employment Background CheckAn Ohio federal judge has granted final approval to an $18.6 million class action lawsuit settlement with Intellicorp Records Inc. and Insurance Information Exchange (IIX) that could provide between $50 and $2,000 to consumers who had criminal background reports submitted by the companies to employers. Payments will begin going out in late summer, according to some reports.

On June 5, U.S. District Judge James S. Gwin approved the Intellicorp background check class action settlement, calling it “fair, reasonable and adequate.” The deal resolves multiple class action lawsuits accusing Intellicorp and IIX of violating the federal Fair Credit Reporting Act (FCRA) by furnishing criminal background reports to employers that included inaccurate information and/or failing to send required notices to individuals whose criminal history information was reported to an employer.

Class Members of the Intellicorp class action settlement include all U.S. residents who were the subject of a report furnished to a third party by Intellicorp or IIX between April 16, 2010 and Sept. 16, 2013.

Class Members had until April 21, 2014 to submit a claim to receive a check for $50 if they were the subject of a Criminal SuperSearch that contained a record of a criminal or traffic arrest, conviction or other criminal history and who were not mailed a notification. These Class Members could also submit a claim to receive up to $2,000 if they believed their reports were inaccurate (to be reduced pro rata if too many claims were filed).

Class Members are reporting to Top Class Actions that the Settlement Administrator has sent out email notices alerting them that as long as no appeals are filed, the first approved cash payments will be paid at the end of the summer/beginning of fall for Class Members who were subject of a Criminal SuperSearch but did not receive a notification.

The second approved cash payment, which is being made only to those Class Members who filed a valid Claim Form by the deadline, will be paid in accordance with the Court’s order, after the first distribution is complete. These payments are not expected to be made until the early 2015.

Top Class Actions cannot confirm the validity of these timelines as they’re not currently posted on the Settlement Website for the Intellicorp class action settlement: www.intellicorpclassaction.com. Class Members can go to this site to request a current report after July 7, 2014.

      They sent me a check on 8.15.14 of $50.
      I did not cash it, Im trying to contact these attorneys, if I find them, I’ll let you know.
      $50 is a slap in the face.

        i havent received mine at all its been 5 years waiting and nothing has been done…..do you have any info about it….or who i can call ive called that 1855 number but it does not work

    I took the check to Walmart and a check cashing place and both locations couldn’t verify it! Is there a specific bank to take it to?

    I applied for jobs from April 16/2010 and Sept 16.2013. And the jobs that I applied for did a background check and found out that I did time in prison and they did not hire me.       They will write you a letter, every job I had. I had to get a background check. They sent me a letter I wasn’t on the list. William that is too much information to put out there. Go to website or call the number. did you file a claim?
