Mirena-IUD-lawsuitsFlorida resident Nicole Minghelli has filed a Mirena IUD lawsuit against drug giant Bayer Healthcare Pharmaceuticals Inc., alleging that the birth control device punctured her uterus and caused serious harm that required surgical intervention.

According to the Mirena lawsuit, Minghelli began using the Mirena IUD in November 2010. When her doctor inserted the medical device into her body, no sign of problems were observed. However, in April 2012, her healthcare providers discovered that the Mirena IUD had “migrated.” This medical term means that the IUD perforated through the walls of the uterus, and moved elsewhere into the abdominal cavity. In May 2012, Minghelli underwent laparoscopic surgery to remove the IUD.

Minghelli’s Mirena lawsuit joins existing litigation that alleges the Mirena IUD can harm the women who use it. These Mirena lawsuits allege that Bayer was aware of the risks associated with the IUD, but downplayed these risks in order to promote the IUD. In fact, the Mirena lawsuits against Bayer allege that despite evidence of the IUD’s dangers dating back several years, Bayer aggressively marketed the device.

To support the claim that Bayer was aware of the risks allegedly associated with the birth control device, the Mirena lawsuit cites research and postmarket surveillance reports. To back up the allegations that Bayer aggressively marketed the device in spite of the risk, the Mirena lawsuit cites a letter by the U.S. Food and Drug Administration (FDA) warning Bayer that advertisements for Mirena were overstating the device’s effectiveness.

Mirena Class Action Lawsuit vs. Mirena Lawsuit

Several of the Mirena lawsuits against Bayer have taken the form of multidistrict litigation (MDL), also called a Mass Tort. Mass Torts are a type of group lawsuit, similar to a Mirena class action lawsuit. The main difference is that a Mirena class action lawsuit is a single legal action involving multiple Class Members, while a Mass Tort consolidates dozens of individually filed lawsuit, which are able to take advantage of the same resources and discovery processes.

Mass Torts are more common than class action lawsuits for drugs and medical lawsuits, since people who are harmed by drugs and medical products often have injuries that vary. Both the Mirena Mass Tort and a Mirena IUD class action lawsuit are designed to streamline the legal process.
