UPDATE 11/12/13: eMachines Extends Cash Option Deadline for Class Action Settlement

UPDATE: A federal court approved the eMachines Computer Class Action Lawsuit Settlement at the Final Approval Hearing. Class Members have until July 15, 2013 to file a claim. Distribution of the Settlement Awards will be made in the fall of 2013. See how to file a claim for the eMachines Computer Settlement.

A proposed class action lawsuit settlement has been reached over allegations eMachines sold defective computers. If you purchased an eMachines computer, you may be entitled to a replacement computer, accessories or $62.50 in cash if the class action settlement is approved.

The eMachines settlement will resolve a class action lawsuit, titled Stroud v. eMachines Inc., that alleges the defendants sold computers with a defective part that could cause the loss or corruption of data written to, or read from, a floppy disk. eMachines denies any wrongdoing but has agreed to a class action lawsuit settlement to resolve the litigation.

Class Members of the eMachines computer class action settlement include anyone who purchased the following computers from eMachines or an eMachines authorized reseller (a retail store) in the United States on or after December 31, 1997:

eMachines model numbers

Class Members have the option to receive a replacement computer and/or accessories or a cash payment. Class Members who complete and submit a valid claim form and Proof of Purchase will receive a redemption certificate with a face value of $365 that can be used toward an Acer, Gateway, or eMachines replacement computer and/or accessories or be exchanged for $62.50 cash.

Regardless of which benefit you choose, you will not be required to return your original computer.

The only way to receive benefits from the eMachines class action settlement is to submit a claim form postmarked by July 15, 2013.

A Final Fairness Hearing is scheduled for March 25, 2013.

Claim Forms and more information on your rights in the eMachines Class Action Lawsuit Settlement can be found at www.eMachinesFloppyDiskSettlement.com.

I own two of these, the company is long since closed that sold them. These models are more than 10 years old, who would have the receipt for it?

    • Brenda January 20, 2014

I got a post card in the mail about 6 months ago stating if I wanted to be in the settlement I had to send back a copy of my DL. Nothing was said about a receipt. I think I probably filled out the registration card when I got the EMachine new so maybe that is why they did not ask for a receipt.

Again I will tell you it is not a scam. I choose to get a replacement laptop instead of the money and I am currently typing on it. It is a refurbished Gateway and I love it! So send the postcard in with everything you have even if you don’t have a receipt tell them where you bought it and approx when you bought it. Good luck and hope you get to enjoy a new laptop!

      • melissa January 21, 2014

        Hi, Brenda,
I see your post was just yesterday – I plan to redeem my certificate soon, and from what I read, I will have to pay shipping, or can use any leftover $$ for expedited shipping. Did you have to pay shipping?

I plan to redeem for a laptop or desktop that is less than $365, and have read on a few other websites where individuals did not enter their credit card number and still received their product. Did you submit your credit card number? Did you have any issues with your credit card being charged, etc.?

I, too, do not think this is a scam, but am concerned about paying a disproportionate shipping fee or having an issue with the security of my credit card.

I would appreciate your response and any other comments or advice you may have for a smooth redemption.
        Thanks,
        Melissa

      • Joe C February 16, 2014

Hi, I got my mailer from them last June and sent it in promptly and have yet to receive anything. So I’m still up in the air about it. Any way of looking for progress you know of?

        • Anna March 16, 2014

I sent in three forms for the settlement, certified mail. All three forms were received by the emachine settlement administrator on the same day, Feb. 19, 2013. I only received redemption certificates for two of them, and promptly used them for desk top computers. I have not yet received the third one. According to their website, the settlement’s telephone number is 1-888-623-6174 if there are any questions.

Did you add your email address? Check there or start again online. hope this helps.

  • Mike January 7, 2013

This is the silliest lawsuit ever! These were awful computers – I owned two or three of them while I was in college about 10 years ago. But I didn’t keep the receipts when I bought them at Best Buy. They will get no one to actually file for this given the fact that it includes people that bought eMachine computers in 1997 – who keeps a 15 year old receipt for a junky computer?

  • Mary January 7, 2013

This is a waste of a lawsuit, I sold one of mine at a yard sale, years years, ago. No I don’t keep receipts that long either, should just give the $62.00 to people, I do have a old photo with my child on it, would that count.

  • Ron January 8, 2013

I had a E Machine in 1997 it was junk I took it back to Circuit City 3 times and each time they gave me another one in place of the old one.It never worked right they said they did all they could do then the warranty ran out and I was stuck with junk so I threw it in the trash and went and got me a new computer and it worked just fine. Now they come out with a law suite and I have no recept or no paper work to show I owned one plus I can’t get Circuit City to get me proof that I owned one they went out of business. So what do I do now.

  • Eric Spivey January 9, 2013

Have model T5026, hard drive replaced twice. Now its just a big paper weight. Oh receipt, yeah right!

  • Kent January 10, 2013

I concur with the above comments.

Wast of time and another pay day for the lawyers. Seriously, who the hell keeps a receipt for that long?

I purchased mine in a store called Circuit City…no longer in business.

  • TM January 12, 2013

Purchased mine’s long ago at Circuit City. Receipt? What a joke.

  • Gary January 14, 2013

I have an EL1200 that has the same problem. I got no help from e Machine, because it was just over warranty. I bought a new computer not a Gateway product

  • TJ January 16, 2013

Reading closely into this the proof required is a Copy of a state or federal picture ID and a receipt or invoice or a picture showing the model and serial number.

Since I still have the dead tower I can handle that one for one of my machines but the other is long gone unless I some how find the receipt for it.

  • Ray January 22, 2013

I just got a claim form in the mail, that says according to warranty records I’m included in the lawsuit. It only asks for a copy of my DL, the word “receipt” or “proof” doesn’t appear.

  • Pete January 22, 2013

I received my claim form today. If I submit a copy of my driver license or govt issued ID they will have my SSAN, birth date and and other pertinent data. No receipt was requested. I have to assume the claim I received is a scam tangential to the real settlement. In any case, I have no intentions of submitting any information

  • Norman January 22, 2013

If you filled out a warranty card then they also sent info by a post card in mail to you. I checked and by putting in the number on the card they knew the model number I had.

  • Nick January 22, 2013

The postcard I just got doesn’t say anything about needing to provide a receipt. I too don’t like providing my SSN but I also don’t think it’s a scam (if it is, it’s pretty elaborate). I wonder if we can just cross out our ssn on the drivers license.

  • R Bloomer January 22, 2013

If you received a post card from them, you just go to the website on the card. You enter the ems claim number above your name on the card.It opens a page with your information on it.You can then print a pdf page to be submitted. They explain that when you copy your drivers license to mail in, you can cross out all info except your name and the photo.

  • OE January 22, 2013

Received 21 cards today for this lawsuit, not sure why I was sent 21 cards…all saying same thing no mention whatsoever about producing a receipt. Just asks for a copy of DL or Gov ID, signature, name and date.

  • Frank January 22, 2013

I going to do some research on this, but why are people on here saying they need a “receipt”? It does not say that ANYWHERE on the card. The only place that “Proof of Purchase” is mentioned is on this site.

  • Frank January 22, 2013

I just looked at the actual settlement. You need to submit your Driver’s License or other gov’t issued ID and “Proof of Purchase” which is either a receipt or other proof that you bought the machine OR return the “Claim Form” that you received. That will take the place of a receipt or other proof that you bought it. The logic is that you wouldn’t be receiving the “Claim Form” card unless you were in their data base as a purchaser.

  • smelli pheet January 22, 2013

There is no rhyme or reason for them to get a copy of your government issued photo ID unless its to populate some face recognition biometric system that points out suckers, me included, who bought pos eMachines.

What if their database gets hacked and stolen. What safeguards do they have?

  • Don January 22, 2013

I don’t think I’ll bite on this one. There are too many scam
going one these days Send a SS number and or drivers license photo copy, I think NOT ! I owned two Emachines , the first one was a lemon, that was a dozen years ago, I bought one 4 years ago it works just fine. Not worth the risk..

  • AlexisMH January 23, 2013

    R. Bloomer is right. I was extremely wary about sending a copy of my driver’s license so I started checking around online and found this site. I went to the website, entered the claim number and I got a .pdf to print out that doesn’t ask for that kind of ID. I feel much better about this. I had an eMachine in the 90s and it was a piece of junk.

  • Jerry January 23, 2013

“There is no rhyme or reason for them to get a copy of your government issued photo ID”

I fully agree with that statement. No one took my picture when I bought the machine, so there[‘s no way to compare whether it’s “me” or not.

