Frito-Lay “All Natural” Bean Dip Class Action Lawsuit

PepsiCo has been hit with a class action lawsuit claiming it misleads consumers by labeling its Frito-Lay snack products – in particular it’s Bean Dip – as “All Natural.”
Lead Plaintiff Kelli Altman alleges in the Frito-Lay “All Natural” class action lawsuit that Frito-Lay Bean Dip and other Frito-Lay snack products cannot be labeled as all-natural because they contain soy and other ingredients that “are known to be derived from GMOs.”
Products containing GMOs (genetically modified organisms) should not be labeled as “all natural” unless they also disclose that the product contains GMOs, Altman says in the class action lawsuit.
This is not the first time Frito-Lay products have been the subject of false advertising class action lawsuits.
At least two class action lawsuits have been filed over Frito-Lay Tostitos & SunChips, which Plaintiffs say are mislabeled as “All Natural” because they contain GMOs. The company was hit with a third false advertising class action lawsuit concerning it’s Lay’s Potato Chips, which Plaintiffs assert are misbranded as healthy through misleading advertising claims that the chips contain “0 grams of Trans Fat.”
Altman is seeking to represent a proposed class of all Florida consumers who purchased Frito-Lay “All Natural” products over the past four years. She is seeking injunctive relief, restitution, actual damages, punitive damages and more for alleged violations of Florida’s Deceptive and Unfair Trade Practices Act and unjust enrichment.
The Frito-Lay Bean Dip “All Natural” Class Action Lawsuit case is Altman v. Frito-Lay, Inc., Case No. 12-cv-61803, U.S. District Court, Southern District of Florida.
UPDATE: On Oct. 3, 2017, Frito-Lay has agreed to end five years of litigation over labeling on its products that indicate they are “made with all natural ingredients” by changing its labels.
