A class action lawsuit has been filed over concerns related to the recent General Motors recall of 1.6 million vehicles over concerns that an ignition switch defect has caused hundreds of deaths.
The GM recall centers on an alleged defect in the ignition switch. The defect may cause the vehicle’s key to switch to the “accessory” or “off” position. This could power down the car while simultaneously deactivating the airbags. If a person is driving, this could suddenly stop their car while disabling a key safety feature. This may have been a factor in as many as 300 vehicle-related deaths. The issue culminated in a recall involving more than a half-dozen types of cars manufactured by GM and related companies.
The GM ignition switch recall covers a variety of makes of cars. GM has produced cars under several different brand names, including Chevrolet, Pontiac, and Saturn. The recall includes cars from various makes, models, and years, some dating back to 2003.
Legal Action
It has been alleged in multiple GM ignition switch class action lawsuits that GM has been aware of the issue since 2001, and that GM did not act quickly enough to recall the vehicles. These class action lawsuits allege that this failure to act may have contributed to deaths and injuries.
The latest GM ignition switch class action lawsuit to be filed is seeking to represent all persons in the United States who currently own or lease one or more of the following GM vehicles:
- 2005-2007 Chevrolet Cobalt
- 2005-2007 Pontiac G5
- 2003-2007 Saturn Ion
- 2006-2007 Chevrolet HHR
- 2005-2006 Pontiac Pursuit
- 2006-2007 Pontiac Solstice
- 2007 Saturn Sky
The GM class action lawsuit is Austin Depalma, et al, v. Gerneral Motors LLC, et al, Case No. 1:14-cv-00681-YK, filed in the United States District Court for the Middle District of Pennsylvania, Scranton.