I think the drivers’ license ot govt I.D.is a stipulation the eMachine lawyers put in there because they know that people are averse giving out any more personal information than is absolutely necessary. Ergo there will be fewer claims, even though waranted under the class action

  • JRR January 23, 2013

And to get the full $365 you have to buy through this secondipity.com? It specializes in refurbs. Sounds like a scam to send you to their website and grab your info (if they haven’t grabbed it through your application).

  • Jo January 23, 2013

I have owned two of them since 1997 and I have two post cards. I looked at the pdf website with the claim form and if you have a post card then you do not need a receipt. As far as the ID, it said you can black out everything except for the picture and name. Both of mine were a piece of junk, I will take the cash or a acer.

  • marshsheryl January 23, 2013

you all are getting all bent out of shape for nothing. The card that I got in the mail does NOT ask for a receipt . Just send in the card and picture ID and give it a chance. PLEEEEZE

  • Ray January 23, 2013

Well I’m just gonna fold up a photocopy of my DL, put it between the 2 parts of the postcard they sent me with the return addy on one side, and tape it closed, and mail it back..
If it is some kind of phishing scam, then THIS website (topclassactions.com) is part of it, because the pdf form available here requests it be sent to the same P.O. box that’s the return addy on the postcard. The only diff is the return zip+4 on the postcard is 02940-3000 and the pdf is supposed to be addressed to 02940-3143

  • Majipoorsbeard January 23, 2013

This is all BS**t. I have never ever seen anything from a settlement other than make a claim. You are only sent a claim if you are in a database resulting from the suit. If you play this game you probably sent money to Guiana to claim the bank account.

  • jp January 23, 2013

I remember buying the Etower many years ago, but a receipt?, don’t be ridiculous. Credit card was probably the way of the warranty since I don’t fill out warranty info. But, why does the post card have the last letter of my last name incorrect? It won’t match up with my license. Probable cause to dismiss my claim?

  • Barb January 23, 2013

I do think this is a scam. I have done numerous legit class action lawsuits and I have NEVER been asked to have a photo ID like a drivers license and I have NEVER received multiple notices.

You can verify scams for class action lawsuits on product purchases by (link to external site deleted by editor) Emachine does not show up under complete listing. I emailed them but am sure they will verify our conclusion.

Note from the editor (Scott Hardy) We (Top Class Actions) were not paid to post this information. We report on settlements but unless we are included in the notification plan we aren’t paid. We are not connected to this settlement in any way. We found the settlement and are reporting on it as a benefit for our viewers.

  • wblscott January 23, 2013

No receipt is required. Claimants get $62.50 each, while the 13 attorneys split $50 million. What could be more fair. That’s only $3.8 million per attorney. They should probably get a lot more.

  • Mark January 23, 2013

Not getting my ID, I just dug this computer up the other day to get ready to throw it out, maybe I’ll just use it for target practice. All class actions are a waste other than life threatening cases they should not be allowed.

  • Ted January 25, 2013

I agree that no receipt is required. But I also would only send a copy of my D.L. if I can blackout everything except my name and picture. The notice sent doesn’t say thst that’s OK. I want the $62.50, but only if I can send a blacked out copy of my DL. Where did you guys see the OK for that?

  • DrDoom January 25, 2013

You can black out all information on the Photo ID copy, except the photo & name. This is a quote from the claims website, found when generating a claims form:
“You may black out the personal information on the copy of your ID, but your photograph and name must be legible and the name must be associated with the Notice you received.”

  • lisap January 25, 2013

Ok, NO receipt needed, BUT you need to send photo id..
When we bought ours we filled out the warranty. Bought it at Circuit City. Now 10+ years later get this notice. Could be real or could be information that never made it to the shredder. hhmmm

  • jb January 26, 2013

There are still states that use your SSN on your driver’s license?

  • Sammie January 26, 2013

I got this postcard the other day, I have had two E-machines, never had a minute’s problem with either of them.
I am leery of sending a photo id, why would they want my picture, they didn’t take one when I bought the computer.
They obviously know I bought the computer or they wouldn’t have sent me the postcard, so why do I need a receipt? Ridiculous!
In light of the current Fed ex scam, they send you an email or postcard, claiming to have a package that was undeliverable, go to this website, and when you do, you get a virus.
Fedex will leave a note on your door if they couldn’t deliver it, or leave the package unless it needed a signature.
Too many scams out there, I’m thinking I’ll pass.

  • jb January 27, 2013

Seeing the astounding lack of reading comprehension in here, I’m amazed some of you can even use a computer.

  • Melissa January 27, 2013

I’m going to do it. If you got a post card for this lawsuit, they already have your name and address, right? So, besides your driver License number what other information can they gain from your DL.? If you heard about the lawsuit afterwards, you’d be saying “why didn’t I get in on it”. My emachine didn’t run at all, but it was all I could afford at the time.

  • Dorene January 28, 2013

My e-machine was a gift, my first computer and it had a mind of it own would come on in the middle of the nght and also go off whenever. Because it was a gift I have no receipt.

  • Ray January 28, 2013

Wonder when the redemption certs are going to be sent to claimants. I know the judge has to approve the settlement in march, but hopefully they’ll start sending them out before the july deadline.

  • DP January 28, 2013

The class action settlement us lusted on the emachines Website. They want the drivers license as part of the proof of purchase. You use also supply some evidence of purchase, a bank or credit card statement, shipping invoice or a photo of the computer showing model and serial #. Who still ha s any proof of purchase 10 years later? And who still holds onto a non working pos 10 years later?? Unfair!

  • Robert January 28, 2013

I had to through out my machine because it was so currupt it would not function. I purchased an Acer Aspire 6920 and over a course of 4 years it has had to be serviced a total of six times. To this day it still has problems.

  • Roslyn Moore-Allen January 28, 2013

I have moved 2X since I purchased 2 emachines in about 8 years ago. I brought them from Walmart, purchasing them a day apart. Is there any hope for folks that have moved since they made the purchase.

  • Rob Wallace January 28, 2013

I Purchased One i 2000 and thinking I had bought a lemon I got another one in 2001 which turned out to be a P.O.S. also

  • johnm49 January 29, 2013

I still have mine and all the paperwork from 1999 but don’t understand why they would want a copy of my drivers license. I had to replace the power supply long ago and haven’t used the computer in years. What happens if you send the card in without the ID?

  • arlene January 29, 2013

bought my first E machine in 2002 and actually have the receipt but since it was printed on Circuit City emulsion type paper it is very light. Someone had written pro pro 556!! on it. I can still just read the price and the big E. It is a little strange that they want a picture but whatever, I will be getting a new puter, I’m in.

  • Pat January 29, 2013

My e machine was a gift from my daughter. I no longer have the machine. Does this mean I still have a legal right to this claim?

  • Brian C January 29, 2013

You may black out everything but your name & photo on your ID copy you send in.
I wasn’t going to participate because no way was I sending a copy of my drivers license to anyone. Then I found out you could black out all but your name and photo. So I’m in.

  • pam January 29, 2013

Anyone have a number to call from that card you all got? Please…I’ve moved across country and didn’t get a post card, but I have 3 of these machines sitting in my house right now?

  • johnm49 January 29, 2013

Here’s the contact number on my card 1-888-623-6174

  • Mark Serva January 29, 2013

I had two of those eMachines. First one was so good and cheap I bought another. Lasted about a year and ended up running one with an external floppy. About $150 back then. Wish I had saved a receipt as that got to be 10 years ago. Who saves such info that long?

  • rhonda January 31, 2013

What if i no longer have the reciet when i bought my computor?

  • Lisa January 31, 2013

No one needs a receipt! I have the card which was mailed to me and all they need is a photo of your drivers license.

  • LB February 2, 2013

Lisa @ 52, You most likely received the post card because you warrantied your computer, so they have proof that you had the computer. If the purchaser never sent in the warranty, you have to send in some sort of proof that you bought the computer. I had an eMachine about 8 years ago, but never sent in the warranty. I would have to mail in a copy of the receipt, packing list, or a photo of the computer. Unfortunately, I have none of those, so I am out of luck. As others have said, this one is mainly for the Lawyers to get more money…

  • J. F. February 3, 2013

If you read the small print it says: If you submit a claim form or do nothing, you are choosing to stay in the settlement.

  • Ray February 5, 2013

I’d like to redeem for a refurbed computer, but I hope there isn’t a run on what looks like a rather limited supply from secondipity, when the redemption coupons are handed out…or they don’t quadruple the prices, lol!

