GM ignition switch recall class action lawsuit

A report by the Center for Auto Safety alleges that more than 2,004 individual cases of death and injury should be included in General Motors’ list of ignition switch recall cases, which could increase the number of plaintiffs in the ongoing GM ignition switch recall lawsuits.

Several GM models were recalled due to faulty ignition switch design, which could unexpectedly turn off the engine during a drive. Various news reports and GM ignition switch lawsuits allege that GM engineers discovered the faulty ignition switch as early as 2001. Because of the deadly flaw in the design of the GM ignition switch, a driver’s car key may suddenly move to the “accessory” or “off” position without the driver’s knowledge. In addition to the potential for accidents when the engine shuts off, the lack of power in the car also prevents the airbags from deploying.

GM recall class action lawsuits and wrongful death lawsuits allege the company did not immediately act to correct the ignition switch problem even though officials knew of the risk of injury and death. GM finally initiated a limited ignition switch recall in February. GM was fined $35 million by the National Highway Traffic Safety Administration and is the subject of several government investigations. The recall has since expanded, leading to GM recall lawsuits.

Many of the cases included in the Center for Auto Safety report list injuries and deaths that were not included in GM’s initial list of ignition switch death victims. GM’s list was almost solely limited to driver and passenger injuries and deaths that were directly linked to the lack of airbag deployment. The official GM list only acknowledges 13 deaths and 47 accidents resulting from ignition switch failure. The CAS report puts the number of deaths due to GM ignition switch failure closer to 300.
