Janumet cancer lawsuitA  San Marcos, Texas, woman named Nancy Megerson allegedly died as a result of using the diabetes medications Byetta and Janumet, according to a new lawsuit filed March 31.

The drug injury lawsuit, filed the by the executrix of Megerson’s estate, claims that she used Byetta for a period of one month in 2007 and began using Janumet from August 2008 through May 2012. Megerson was diagnosed with pancreatic cancer on April 20, 2012, and died approximately four months later. According the Byetta/Janumet lawsuit, the drugs were directly responsible for her cancer diagnosis and death.

Janumet is a DPP-4 inhibitor that is supposed to help type-2 diabetes patients who are facing insulin sensitivity. However, studies produced prior to Megerson’s pancreatic cancer diagnosis indicated that pancreatitis occurred six times more often in patients who took that class of drug, and the occurrence was more than 10 times higher for Byetta. Both were linked to a nearly thee-times greater risk of pancreatic cancer side effects compared to other type-2 diabetes treatments, according to the February 2011 study.

While more research has helped to confirm those rates, and public advocacy groups have called for a recall of both classes of medications, Amylin Pharmaceuticals, Eli Lilly, and drug makers have not updated the warning labels regarding the possibility of pancreatic cancer side effects from Janumet, Byetta, Janvuia and Victoza.

As a result, the Janumet lawsuit argues that patients would be unaware of the risks of a disease that has one of the lowest survival rates of any type of cancer. The one-year survival rate is 23 percent; at five years it drops to four percent. Megerson and others would have opted for other treatments had they known of these possibilities, the Janumet lawsuit alleges.

In general, Janumet pancreatic cancer lawsuits are filed individually by each plaintiff and are not class actions.