  • Karen Kelton February 5, 2013

I bought two of the eMachines computers and I got two postcards in the mail. Both computers were worthless. Most people fill out the warranty card when they buy things. That’s where they got our addresses. If you filled out the warranty but have moved, you should contact them at 1-888-623-6174. I have been watching this ongoing lawsuit and I am glad it is almost resolved. You can get $62.50 cash or $365 toward an Acer, Gateway, or eMachines computer. I have an Acer and it is a fantastic computer but it is getting old. Virginia (my state) used to use the SSN on driver licenses but no longer does. My address is in the phone book and my photo is on Facebook. Those of you suffering from paranoia will get nothing. I plan to get a new Acer laptop!

  • Raye February 6, 2013

There is a reason they want a copy of your drivers license. If you have moved since you sent in the warranty, your postcard was mailed to your old address. The person now living there could receive YOUR settlement award if identification was not required. If you live in one of the 29 states that have the SSN on the drivers license, you should certainly black that out. All other information is most likely already in some public database.

  • Speed February 6, 2013

The settlement talks about the 3 brands of computers AND accessories. Do you think an iPad would count as an accessory? What about an LED TV?

  • Artimus REALITY February 8, 2013

Some of these comments are TOTALLY WHACKED!! First of all who DOESN’T keep a reciept for a major electronic purchase. Second, in this case YOU DON’T EVEN NEED IT!! Fuckking read people!! I have 4 of these and registered every one of them online the first time I used them. E-Machines is now giving me ALL OF MY MONEY BACK!!! $1460…and I still use every one of them!

  • LB February 8, 2013

Artimus REALITY @ 59 – I’m fairly sure that there are quite a few people who don’t keep receipts for crappy computers for over a decade. Also, if the customer never sent in for the warranty, they *certainly do* need either the receipt, the packing list, or the physical computer (to send a picture of it) to the company before they can get any settlements. Why don’t *you* read the claim form?

  • Donna February 9, 2013

I am so tired of big business, and the companies such as this who takes financial advantage of customers. A whole decade ago, when I was suffering from corrupt files and loss of information.Only, when I tried to return it only then, did I find out it was too late (pass manufacture warranty) we were stuck with crappy systems that did not, live up to the advertised hype…..shame, shame, not mine yours….fool my once, shame on you but thinking you can fool me twice? This company knows dam well, that the money we spent on their crappy computers came to much more than the settlement amount. Even if you consider they required you to pay for Tech Assistance it did not come free at that time with their systems. You had to pay, for technical support when, no amount of technical support would have helped cause they had defective parts….RIPOFFS!

  • Sondra February 11, 2013

I also received the cards for this suit. It makes me nervous that it asks for photo id copies… Kind of feel like it is an identity theft thing.

  • Speed February 12, 2013

You can cross out your drivers license number and any other identifying information. They just want to verify addresses before they ssatrt sending out the refunds. As far as the other comments – I bought the emachines so long ago its been at least 2 computers in between. Receits were shredded long ago. And even if I still owned it what could I use it for? The OS was like Windows 98 or ME. MS doesnt even support those anymore.

  • Mary February 16, 2013

That was the worst computer ever. It was finally replaced with an HP after I took it in 4 times. Bigger, faster, better, no extra charge to me. But what a lot of crap I had to go through first. We should get $365 cash!
Has anyone looked at the secondipity.com website? Mostly refurbished and we would be restricted as to what we could get. Nothing I want. Think I’ll go for the cash.

  • Diana Sebera February 16, 2013

I was hesitant, but sent in the info because I received a postcard. I am newly married so I sent in a copy of my new name on copy of marriage license.

  • Diana February 16, 2013

These computers 3 were not that bad, the first one was now that I recall.

  • Diana February 16, 2013

Does anyone know when it will all be over with and where to you get the computers from? I already sent the info in.

  • George February 17, 2013

I think everyone should be happy because you had a piece of junk, now you are getting a new computer. I also think you should praise Jesus because he loves you and made this possible. Amen to you Jesus! I love you Jesus! Thank you again! Your child George

  • Maria February 17, 2013

    Jesus is Lord!

  • Jim February 17, 2013

Is this a great country or what?

  • Carl February 17, 2013

I would not be so thrilled about this settlement agreement if I were you. Received the claim card in the mail and after reading the fine print they are not giving anyone $365 for a new computer. You have to redeem the $365 from a website called “secondipity.com” which only sells USED AND RECONDITIONED computers. Basically you can spend your $365 on a second hand piece of junk.

  • rose burdette February 17, 2013

Machine was virtually worthless….did not own it very long before it took a dive.

  • Larry G February 18, 2013

If something sounds too good to be true – it probably is. Trade my identity for the POSSIBILITY – if the court approves – of getting $62.50 – I think not. I made a mistake buying the machine because I needed one in a hurry. I’ve long since forgotten when I got rid of it. I don’t plan to sell my picture for $62.50 – or a refurbished piece of junk that failed for someone else.

  • Dana February 18, 2013

While my emachines did end up crashing, it lasted me far longer than any other desktop or laptop I’ve ever owned. Those of you complaining about a receipt, no one said you needed one. You were contacted because you registered your computer when you bought it. That is all that was necessary.

  • Bill February 18, 2013

Well someone must do the research well. I bought mine in Va. Since then I have lived in Oregon, Ca., and now Wa. and they got my address right!! Still have the tower and its still running well, no problems.

  • Julio February 18, 2013

If only someone would start knocking off a couple CEO’s maybe we’d see capitol greed end. I’m not giving away my personal information. How did they get my address anyhow? I’ve moved several times since I bought that piece of cr*p computer.

  • David M February 19, 2013

I bought the eMachine 400i3. it was a good “value” pc for me at the time. A Celeron processor and 64 MB of ram (Upgradable to 256 MB.) It came with a 3.2 GB HDD. (I think 30 was state of the art back then but, only just… most “new” systems were boasting 10 GB HDs.) I remember getting a coupon for $50 or something, plus an instant, in-store rebate toward the purchase of a 15 in. eMachines monitor. Got the computer and monitor for around $300.

I do remember that the floppy drive was eating up my disks… Oddly, I could hear a rhythmic scraping like sound before the floppies would go “bad” on me. I would try to back them up usually with pretty good sucess, once I recognized the “failure imminent” sign. I believe I was still having the problem after I replaced the floppy drive though, (with one from an eBay seller.)

Wonder if the guy was warranty replacing eMachine floppy drives and selling the pulls? They did seem to work just fine, with new and clean floppies… till they had been read and written to a couple times anyway.

  • Ray February 21, 2013

I wish they would acknowledge receipt of out claim form somehow, with a website or via email. Wouldn’t want my claim to get “lost”!

  • JellyBean dm February 22, 2013

Few weeks ago I sent the card in with pictures old my old 333id computer serial number/model number I still had it in the closet. NEVER got any letter or receipt from them, just like someone else said. Maybe I should have sent certified. Did not like sending zerox of drivers license, regret it now, should have blacked out driver id number. Who on earth would have a receipt from 1998 ? I did not. Something seems strange about the whole thing.

  • Gary February 22, 2013

#1 Settlement Agreement says that the selection site is required to have new as well as refurbished.

#2 Not getting acknowledgment or reciept is common until court approves.

  • Mike M February 23, 2013

I have owned quite a few eMachines and found them quite reliable and hardy. Well, I kludge an d replace all my own parts: power supplies, fans, etc. but those eventually go out on ANY computer. I am still using 2 out of the 3 that they sent me cards on. A couple of them were even processor-swapped and overclocked pretty fast for the time. Well, one lost the HD last year, so I was using it mostly as a printer driver, and another was just barely booting up, so I keep it turned on as a backup file server., the 3rd I use weekly because it has some irreplaceable software that won’t run on a newer operating system. The next generation of eMachines I bought to upgrade (T3104) JUST missed the recall because they were the first NOT to have floppy drives in them on CDs (the CD’s of which have since all died… maybe they’ll have a recall on them next!)

I would love to get a refurbished one to replace the old ones, but don’t expect anything other than the $62.50, as after looking at the second-hand website (which appears to be owned by them since it only carries their own brands) certainly doesn’t stock enough of each item (try buying one now, and there are only 1 or 2 of each) to fulfill all of the certificates.

If you haven’t sent in your card yet, you should send along a note to this effect that they should amend the settlement agreement to ensure that they keep enough of a supply on the website to fulfill ALL orders placed.

  • Liz February 23, 2013

I thought this had to be a scam since I bought my eMachine so many years ago that I don’t even remember the model, just remember it being garbage (just like the Acer Aspire I have now :) And I also moved from OH to MN and have had at least nine different addresses in the time since I originally registered my e Machine and probably only registered it to get a rebate they would have offered with the purchase!

From the looks of it, it is not a scam; I searched for the District Court of Cleveland in Oklahoma since I figured if this is legit, of course their would be a paper trail and found The Oklahoma State Court Network http://www.oscn.net. Whenever I entered the case number, and error message came up but then I noticed you can also search by the name of one parties involved in the suit if you select the search dockets link and use the Search by Party option.

