Vivint class action lawsuitA potential class action lawsuit is looming against security company Vivint Inc. for allegedly not compensating employees who went to mandatory training. The class action lawsuit would include former and current employees of Vivint in California, where the line in mandatory training under its labor law is clearly defined.

Under California’s wage and hour law, employers are required to pay individuals for attending certain types of mandatory training programs, lectures and meetings. One may be entitled to compensation either as an employee or an individual who underwent training but never became an employee.

The law is clear that “pre-hiring training” or making the training as part of the interview process will not hold water because employers are still required to pay. Companies that violate Fair Labor Standards Act guidelines face harsh penalties from the Department of Labor.

The only time training without pay is allowed is if the following criteria are met:

  • Attendance is outside regular working hours;
  • Attendance is voluntary (Attendance is not voluntary if the employee is led to believe that present working conditions or the continuation of employment would be adversely affected by failure to attend);
  • The course, lecture, or meeting is not directly related to the employee’s job (Training is directly related to an employee’s job if it is designed to make the employee handle his job more effectively as distinguished from training him for another job or to a new or additional skill); and
  • The employee does not perform any productive work during such attendance.

(formerly known as APX Alarm Security Solutions Inc.) is a private home security company that provides security systems and energy conservation services throughout the United States and Canada. Its headquarters are in Provo, Utah, and was first established in 1997. Due to its rapid growth and success it was named as one of America’s most promising companies in 2013 by Forbes Magazine, ranking 46 out of the 100 privately held companies listed.

However, Vivint is facing long-standing complaints about pricing, aggressive marketing tactics, and now unpaid job training.
