Bayer Healthcare Pharmaceuticals has been hit with a wrongful death lawsuit after a Washington, D.C. woman died from side effects allegedly caused by Yaz birth control pills.
According to the Yaz lawsuit, Angela Holland received a prescription for Yaz on April 2, 2012, but received the generic equivalent Gianvi. Less than a month later, she required hospitalization at George Washington Hospital. As a result of a Yaz blood clot, Holland suffered from a cardiac arrest.
She died a few days later, having also faced bleeding and circulatory damage. The autopsy indicated that the generic Yaz birth control pills caused a pulmonary embolism, which lead to the heart failure.
However, defendant Bayer Corporation had already been aware of the risks regarding this family of oral contraceptive treatments, the Yaz lawsuit claims.
In 2008, the U.S. Food and Drug Administration (FDA) took issue with the company’s marketing campaign, not just because it reportedly over-promoted the benefits of the Yaz oral contraceptive, but also because “it contains the progestin, drospirenone … which can lead to hyperkalemia in high risk patients, which may result in potentially serious heart and health problems.”
Hyperkalemia, or a significant increase in potassium levels, is thought to lead to arrhythmias that may cause Gianvi pulmonary embolism side effects.
The Yaz class action lawsuit filed by Holland’s parents, Burnell and Marilyn Holland, argues that the company should have performed more testing as the hormone differed significantly from older generations of oral contraceptive options.
The Yaz lawsuit also claims that if the company had been more diligent in updating its warning labels, Holland and others would have monitored their potassium levels or used other birth control options. Studies cited in complaints filed in centralized litigation indicate the risk for blood clotting is significantly higher compared to alternatives.