I found two cases referencing Stroud and eMachines. It might take some time to find the correct one, the first one I found was filed in Appellate County with eMachines vs Stroud, case PR99904. If you open that case, after it lists Petitioner, Respondent and a long list of Attorneys, it list a link to the other case under the topic ‘Lower Court Counts and Other Information), which is the Class Action case. This case has been going on since 2003 (filed 6/4/2003).

Hope this helps. If I have to choose between another crappy computer and $62, I think I will take the $62 and apply it to my purchase of a decent computer.

  • Cindy February 24, 2013

yes I purchased an e-machines it was my first computer and have had lots of problems with it, have called in about it several times but nothing ever got solved, the floppy disk drive didn’t work the biggest part of the time and I have lost pictures I can never get back. If they would replace mine with a new one lord yes I will take it gladly. Mine is down now and can not afford to get it fixed or to find out what is going on with it. So Please send on a replacement PLEASE!!!!!!

  • Robert Askew February 24, 2013

I had one of these and had the motherboard replaced twice because the power supply fried the motherboards.

  • Jim February 25, 2013

After sending in my photo ID and the card I got about 3 weeks ago, I just received another notificaitoncard in the mail. I was going to send it in again, just in case, but don’t want to be accused of trying to get 2 when only entitled to one. I just don’t want to miss out on the deal. (My Windows 98 E-Machine fried a power supply (expensive) and was a piece of crap as well. FYI).

  • PizzaPatt February 27, 2013

to everyone complaining about computer crashes, stop looking at all the free porn… my emachines lasted plently long enough! bang for buck when i couldnt afford much else

  • jw March 2, 2013

This is so funny I just sent out my papers for this.. The e machines was my first computer in 1998 and lasted a long time. My best friends husband is a computer man and said he was shocked to see it last almost 10 yrs without any problems. Nice to see if things go through something could be done.. I still have the old e machines tower in my garage yet. never got rid of it for some reason.. I thought I might have the receipt for it in my safe might have to really check to see if its still there.. I needed to keep it to show I bought it after my divorce so my ex didnt say it belonged to him. he wanted everything after the divorce too.kept saying he bought it.. thank god I kept receipts for a long time. Glad to keep the papers for a long time anyway never know when they can come in handy

  • mam March 3, 2013

emachines are crap. It was my first one and it didn’t last long. The website where you you can spend $365 is all refurbished items. More problems with second hand technology. The card I recieved says to black out your personal information from your ID. It just needs your picture and name. Your proof of purchase is the 11 number code on the postcard that you recieved. It states that on the Claim Form that you have to print and send in. It is on the website http://www.eMachinesFloppyDiskSettlement.com
Nothing is to be settled until March 25, 2013. It could then be appealled and put off for even longer. I don’t plan on sending my claim form in until I check the above website to see if all was settled.

  • Patti March 4, 2013

First, what if i have the restore disk for the emachines? In the center of the disk it has some kind of serial number on it, I assume that would associate it with the computer. I have a photo of the computer in my living room years ago, but kind of distant. Receipt is nowhere to be found as it was several computers ago. I did not receive a postcard in the mail, I have moved, and my email address has changed a couple of times, and I have no access to previous email addresses. What do you think? That phone number is not helpful, it is just recorded information.

  • Patti March 4, 2013

In response to some of these comments on here. This lawsuit is justified. People spend a good amount of money and should expect the product to function properly. Computer companies rarely are of any assistance when called for help with any problems with the machines. There was a lawsuit recently for a hp laptop dv6000, which I had also purchased. This laptop cost me over 550 bucks, and it got so hot that it nearly burned skin off my legs when I had it on my lap. The wifi worked, then quit working, then worked, then quit working. I had to buy an external wifi adapter to use the internet. The screen started to fry out because of the excessive heat. The lawsuit was settled and I received a new laptop. While it is not a comparable model, at least it is a functioning laptop. By the time I received the notice, I had already purchased a new computer anyways, so I now had a free computer that I could give as a gift or sell on ebay. As to the person who thinks it is a scam, look at the official Acer website. It has a notice on there regarding the class action lawsuit. I don’t think they would put it on there if it was a scam. I believe Acer bought out Emachines. Take the refurbished computer that is being offered, or the 63 bucks, because you deserve it. The computer companies sell computers that they know are defective, and then when customers call them with issues, they say that the warranty has expired, or that it was the fault of the customer, they must of done something to the machine to break it. Or they try to make you pay them to even discuss the issue, when they know the part was defective to begin with. Its about time consumers spending their hard earned money get some justice against these large corporations! Also the website states that the Photo Id can be blacked out except for the Name and photo. This makes sense. They want to make sure the person getting the computer is the person who owned the computer to begin with.

  • Ray March 4, 2013

    as Gary mentioned below:

#1 Settlement Agreement says that the selection site is required to have new as well as refurbished.

Then I would suppose when the redemption certs are sent to people, secondipity will have access to new machines to send those who prefer a replacement. It only makes sense, I figure they would have to have multiple thousands available, even if most people choose the $62.50 option!

  • jigaboo james March 4, 2013

thought it said d/l and do not need reciept

  • jp March 5, 2013

After viewing all these posts, I think I will go back into my cave and generate my rabbit ear TV ( by way of fracking) and watch the Big Bang Theory. Lighten up and let the lawyers make their “well deserved money”. Then take your $62.50 and have a nice dinner ( for 1) and watch the lawyer table next to you celebrate. Cheers!

  • Casey Dorion March 5, 2013

I had one emachine and liked it, no problems.
I got 3 claim forms, all in my name but each
    had a different serial number.
    Will send in only one.

  • Donna March 5, 2013

I am looking for the POSTCARD I should have received for my participation in the eMachines Lawsuit.

I bought AND REGISTERED my eMachines computer in 1999, but my Receipt is no where to be found. I do not have this computer any longer.

Because I REGISTERED my eMachines computer, I should have received a POSTCARD in the mail from eMachines. BUT, we moved 4 years ago from CA to FL.

The phone number for the Lawsuit is ALL recorded information so it is of no help.

Where can I get MY POSTCARD?

    Donna

  • Tim March 7, 2013

I received two cards my buddy also purchased around the same time did not receive any. I also found my receipt from 1998. I almost trashed that thing.

  • Donna March 7, 2013

i bought 3 emachines , got post card today , for 1 , so i dont know if they will be sending to my old address , or not , hopefully my registration on line will due ,

  • KK March 8, 2013

Checked out KCC online for their settlement services – checked out. Finally found the court record in the Oklahoma court records (by county docket, but not easy!) – all seems legit. Blacked out most info on the ID.

AFTER MY RETIREMENT I USED 3 BRAND NEW EMACHINES FOR MY DAY TRADING ACTIVITY ON WHICH I HAD DAILY 7 FIGURE DOLLAR AMOUNTS RIDING.
MY ACQAINTENCES TOLD ME I WAS INSANE TO TRUST THIS AMOUNT OF MONEY ON CHEAP EMACHINES.
THEY MADE ME SUBSTANTIAL SUMS OF INCOME WITHOUT ANY COMPUTER PROBLEMS.. I GUESS, I WAS JUST LUCKY THEN THAT THEY DID NOT BREAK DOWN ON ME.

  • Robert March 22, 2013

I got my post card in mail!Hope on March 25th they rule in our favor. You will get a $365 credit at Secondipity.com for replacement or$65.If we win emachine will deposit 50 million in an account..

  • Ray March 24, 2013

I don’t think it’s a matter of “winning” at the 3/25 fairness hearing. BOTH SIDES WANT THIS SETTLEMENT. The hearing is a formality and I’m sure any minor differences will be quickly ironed out so things go smoothly. I just hope we don’t have to wait till July or later to receive these vouchers.

  • steve porter March 30, 2013

I did purchae a emachine modellisted and the floppy drive did go out along withe the hard drive 3 times. It was frustrating.
It would be nice to be able to replace the desktop.
I wonder how the hearing went.I havent hear anything.

  • The Real Stev Porter March 30, 2013

I got my postcard and sent it back with photocopied ID the other day.

My main concern is that when the $365 certs get mailed out, Secondipity will not be able to meet the demand. They look like a small outfit and may quite possibly run short of stock in the face of everyone rushing to cash in on settlements.

  • LtJimmy April 5, 2013

The class action is legit and it appears the settlement was approved by the District Court of Cleveland County.

Per the ORDER GRANTING FINAL APPROVAL TO CLASS ACTION SETTLEMENT AND FINAL JUDGEMENT:

Section 6: “Therefore, I find that the agreed amount of attorneys’ fees in the amount of eight-hundred thousand (800,000) returned goods credit certificates is approved, as part of the final approval of the Settlement Agreement.”

