Arctic Zero Frozen Dessert Class Action Lawsuit

A federal class action lawsuit claims Arctic Zero falsely advertises that its frozen desserts have just 150 calories per pint.California consumer Altara Michelle is suing Arctic Zero, Inc. for over $5 million for falsely advertising the calorie content of its frozen dessert products. According to the Arctic Zero class action lawsuit, independent testing and analysis conducted by EMSL, a top food laboratory, found that Artic Zero frozen desserts contain up to 68% more calories than advertised.
“For instance, according to EMSL’s test results, Arctic Zero Vanilla Maple has 45% more calories than the 150 calories advertised on the product packaging and reflected on the nutritional label,” the class action lawsuit states. “Likewise, Chocolate Peanut Butter has 68% more calories than the 150 calories advertised.”
Arctic Zero frozen desserts are sold nationwide on Amazon.com and in over 3,000 grocery stores, including Kings, Whole Foods, Kroger Stores and Dillons.
The Artic Zero false advertising class action lawsuit is brought on behalf of all U.S. persons and business entities that, since 2009, purchased any Artic Zero frozen desserts advertised as containing 150 calories per pint or less. It is seeking damages and restitution for Class Members as well as an injunction barring Artic Zero from continuing to falsely advertise the calorie content of their products.

The case is Altara Michelle v. Arctic Zero, Inc., U.S. District Court, Southern District of California. The Plaintiff and proposed Class is represented by Scott L. Metzger and Annette C.
