Compass Health, a hospital company based in Grover Beach, Calif., will pay $1.1 million in damages in a class action settlement over its labor practices, including asking employees to work overtime hours without appropriate pay. The U.S. District Court for the Central District of California on March 5 granted preliminary approval for the unpaid overtime settlement. The court will consider granting final approval at a hearing scheduled for May 12.
The Compass Health overtime class action lawsuit, filed by lead plaintiff Marlys Jean Tacker, accuses the company of multiple violations of the California labor code, including failing to pay overtime and failing to provide required breaks for meals and rest. The plaintiffs also claimed they were overworked, and their staffing issues led to unsafe conditions for the skilled nursing facilities’ patients, including neglect and failing to provide correct medications.
Compass Health, an operator of skilled nursing facilities, is one of the largest health care providers in the California Central Coast. It operates seven skilled nursing facilities: Arroyo Grande Care Center, Bayside Care Center, Danish Care Center, Central Coast Nursing Center, Mission View Health Center, San Luis Transitional Care and Vineyard Hills Health Center; and two assisted living facilities: Casa de Flores and Wyndham Residence.
All current and former hourly workers employed between March 29, 2009 and Jan. 6, 2014 are required to file a claim before April 22 to receive their share of the unpaid overtime class action settlement, according to the agreement.