Section 19: “The Settlement Agreement (OPCE 2) is finally approved as fair, reasonable and adequate.”

    Hope this helps!

  • Ted April 5, 2013

When can we expect the voucher?

  • Mihir Shah April 9, 2013

For those who think that the notice is a scam, this is from the official eMachines website:

    http://www.emachinesfloppydisksettlement.com/CaseInfo.aspx?pas=EMS

  • alenka April 10, 2013

So do you need to send proof of purchase? It was very long time ago, can’t find any receipts.
Their card says to fill out the form and send it with a copy of pic ID.

  • Ray April 10, 2013

Grrrr… this is from the eMachinesFloppyDiskSettlement website:

The Proposed Nationwide Settlement can’t become final until all appeals are resolved and the related class action lawsuits in FAQ 1 are dismissed. It’s always uncertain how long appeals will take. They can take many months or longer. Check the website periodically for updates on the status of the Proposed Nationwide Settlement

So I guess it’s hurry up and wait!

  • R2 April 11, 2013

    Scary!

I purchased mine in 1998. Since then I have moved 15 or more times (across 3 states) and they still found me. That is a little concerning.

  • donna dunn April 15, 2013

anyone know when the redemption certificates will be mailed out????

  • belle April 27, 2013

I filled out the claim that was sent to me, my computer did not last long after purchase, problem after problem. But I recently moved right after filing and im not sure if I gave my new address, and cant find my claim number (copy) at this time. How can I check to make sure I gave my new address. I think I did but not sure, as I just purchased a new home and not sure if I had the closing yet when I returned the form :(

  • John Haz April 28, 2013

I returned the card with a copy of ID but stupidly didn’t make a note of the claim number. Anyone know if I can get the claim number? Or if I even need to send a claim form? Thanks.

  • Lt. Tim April 29, 2013

ok the march date has passed….what happened & when do I get the coupons

  • Randy May 10, 2013

I sent claim in the week it was sent to me which was months ago, I guess this is the usual lying bull crap we always hear from a bunch of lawyers while they line their pockets and crap on everybody else.
I am like everyone else are we ever going to get our coupons or was this all just a bunch of bull

  • Ray May 11, 2013

I can only figure they’re at least going to wait till after the July 15 deadline for filing a claim. Then they’ll see how many vouchers they need to create. Then they’ll figure about how many new computers, etc. that Secondipity will have to get in stock or have access to for them to be able to serve people who want equipment instead of the $62.50. And that’s counting on there not being any other legal glitches that are wending their way thru the court system that we’re not informed of! :(

  • raz May 14, 2013

They asked for drivers license did it is little scary to share that type of info with these people. Any thoughts?

  • Anita Norris May 22, 2013

Why isn’t there a database somewhere where we can get that number on the postcards they sent out (in case we didn’t get ours or lost it) if we filed our warranty? We have to have id anyway to file a claim so what would be the problem?

  • M Sakai May 29, 2013

Well, it looks like they finally approved the settlement. There was an update on the main page for the lawsuit.

On March 25, 2013, the Court held a hearing to consider whether to approve the Proposed Nationwide Settlement. Based on the hearing, the Court has approved the eMachines Settlement. We anticipate the distribution of Settlement Awards to start in the fall of 2013 for all people who file a timely and valid claim form. All claims must be filed no later than July 15, 2013. Your legal rights are affected whether you act or don’t act. Read the notice carefully.

So figuring that settlement awards will go out after October and hopefully before December. I got 4 of those claim cards and sent them back with a copy of my drivers license with certain items blacked out.

  • Ray May 30, 2013

Thanks MS…the fall? wow, this is taking forever…I notice in the final approval notice document, it says secondipity will accept the redemptions at a emachinesredeem site. That site will be required to have the same acer, gateway, and emachines (and at the same prices, warranties, shipping, etc.) that secondipity has AND a sufficient supply to meet the demand. I see that ‘emachinesredeem’ url has be registered, but it’s just a parked domain at godaddy. For now.

  • carrie June 3, 2013

I lost my card with my claim number and the website and phone number are NO HELP!! How do I get it re-issued?sddanes@aol.com

  • M Sakai June 7, 2013

    carrie,

I have a feeling that they hope not too many folks redeem the cards. I think it is funny how small those cards were. The only hope you have is writing to them. You can forget about emailing or calling. The determining factor whether to redeem the certificates if I get them for cash or for the crap, Oops, I mean a refurb will be what stock is available on that serendipity site. For one thing, there are different grades of refurbishment. Well, let’s see what happens in October.

  • Michael June 24, 2013

This is crazy. No one keeps receipts from back then and most of the computers have been dumped for a long time. So, the attorneys on the other side agree to the receipt claim to get the company to settle. The company know it won’t have to pay hardly anything and those attorney’s still get their money.

  • Patricia Sirios June 29, 2013

When is this supposed to settle? I filled out 2 cards that they mailed me for the 2 machines I purchased and have never heard another word.

  • ljl June 29, 2013

i registered my emachine.. and they sent me a form and i returned it.. no word of i.d. ….

  • Rick July 12, 2013

Bought 3 emachine models on the list in that time frame. Have moved since but they sent me one card. I am assuming that covers all 3 machines otherwise they would have sent 3 cards…anyone know if that is correct because the 1-800 number is no help.

  • GS July 13, 2013

Okay, this is what I have gathered after research. If you registered your machine, then you were issued a card. (That should be the only information they need regarding the card as I doubt not many of us kept our receipts.
If you returned the card with the ID, this is the only place you are going to get information regarding the suit. As of right now, it is looking like September or October (which usually means November).
The attorneys know that they would be liable for moneys for the claimants (us) as they sent us the notices based on the fact we registered the machines. :) That in itself should be adequate information regarding our purchase of them.
We can only hope that the research I did is accurate. We all know that everything you read on the WWW is accurate and true, right? After all they can’t lie.. LOL

  • Ray July 18, 2013

I sent the card in with a photocopy of my license in January. I also scanned the front and back of the card for my records. I didn’t send it certified mail though. Hopefully it didn’t get “lost”, lol.

  • Syndi July 19, 2013

I just received my certificate and have spent 2 hours on the website trying to redeem it. There is no phone # for help so if you have a P.O. Box your order will not be processed. Hopefully this will be corrected !!!

  • Gary July 19, 2013

I got my certificate and PIN and went to the website provided, ordered a computer and had to provide a credit card to charge in case the charges were more than $365. The computer I chose was $349.99, shipping was free and no tax. The $349.99 showed up on my credit card soon after I ordered. There is no contact to call to follow up on the order. What do I do now???

  • Telise July 19, 2013

I just received my certificate for replacement in the mail today. July 19, 2013. It says it expired July 15, 2014. Called the 1-800 number: disconnected. How CONVENIENT for them. :-

  • Travis July 19, 2013

@Gary, I’d really like to hear more about your credit card being charged a full $349… please email me at hawaiimix@maildrop.cc. I’d appreciate it. Thanks.

  • Barb July 20, 2013

Argghhh! I ordered mine today. Gave a cc for any charges over. Entered my cert. # and pin #. My credit card was also charged for the full amount! Anyone else? Now what? I guess that I’ll just refuse it when it comes. Also, did you notice that the price is going up all the time on the same machines? I first thought I would cancel and try again, but the price on the same machine had already gone up $20! Are there any other contact numbers out there? Thanks for the help!

  • Randy July 20, 2013

I ordered 2 computers with 2 certificates and they charged my CC! No phone number, can’t cancel the orders! ***? Someone needs to get this straightened out now!

  • Travis July 20, 2013

EVERYONE – hold off on giving your CC information to a page that’s not even secure. This may all be a scam. You should see https:// in front of ANY website handling your CC information.

PLEASE, if anyone else is reading this and had their CC charged after redeeming those codes you received – POST SOMETHING ABOUT IT.

  • Cheryl July 20, 2013

I received my letter a few days ago which contained a certification number and pin. I went to the website and ordered a new Gateway Desktop that can be purchased at Amazon for 520.00.
My debit card was not charged and I received an email today confirming shipment with a tracking number.
The products change quickly as they are depleted, If you see something you want don’t hesitate to order it.

