Bayer A new birth control lawsuit has been filed against Bayer Healthcare Pharmaceuticals Inc. in which nine young women allege  they have all suffered from complications related to the Mirena IUD.

The Mirena IUD is a birth control device. It is designed to be inserted into the uterus by a physician, where it can remain in place for up to five years, preventing pregnancy through hormonal actions and increasing cervical mucus.

The Bayer birth control lawsuit itself does not delve into the details of the plaintiffs’ injuries. However, most other Mirena lawsuits allege that the device can perforate the uterus, or punch its way through the walls of the organ. Once it punches through the wall of the uterus, the Mirena IUD can damage the other organs of the pelvis and abdomen. Many alleged Mirena complications have required laparoscopic surgery to remove the device. Plaintiffs in Mirena birth control lawsuits have alleged that they have suffered debilitating pain from Mirena complications.

Other alleged complications include permanent damage to the reproductive system. This may include scarring of the uterus and fallopian tubes. Scarring of this sort can cause permanent sterility. Additionally, women who have achieved pregnancy after these complications are more likely to suffer from high-risk pregnancies.

The litigation against Bayer over the Mirena IUD has taken the form of a multidistrict litigation or MDL. MDLs are a type of group lawsuit, similar to a Mirena class action lawsuit. In both MDLs and class action lawsuits, a group of plaintiffs allege that they have suffered similar harm at the hands of the same defendant. The main difference is that in a Mirena class action lawsuit, the legal action starts as a group lawsuit, while the Mirena MDL contains hundreds of individual Mirena lawsuits filed across the country.

The Mirena birth control lawsuit is Danielle Lynch et al v. Bayer Healthcare Pharmaceuticals Incorporated et al, Case No. 7:14-cv-02268-CS, filed in the United States District Court for the Central District of California.

The Mirena MDL is In Re: Mirena IUD Products Liability Litigation, MDL No. 2434, filed in the United States Distrct Court for the Southern District of New York.
