Court Approves $69M Volkswagen/Audi Leak Sunroof Settlement

VolkswagenAudiA federal court has approved a $69 million class action lawsuit settlement over leaky sunroof problems on 80 different Volkswagen and Audi models. Class Members that submitted a Claim Form by the deadline can expect to receive their settlement checks in the mail within the next 45 days or so.

The settlement brings an end to a “difficult and complex” class action lawsuit that lasted more than five years and suffered several major blows, including a settlement rejection earlier this year over fairness issues. A new Volkswagen/Audi leaky sunroof class action settlement was reached that provided equal benefits to all Class Members and allowed additional vehicle owners to participate.

On December 14, a New Jersey federal court approved the amended Volkswagen/Audi leaky sunroof class action lawsuit settlement, which will provide reimbursements and other benefits to Volkswagen and Audi owners that suffered damage caused by sunroof drainage problems.

Volkswagen also agreed under the final settlement to pay attorneys’ fees separately from the reimbursement fund and to grow the fund if necessary, thereby guaranteeing Class Members will receive 100% on their claims.

“I have to give credit to defendant Volkswagen to be willing to do that,” said Samuel P. Sporn of co-lead counsel Schoengold & Sporn. “After all, it’s their customers.”

The deadline to file a claim for the Volkswagen/Audi Water Ingress Class Action Lawsuit Settlement was November 26, 2012.

    My 2008 Q7 has been having leaking sunroof drains (accompanied by a soaked front passenger side floor) and battery drain. I took off the fuse cover on the front passenger side next to the glove box, and found a large amount of rust (indicating that there is a leak).
    I spoke with the local dealer and they claimed they have not heard of this before, ran my VIN number and said there are no recalls or notifications about any defects. I am hesitant to take it into the dealer for repair knowing they will likely charge me an arm and a leg to research and repair.
    I have been stranded at times after turning the car off and there is not enough battery power to turn the car on.

    Does anyone know if this will be opened again — this is a result of poor design and is just not right.
    Please let me know if there is any update and I will submit this into the TCA website.
    This is VERY frustrating.

      I have a 2008 Q7 and have had the same issue going on for the last year and half. This issue has caused my entire radio/navigation system to go out. EVERY TIME it rains, water gets in my car. This is beyond frustrating. Has anyone found a resolution to this problem? It’s sad this issue continues even with newer models…smh

    This is happening with my 2015 Q7 and has been happening for the last few years and I have gone through 3 batteries and they just now are figuring out the problem and asking for $2500 to fix it and replace the electrical/speaker. I’m ready to sue because his has cost me so much money and caused so much emotional distress. I have been stranded on the side of the road numerous times with my children and pregnant for hours at a time waiting for tow trucks. This is not what I signed up for when I purchased an Audi.

    I have a 2006 Passat that flooded with rain water coming inside of the car from the sunroof.
    There was a class action lawsuit in 2012 regarding the same issue. Will I still be able to get my car fixed under the same lawsuit?

    Has anyone has this covered? Dealing with mine now, this is my 4th time I have my 2010 Q7 in for this issue. Prior two were in the front, this issue happened in the back right and has blown the amp. Waiting to see whether or not the extended warranty covers this, but I am nervous it won’t. Anyone make any progress with audi directly?

      I am having this issue now with my wife’s 2009 Q7. Car won’t start at times and we get the EPC Fault message.