  • gary c July 20, 2013

I tried ordering a computer yesterday. The total amount was around $314. When I was about to place my order, it appeared the entire amount would be charged to my cc. I backed out and started again to see if maybe I missed something in the process. When I entered the claim # (it never asks for the certificate #) and PIN # again, it said that the claim # and PIN # were invalid. I also tried entering the certificate # instead of the claim #. It still said claim # and PIN# were invalid. Not sure if this was because I had already entered the claim # and PIN # when I tried to order the first time. It could be that it already has a record of my claim # and PIN#, but not sure and there is no one to call to find out. The only phone number provided is the 800 #, which only provides information about the lawsuit. I noticed when I went into the website today that the same type of computer that I tried to order yesterday was about $70 more expensive, and greater than $365. Also, it appears that most of the computers do not come installed with Windows 8 unless Windows 8 is listed in the computer description that is on the first page. Anyways, looking at the comments about charging cc, I am glad I did not place my order. I don’t understand why the website was not set up so that if the total purchase price (price of computer, shipping, and taxes) was less than $365, then no cc information should be needed to order the computer.

  • Carl McLean July 20, 2013

I just ordered my new computer. It doesn’t appear to be a scam. I got my new Intel I5 desktop for free – even shipping was included. I just checked my CC activity and nothing was charged. They did not ask for the security number on the back either. I think everything is legitimate by the looks of this.
(EDITOR’S NOTE – “Carl” and “Cheryl” were both posted by the same computer so the claims may not be legitimate. Top Class Actions is not a settlement administrator and does not process claims. That being said we are trying to contact the settlement administrator for this lawsuit for more information. We obviously want to make sure that we do everything we can for our viewers. Keep reporting on your experiences! If you are the settlement administrator you can email me at Scott.Hardy@topclassactions.com THANKS! )

  • KMG July 20, 2013

My mom got her certificate the other day and we went online to purchase something. It appears that the items rotate very quickly. If you look at them, some of refurbished. We made the choice to have it sent 2 day and then decided to change it to 1 day and it was an overage. I went back to the 2 day and it had taken out the certicate and pin # so we re-entered it and were able to order it. DO NOT put in your CC info unless you know for sure you are going to pay the overage. Our total for our laptop left $6 and some change. If you want something, order it then or it may be gone. @Telise, you entered 2014 for expiration date.(Next year?) Hope this helps. BTW, I actually had 2 emachines but long since got rid of them and through out paperwork so I couldn’t be included in this settlement. Oh well.

  • gary c July 20, 2013

I have a question. For the people who ordered, was there a place to enter your certificate number? When I first tried to order, I only saw a place to enter my claim # and PIN#. On the letter I received, the claim # is above my name and starts with EMS. The certificate # is all numbers (19 digits) that is shown on the left side of the PIN #. Did I miss something on the emachinesredeem webpage when I first tried to order a laptop? Because it appeared the whole amount was going to be charged to my cc, I cancelled my order at the last minute before giving them permission to place my order. When I went back to reorder, and reentered my claim # (it asks for a claim #) and PIN #, it said they were invalid. So I tried entering the certificate # in the place where is asks for a claim #, and it still said invalid. Was there a place to enter the certificate # that maybe I missed? I am only seeing that they are asking for a claim # and a PIN #. (Which the second time around are being rejected.) Any help would be appreciated.

I have a certificate. Misread the date, but all good now. Afraid to use it though. Do not want to put my CC info. in. Maybe I’ll just opt for the cash payout.

  • Elvis MArcrum July 20, 2013

I got 2 redemption certificates in the mail yesterday. I ordered 2 laptops (neither of them exceeded the $365 face value of the certificate ..including shipping). I got a e mail thanking me for my order (I had to provide a credit card number but the card had less than $70 available credit on it). I got anoither e mail stating they could not process my order because my credit card company had declined the charges? I check with my credit card company and theyu TRIED to charge THE FULL PURCHASE PRICES FOR BOTH LAPTOPS TO MY CREDIT CARD TOTAL WAS OVER $700! Good thing I do not have anything left on THAT card!

i SENT A NASTY LETTER TO The CLAIMS ADMINASTRATOR IN PROVIDENCE RHODE ISLAND BUT DOUBT IF I WILL HEAR ANYTHING FROM THEM UNTIL AFTER THE EXPIRATION DATE OF THE CERTIFICATES!

WHAT A FREAKING RIPP OFF (I KNEW it was going to be!) I think tHE lawyers are absconding with the $80 million!!!

  • Kalie July 21, 2013

Just ordered my laptop this morning, only had to pay the difference, not the total amount, be sure to enter your certificate number where it says Claim code, and enter your pin. Don’t forget to push the “apply” button right next to that, a green check should pop up after pushing apply, when you get to the confirm order section the $365 should be subtracted from your total if not and you submit the order with the full total, you didn’t fill out the certificate number correctly and you’re being charged. Hope this helps

  • Ray July 21, 2013

Well this is just great, they’re sending out redemption certificates now, not in the fall. I hope they’re staggering the mailings because I still haven’t gotten mine. I returned the card w/ a copy of my DL a day or 2 after I got it back in January. I hope I’m not going to have to call their 800 #

  • Brian July 21, 2013

Received 2 certificates in the mail on Friday, went to the website and ordered 2 Acer laptops that were $450 each. I was able to place one order for both and use both certificates on that order. I charged the $170 difference on my credit card – no problems, they charged the correct amount and regular shipping was free. Just waiting on them to come. I didn’t have any of the probs that others have had, seemed pretty simple to me.

  • Dana July 22, 2013

I had the same to happen as others. I entered my certificate number and PIN where indicated but it’s trying to charge my full amount. I don’t see how to cancel it to even attempt to start over but when I tried to do a new one, it says my certificate was used already. No email or phone to contact. I called the 888-623-6174 and it basically repeats word for word what the website says. Can’t we speak to a PERSON?

  • Ray July 22, 2013

Ok, just got the certificate today (Monday) so will see how it goes….

  • AH July 22, 2013

    Got cert. Fri. 7/19
    Placed order that night
    Got tracking 7/21
7/22 Tracking posted and now says will arrive Thrusday 7/25 from New Jersey (not from Rhode Island though, so im guessing all products are dropshipped or from warehouse location)

The shipping weight shows 9 lbs.
I did order 4 products. Hopefully they will send me tracking for other 3 items (although, I read somewhere on the site that it would ship all in once package)

    Will update Thurs.

  • HJK July 22, 2013

I got my certificate letter on Friday 7/19, placed an order for a netbook and a desktop (the netbook was hard to get, kept saying we’re sorry none available and then all of a sudden it was, like an auction). Placed the netbook and desktop in my cart, went to check out, entered certificate number and pin, and it applied the discount but the order showed TWO desktops and not the netbook. Backed out, kept trying until a netbook was available again, put them in my cart, finalized the order but it did NOT give me the option to enter my certificate and pin number again and did NOT apply my credit. I have been frustrated trying to cancel my order, revise my order, contact a LIVE PERSON, mailed a letter on Saturday and went to KCC website and submitted an online notice, but nobody has contacted me so far. My bank put a temporary hold on the charge, they said they can’t cancel it (thanks BOA) it was my debit card charged $434.98.

  • gary c July 23, 2013

Dana, thanks for the information regarding the secondipity email address. I hope they can help. Basically, the same thing happened to me regarding trying to cancel and putting in the certificate # and PIN # again. Except, it kept on coming back invalid. The pickings on the emachinesredeem website seem to be getting slimmer and what are left seem to be overpriced.

  • BGH July 23, 2013

Does anyone know when theirstock will be replenished? I logged on same day i received my voucher and with in 20mins all of the affordable laptops were gone. Do they update their products often?

  • Dana July 23, 2013

Stock does seem to change often. I see only 2 extremely expensive Acers right now but I still have an order, it’s just not paid right. I did get a response from secondipity. They told me if it was under the voucher price that it wont ask for credit card info. Still stuck right now, though.

  • MC July 23, 2013

I felt like it was a scam when I tried to order as well. Even spent the time reading all the fine print when it came to the credit card charges. I entered my order and my certificate number and the 365.00 never came off of the total. When checking out it stated that the whole amount would be put on hold and the balance would be charged at the time of shipping which should have been 32.50. They authorized the full amount. When trying to log on to see if the certificate was applied it doesn’t say anything about it. When trying to follow up there is no assistance, support. I feel like i just got screwed again from emachine!!!!

  • Cathy July 24, 2013

I received one certificate last week. I went to the website to redeem it, found the laptop I was looking for which was under the $365.00. Did not have to put in any credit card info. Entered all the info they requested, received a confirmation email, and received my laptop today. I didn’t incur any of the problems some have mentioned.

  • mary July 24, 2013

Cathy, in the claim #, did you enter claim # or certificate #?

  • Jimmy July 24, 2013

Hi are we supposed to use emachine redeem website are secondipity website because emachine website won’t load when I go to checkout.

