Monster Rehab Energy Drink Class Action Lawsuit

Monster Rehab energy drinkMonster Energy Co. has been hit with a class action lawsuit claiming that its Monster Rehab Green Tea + Energy drink contains unknown amounts of epigallocatechin-3-gallate (ECGC), “an extremely dangerous and potentially lethal ingredient,” and that the company fails to warn consumers that it could cause hepatoxic side effects, or chemical-driven liver damage.

California resident and lead plaintiff Jennifer Wooding alleges in the Monster Rehab class action lawsuit that medical research shows ECGC has been linked to liver injuries and could cause adverse side effects, and that it should not be consumed with alcohol or by those with compromised livers. Yet advertisements for Monster Rehab suggest it should be consumed as a pick-me-up after a long night of partying. 

“Instead of being the safe energy drink that Defendants promised, the subject product causes dangerous hepatotoxic side effects, including without limitation, death, acute liver failure, hepatitis and other liver injuries,” the Monster Rehab class action lawsuit says. “Despite knowing that the subject product could result in severe injury and even death in susceptible users, Defendants marketed and sold the subject product to millions of unsuspecting consumers without any warning whatsoever.”

While ECGC has antioxidant properties in small doses, the class action lawsuit points to 20-year-old research that shows ECGC has toxic liver effects “when used in the doses present in dietary supplements.”

Monster Rehab Green Tea + Energy contains an unknown amount of ECGC, which has been linked to numerous cases of liver injury in Europe, the class action lawsuit says.

It is the latest development in a series of legal filings against the popular energy drink company.

The FDA is investigating five deaths and one non-fatal heart attack in connection with Monster Energy drinks that occurred over the past year. The family of one of these victims, a 14-year-old girl who died of a toxic caffeine overdose, has filed a wrongful death lawsuit against Monster over their daughter’s death. The company has also been hit with a class action securities fraud lawsuit filed by investors accusing Monster of failing to disclose it is being investigated for alleged false advertising and marketing by a state Attorney General.

Other energy drink makers are also facing litigation over allegedly dangerous amounts of caffeine in their products. The makers of Four Loko are still fighting a class action lawsuit alleging the now-banned alcoholic energy drink “causes sickness and alcohol poisoning, and even death.” And an October 2012 class action lawsuit claims VPX Redline energy drink causes extreme adverse health effects that resemble a cocaine overdose.

The Monster energy drink class action lawsuit is seeking to represent a proposed class of all consumers nationwide that purchased Monster Rehab Tea + Energy. It is seeking restitution, punitive and treble damages, a corrective advertising campaign and more for alleged violations of the Consumers Legal Remedies Act and California Business and Professions Code, breach of express and implied warranties, and unjust enrichment.

    Damn this is the first I’m hearing this. I wondered what happened to these in particular, why they were so hard to find and only ever found on military bases. Seriously why the hell was I still finding so many of these years later at military bases…….and they were the only place you could find these. Wow.

      I had no idea either, though back when I was drinking them every morning, my wife would harp done that “those things will kill you!” More from irrational worry than from actual knowledge. My boss mention a few times at work too; but he couldn’t complain about my lack of energy. He, himself, used to drink Red Bull like most people drink coffee.

        I have a Primary Dr. Cardiologist and Internist who approve the Rehabs. I made it through Cancer because of the rehab drinks. My blood work was great. I now mainly drink the Strawberry lemonade and Watermelon. I have 4/5 day. No kind of jotters or crash effects. The California Lawsuit was Dismissed!! Read the Ingredients. Electrolytes all the B vitamins and even Coconut Juice in it. Low Sugar and all tastes amazing! Main reason no Carbonation!!!!

    I loved this monster energy version of the drink. I would drink it on occasion, but I wouldn’t chug these down like soda. I was sad to see these gone and now I know why. Most energy drinks are bad for you, that’s why they have the warnings on the nutrition labels. The symbol is there to show that the levels of all of the ingredients are not based on a 2000 cal diet. They even have a label that clearly states for children, women who are pregnant, and people sensitive to caffeine to not consume the drink. So, for the unfortunate death of the child in this article, I agree it is the parent’s responsibility to watch and educate their children on what do and not to do. Its also simple common sense; if you get a headache from an energy drink, you may not be used to consuming that much caffeine in a single setting.

    Oh and when I was in the Marine Corps. most of us drink these (all Monster Products) all the time close to if not an actual overdose on a daily basis and if we are in a combat zone we drink worse. So really why would the public do this.

    LMFAO wow I have massive health problems and it is a known fact that drinking to much or anything is bad. Green tea in large amounts isn’t good for anyone at all anyways. But others shouldn’t have to be affected for a few that have either abused the Monster Product or some kinda freak thing. And it is known that energy drinks and liquor don’t mix but because of the high people are gonna mix them. I really wish 5his world was heading in a different way but it’s not. People just want a quick buck these days and working for it is so out of the question.

      I’ve seen lately on tv commercials that green tea is the most healthy of all the easily available teas, and black tea is the worst. I’m drinking a Minster Rehab Lemonade right now. About thirteen years ago (2007-ish) ivhad migrated my daily morning caffeine jolt from Fiet Coke to Monster +Lenonade + Energy. Maybe that’s why I now have “unspecified liver damage” on my doctors’ reports. But my gastroenterologist never did more testing to confirm or identify what or why. Hmmm. Makes me think I ought to go dump the rest of this can down the drain and drink Diet Coke instead!

    I used to drink the monster green tea a lot ..I was loosing wait but then one day I drank it and got a numb filling and like a rush filling in my fingers and I new it was from drinking the monster green tea drink so to test myself I stop drinking It for awhile like a month then just to try it again it did the same filling so I stopped but now I still have trouble sometimes I think it messed me up from drinking it to much..

    Why is a 14 year old girl drinking anything other than smoothies, milk, and water? Her parents are to blame for not bestowing healthy habits on her. America is so stupid. It is so cheap to eat healthy. People just don’t want to take the 2 hours plus to prep there food for the week. Quit looking for quick fixes. That little girl should of been eating a huge breakfast, not drinking caffeinated drinks with supplements her parents probably cannot even pronounce. People going to start suing alcohol companies for cancer and other related effects even though they are not alcoholics?

      Actually – alcohol companie should be sued for alcoholism and liver damage among others . Oh the cigarette companies should be sued for lung cancer.
      I’d rather see these going down than monster green tea. Come on !
