Many people might not count Phoenix as a premier vacation destination. But the city is actually a hub of resorts, culture and attractions that rivals more familiar vacation spots. However, Phoenix’s status as a vacation destination has tangled the city in a recent legal issue in the tourism industry: resort fees.
The City of Phoenix
Phoenix is the sixth largest city in the United States. Winter in Phoenix is relatively mild compared to most of the country, attracting winter-season tourists to its many resorts. Phoenix is also relatively close to Mexico, Los Angeles, and other southwestern vacation spots. Its proximity to several military bases also draws tourists as service-members and their families. And Phoenix is near hiking and camping, historical attractions, and cultural draws including theaters.
Phoenix Resort Fees
One recent issue that has plagued the resort industry in Phoenix and elsewhere is resort fees. Many hotels and resorts have been accused of offering one price online, or in other advertisements, and then charge more money at either check-in or check-out. Some customers have allegedly not been informed of this charge until they arrived at hotels, after making reservations and arriving on-site. It is alleged that this practice violates truth in advertising laws by allowing resorts to advertise a lower price than the actual cost. This practice has received legal and regulatory scrutiny.
Resort Fee Class Action Lawsuit
A class action lawsuit investigation has been launched to explore the possibility of legal action against Phoenix resorts and across the country. The investigation is gathering evidence and contacting potential plaintiffs for potential class action lawsuits. A class action lawsuit is a type of group lawsuit in which a group alleges that its members have all suffered similar harm at the hands of the same defendants.
Class action lawsuits are designed to streamline the legal process and save resources for everyone involved. For example, the plaintiffs can pool their resources for the cost of their legal team, while the defendants only have to face a single lawsuit. Similarly, the court system only has to hold a single trial. In this case, however, the class action lawsuit investigation could result in multiple class action lawsuits. This is because it has been alleged that the practice of charging resort fees is widespread across the hospitality industry. This means that each company that engaged in the practice could potentially face a separate class action lawsuit investigation.
Take Action Now
If you were charged resort fees beyond the advertised price of a resort or hotel, you may be entitled to compensation. But you may need to act quickly, since a legal concept called a statute of limitations may apply. Statutes of limitation are legal time limits that prevent a person from seeking legal action.