  • Frank D July 25, 2013

Ordered a 349.99 pc from the eMachineredeem website, put in certificate number and PIN and my credit card was charged the full price! Have a relative that the same thing happened to! We have both contacted our credit card companies to dispute the charge. I am also considering contacting the attorney general to file a complaint against them. This is absolutely ridiculous.

  • AH July 25, 2013

I’ve received 3/4 items so far and the last item is set to be delivered today.

  • Dana July 25, 2013

    Shipping & handling: $17.99
    Total for this order: $397.98

  • Dana July 25, 2013

Don’t know why it posted twice! Anyway I emailed the secondipity also after that and got an “out of the office til tomorrow reply”.

Grrr I’d really like this to be over and have a another laptop. My 18 year old just left Monday for basic training and will be gone til Feb. I’d like a place to keep my letters to him ready to print when he gets an address to me. Until then, I’m on my desktop or use my older son’s laptop. :(

  • Joe July 26, 2013

A waste of time! Tried to use the redeem certificate. The order showed all was credited andmy credit card was to pay for shipping. They said there was a card problem. So i entered a different card. Thank god im only using small balance cards. The problem is that they probably tried to charge the full amounts. The boucher credit disappeared after i updated the credit card information. Ofcourse no answer from them regarding. Complete waste of time.

  • Clyde July 26, 2013

I have had ALL of the problems others listed here while trying to redeem and then some. I emailed their given contact address… you guessed it… NO REPLY. I resorted to calling their given phone line… “no rep currently avail., leave msg., we’ll return call” NOPE, didn’t happen – NO returned call. I guess Secondipity translated means “I PITY the SECOND” you attempt to do honest business with us. I hear the excuses coming now… people didn’t follow instruction correctly….we were overwhelmed… many attempted abusing the system… we didn’t expect… yada, yada. As usual it’s a rigged game when it comes to the small guy. It’s not rocket science, should (could) be little difference from using your ATM. Enter number and PIN, click done. Success. Order being processed. Thank you, it’s a done deal. ONLY THEN should you be notified if there’s any small balance owing, and a request for CC info for sole purpose of THAT small balance only. They “deal” in IT for a living, yet somehow can’t (didn’t) set up a pertinent site given many month’s/year’s of a head’s-up. AND their main office is in Wash, D.C., hmm.. C’MON! When will legislations ever get done for the consumers from bottom up… not TOP DOWN. Oh well, Nuff said I guess. Vote/purchase next time with you wallet in mind.

Those of you who it didn’t work for and you WERE NOT charged, go try it again with a different email etc. (totally new account). Put your certificate number and pin in where it asks and click “apply”. Then you will see a message (if it wasn’t enough) that you need to add a credit card. After you do this and it goes to the next page, you can see how much it will charge. I was able to redo mine totally today and it took it. I only owed $14.99 for it. They must of reset it or something but it worked. If you were CHARGED, you can dispute it with most banks. Do it as an unauthorized charge.

just like a lot of you my credit card got hit for full price of $389.98. Emailed emachinesredeem about it on Thursday and got a reply back yesterday saying the problem has been corrected and I should see credit in the next 1-2 business days. Actually I got 4 emails from them, 2 two of them were for the credit amounts applied to my orders. It look likes I’m good now.

  • George Keenan July 27, 2013

Got two certificates and went on line to pick out a lap top. Order one for $379 with $8.99 for shipping. After the correct numbers were entered and I was finalizing the transaction, it showed that the shipping then was free with a balance of $14.99 to be charged to my credit card. I received the lap top within a week and am happy with it,……but…..checked with credit card co and they charged my card full price withholding the certificate amount!!!! Credit card said to dispute the charge which I am doing…..we’ll see

Received my Gateway 17.5″ laptop on Friday. I didn’t put in a credit card number anywhere, so this came to me absolutely free. I made sure the price was significantly below the $365 just to make sure. Still hard to believe that a stupid floppy drive 12 or more years ago gave me the opportunity for a completely free laptop.

I recived my tablet Friday. White spot in the middle of the screen. Windows set up already and not recovery disk included.. A lot issue and not able to come back to factory set up. Requested warranty repair/replacement. They don’t issue shipping back ticket for 3 days.
Hang up the phone when I was asking….
I’m considering this to be warranty breach…which is protected by federal law. Will file small court claim if they don’t take of this in next 2 days.

  • Hayley August 1, 2013

    Donna,
    The FAQ from http://classaction.kccllc.net/CaseInfo.aspx?pas=EMS says:
The Returned Goods Credit Certificates are being mailed on a rolling basis as claims are reviewed and processed. Please check the website for any future updates.

I’m going to wait a while longer before contacting them but here is the info they listed:
Call toll-free 1-888-623-6174 or write to eMachines Settlement Administrator, c/o KCC Class Action Services, PO Box 43143, Providence, RI 02940-3143.

Just ordered a NEW in box $349 desktop (w/$12+shipping), entered my certificate and pin # AND clicked the button next to the box I entered the pin # in and it credited it paid in full. Didn’t have to enter any CC# at all. They say they will ship w/in 10 days…Be sure to click the button next to the pin# entry box!
BTW, my identity still hasn’t been stolen, I’m glad I didn’t follow “Don’s” advice, lol….

  • Ray August 6, 2013

…as I said, I ordered late Friday afternoon. Got an email with the tracking number last night, (Monday) it was sent from Edison NJ and arrived 54 miles away to the nearest ups center from me (Horsham, PA) around 1:15 am today (Tuesday)…I signed for it this morning when it was delivered…works great, except windows 8 really is a sucky operating system!

  • mark August 9, 2013

Received my reconditioned laptop. Bluetooth mouse was broken, no big deal. When I disconnect the power cord a few seconds later the laptop turned OFF even though the battery shows 100%. I was sent a broken laptop and mouse to replace my broken emachine. Sweet! They don’t allow for a replacement. The machine you get must go back for repair. Now I must play the warranty game for months and may never get this resolved. I paid an additional $494.99 for my new (broke) reconditioned laptop that must have a power cord to operate. What were they thinking?

slim pickings on the redemption site! only 3 laptops under $365 …. guess we need another class action for them to have an adequate supply on hand to fulfill the claims! LOL

  • Southcarolinamom August 19, 2013

Help! We received our NEW Gateway desk top. We’ve had it less than 1 month. This morning it would not start up … the tower just goes black after a few seconds. Who can we notify to have it fixed? We still have the original box and shipping materials and papers. Surely it is still under full warranty, as it is BRAND NEW. Please advise.

Also, my husband received his certificate over 2 months ago. I have not received mine. Any word on how much longer the wait is?

  • wesnile August 20, 2013

I rec’d my cert# last month and got my new laptop a few days later…I am amazed that after 13 years I got a free brand new computer! I never had any issues with the old floppy…It was my first pc and a piece of junk and I got rid of it a year later. Best Buy would sell these by the truckload and they would tell you anything to get you to buy one!

  • Mike August 20, 2013

got my redemption certificate in mail today….i had mailed in the claim form with a copy of my driver license about a week after i got the claim form a few months ago….i see now that they changed the redemtion site from secondipity to a new site called emachinesredeem.com just for us claimants…wow, the inventory there changes every 10 minutes sometimes….but now what?….i want a laptop, but i guess it’s just a crapshoot….am i going to get a laptop that some kid splilled his orange juice into?..(i doubt one like that would last long, no matter how good they refurbished it)……all i can do is order and hope i get a good one…if your looking in the mail for your certificate, here’s a picture of mine so you know what to look for…it’s on my photobucket page… http://i1151.photobucket.com/albums/o637/stonum/picofcertificate2.jpg

Someone please tell me, when we redeem our certificates, are we responsible to pay a sales tax?…..how about shipping charges?

  • TjWozer August 23, 2013

To folks who have a certificate…. it is good until July 2014 so don’t be in a hurry to get an overpriced computer/tablet with the slim pickings they have now… within the next few months when people lawyer-up when they realize this so called settlement is a scam by offering overpriced stuff on the redeem site VS the great prices on secondipity the crap will hit the fan!

