Lucky BrandLucky Brand Dungarees Inc. and several marketing subcontractors have reached a $9.9 million class action lawsuit settlement over allegations they sent unsolicited text spam during a 2008 marketing promotion. If you were sent a text message in August or September 2008 for a “Back to School” promotion by Lucky Brand Jeans, you can receive up to $100 cash from the Lucky text class action settlement.

The Lucky Brand text settlement will resolve a class action lawsuit, titled Robles v. Lucky Brand Dungarees Inc., that alleges the companies sent thousands of unsolicited text messages to cellphones offering $25 off Lucky jeans or offering store location services to consumers that responded with their ZIP codes.

These text messages violated the federal Telephone Consumer Protection Act (TCPA), which prohibits companies from contacting people on their mobile phones by using an “automatic telephone dialing system” or using “an artificial or prerecorded voice” without their prior express consent, the class action lawsuit says.

Lucky and the co-defendants deny any wrongdoing but have agreed to a $9.9 million class action lawsuit settlement to resolve the litigation.

Class Members of the Lucky Brand text class action settlement include all persons nationwide who, from August 24, 2008 until September 15, 2008, were sent text messages promoting Lucky Brand Jeans’ “Back to School” promotion from the short code 88202.

Class Members that submit a valid and timely Claim Form by the April 19, 2013 deadline can receive up to $100. This amount may be reduced depending on the number of valid claims submitted.

A Final Fairness hearing is scheduled for May 10, 2013. Settlement checks will be mailed within 60-90 days after the class action lawsuit settlement has been finally approved and/or after any appeals have been resolved in favor of the settlement.
