Barnes & Noble PIN Code Theft Class Action Lawsuit Filed

Barnes & NobleAs predicted, the first of what could be many consumer class action lawsuits against Barnes & Noble has been filed over the September 2012 PIN code skimming scheme that compromised the debit and credit card information of thousands of customers.

Illinois consumer Elizabeth Nowak filed the Barnes & Noble class action lawsuit just days after the company announced a hacking operation it discovered last month that impacted 63 stores in California, Connecticut, Florida, Illinois, Massachusetts, New Jersey, New York, Pennsylvania and Rhode Island.

According to the company, hackers planted bugs in a single card reader at each of the stores, which allowed them to steal account information and PIN codes of customers who used the card readers to swipe their credit or debit cards during purchases.

“Barnes & Noble’s security failures enabled the skimmers to steal financial data from within Barnes & Noble’s stores and subsequently make unauthorized purchases” on patrons’ cards, Nowak alleges in the Barnes & Noble PIN pad data breach class action lawsuit.

Nowak says not only did Barnes & Noble fail to protect the credit and debit card information of its customers, but it also waited nearly six weeks to publicly disclose the data breach, putting customers at risk for theft.

Nowak is seeking to represent a proposed class of anyone who swiped their card through one of the affected stores’ PIN pads from November 1, 2010 to the present. She is seeking unspecified money damages and three years of credit monitoring services for Class Members for alleged violation of Illinois consumer fraud laws and breach of implied contract.

The Barnes & Noble PIN Data Breach Class Action Lawsuit case is Nowak v. Barnes & Noble, Inc., Case No. 12-cv-8617, U.S. District Court, Northern District of Illinois (Chicago).

    B&N customers can actually READ and know what a problem this is. If this had been the worlds largest retailer, there would not be a class action suit. They don’t know what a class action suit is. ” A oufit for PE class? “