  • Jedi Pimp Master August 24, 2013

TJ Wozer had some good valid points and had some good valid points but I don’t agree with him totally. I do agree that the prices are a lot higher and inflated especially when the stuff is refurbished or discontinued. You have one year to select an item which is plenty of time.TJ Wozer forgets one important thing. As far as the lawyers, courts, and the defendants are concerned this lawsuit is a done deal and over. The lawyers got paid and they don’t care anymore. They’re already breaking out the champagne bottles and smoking their over priced cigars celebrating that it is all over. They don’t care anymore about the little guy getting cheap overpriced refurbished discontinued computer stuff. There is nobody left out there to represent the little guy. I suggest that everybody stop whining and crying and get on the bandwagon and get your free stuff while it lasts. I don’t really like the total outcome of this case because the little guy got screwed in the end by getting refurbished discontinued stuff. 40,000 people got very lucky to get something out of this 13-year-old lawsuit. Most of the time your lucky enough to get even five dollars after millions of people have collected in a major lawsuit settlement case. I would love to see things hit the fan like TJ Wozer claims but let’s face it it’s not going to happen. There is nobody out there to represent us anymore. I was lucky enough to order a brand-new discontinued Acer tablet that was top-of-the-line last year. Honestly, I can live with it and be happy with the free item that I’m getting. A lot of people missed out on a chance to get a free computer because they were too skeptical or stupid to read and do research. People keep on asking why do they need a drivers license because people need to prove that you the correct person getting the item. They do not require proof of purchase like it was originally said on the first card that you received. I even called a law firm representing us and I told them who the hell keeps receipts after 10 or 13 years. The lady representative told me don’t worry about that. Just send in the card with a copy of your driver’s license and ink out your numbers. If people do simple research they would not have missed out on this deal of a lifetime. all I can say is move on people and enjoy your free item. You paid nothing for it, so don’t look a gift horse in the mouth. The 800 number to contact a representative is 1-877-637-3300 and it’s being handled through secondipity but you can only order the item off their second website emachinesredeem.com

  • Jedi Pimp Master August 24, 2013

To my understanding, there were only a few states that they required for you to pay sales tax on. I believe Texas, Indiana, Rhode Island, New York, New Jersey and Washington, DC, you are required to pay sales tax on the items you ordered. if there is any money left over from your certificate. Then you can use it to pay for expedited shipping on the item that you ordered. In my state of Maryland. I didn’t have to pay sales tax, but elected to get second day expedited shipping. I hope this information helps.

  • Hapenstance August 24, 2013

It’s a personal settlement per person. If we are dumb enough to fall for it without doing our homework, shame on use, and we did. These computers are designed to get their money back from suckers trying to fix phoney, come-on computers that steer us to pay them to be fixed…ALL OVER AGAIN. Get it??? When you open the box; see the size, the feel the weight, you know you’ve been had, right off the bat. They are refurbished antiques that collect your personal information. They are laughing all the way to the bank.

This is a message to Hapanstance, It’s not about being dumb. You simply have no choice in the matter regarding the settlement. You can wait and see if the website will update with some new items instead of refurbished ones. Nobody is putting a gun to your head. If you don’t want the free computer then that’s up to you, fine miss out on the deal because I don’t care. I’m just saying to everyone you have one year to choose your item. This person wants to whine and cry over something that he/she can’t change. it’s a take it or leave it situation.

  • TjWozer August 24, 2013

jedipimpmaster … I have purchased 4 laptops from secondipity over the past 3 years, all of them refurbished (I didn’t know they had new ones). Some were through their eBay store and some directly from them. I have no problem buying manufacturer refurbished laptops and secondipity stands behind what they sell. I had one that had a dead USB port and they just emailed me an RMA label and as soon as they were notified that it was on the way back they sent another one out! NOW THAT’S THE WAY TO DO BUSINESS! The problem I have is there are many for sale on secondipity at reasonable prices close to the redemption value of the certificate but that same stock isn’t being offered on the redeemption web site.

Got my cert last week, chose a tablet. after the coupon amount was redeemed I paid a WHOPPING 3 bucks for shipping. delivery was fast less than a week, tablet is great! no complaints here. I’m happy!
Some people will complain about everything! the e machine was not worth the money I spent, but at least now I have a tablet.

  • Jedi Pimp Master August 25, 2013

TJ Wozer it’s very slim pickings but sometimes they will a new item up for sale. I bought an Acer A700 brand tablet, however it’s discontinued item but I don’t mind. 3 hours after I bought it, that particular tablet was taken off their website and I have not seen a 10 inch tablet put back since. They put an 8 inch tablet with less bangs for the buck for the same price that I paid for my tablet. I would have been mad as hell if I had waited later to get that tablet only to find out later it’s no longer being offered.. If you see something on that website then snatch it quick as you can before it’s sold out before you lose out. Hey Sherri, I was curious what model tablet did you buy? I’m glad your happy.

  • Alenka August 25, 2013

Finally got my certificate. But I am going to wait until most people redeem theirs. I want tablet, and I am not in a rush. Wait 3 or 4 months and see.. I hope they have better choice by then.

They are not giving out the certificates all at once because of supply and demand reasons. Some people will have to wait a little longer for their certificates. I talked to one of the customer service reps and they told me that they are filling about a thousand/1000 orders a week to meet the needs of the customers. It looks like they are trying to clear out the warehouses of the old and discontinued stuff. The rep did say that they test the refurbished items before it is shipped out. I paid $339 for my tablet that’s selling on Amazon for $281. See the price difference on how it’s inflated? I didn’t have much of a choice since it’s a take it or leave it situation from their website. My new tablet was supposed to arrive last Friday, but it got shipped out too late so I will get my tablet tomorrow on Monday from UPS. I was pissed since I paid for 2nd day delivery and had to wait an extra 2 days which hit on a weekend in order to get my tablet. I wished they offered Saturday delivery in my case. When I called UPS on Saturday since it arrived at my local UPS outlet. They told me yes we have your package but it’s locked and sealed in the semi truck until we sort it out at 4:00 am on Monday. I wanted to drive there and pick it up, but that even was not an option. Alenka you should wait for the Acer A700 tablet if they put it back on the website. It had good reviews on it and it’s a 10 inch tablet screen. I noticed that their tablets are selling out like hotcakes, it seems like every time I check the website out the tablets are getting sold out and they are having trouble keeping them on the website ha ! ha ! ha !.

I received the notice WAAAY back and just for kicks sent in the info. I had forgotten about it, but my mom of all people, kept up with it. She would get the mail, read the slips and send in whatever was needed. I would sometimes get requests from her to “Sign this.”, I would and that was that. Last Thursday I got my voucher for $365 or so. I Quickly went to the site, and found the only decent thin in that price range, an Acer Iconia W Tablet 32GB Memory 8.1″. I see now they went quick. I am tracking the package, it “Out for Delivery”. I really don’t want it, so hit me up at Deaderpool on Twitter and I will undercut Best Buys price, $300. Bam.

  • Tammy August 26, 2013

After trying unsuccessfully for 6 days straight, I was finally able to order a tablet this morning. You pretty much have to be on the site when they update with the new items because they sell out very quickly. I have added things to my cart immediately only to find they are no longer available before I could even complete checkout. The tablet I got was $299 so I ended up forfeiting the rest of the money for fear that if I took the time to look at anything else I would not get anything again. I later found that I could have added on a 23″ monitor for only another $45. Would have been nice to have, but then if I took the time I may have lost out on the tablet again as it disappeared quickly. Not sure what I will be sent with the tablet. It said the condition was “NEW”, yet as I later read the description further it also stated it was fully refurbished. Also, since I had a $65 balance left over I opted for the one day shipping. Now I assumed that one day meant just that, one day… but, when I was sent the confirmation in an e-mail it said I could expect delivery in 10-16 days. So, maybe the one day just means they process the order the day you placed it???

The redeem site states 16 laptops under $364.99 … yet when you sort by low to high there are many with no prices, and then when you sort by price there are ones showing over $364.99, and then some of the ones I google by model number are over a year old! How does a model that was released OVER A YEAR AGO BE CONSIDERED MANUFACTURED REFURBISHED?… 30, 60, 90, 120 days maybe BUT A YEAR? … I just chuckle!

  • Carol Fitzgerald September 2, 2013

After many of the problems with availability you all have had, I ordered (for my husband’s certificate) a “lightly used” Gateway back in end July. When it arrived in early August, it had a cracked screen (I had never seen anything like this before, but the liquid crystal under the top coat spreads and most of the screen is obliterated). When I turned it on, it got to the multitude of terms pages (most of which could not be read because of screen condition) and pressed “accept” button and there it stayed. So I emailed Secondipity and finally, after weeks they emailed back and said they had no record of this computer and I had to get all sorts of numbers and codes off bottom and send back.
Finally they sent us the return authorization and we sent in the same day.
Yesterday we got back the computer. It was the same broken screen computer that stuck on the acceptance page. I called the warranty service who said they had to wait for the”repair report” I laughed. What repair? It appeared that the slapped the return label back on the box and sent it back as it was.
Those of you who got a working computer are very lucky. To me it is a bad dream.
I am hoping I hear back from the warranty people before the 90 days are up! The clock is ticking!

  • ginamarie5000 September 2, 2013

If you did not register your machine when you purchased it several years ago then you could not be a part of this class action suit. It does not matter if you recently found your machine and the receipt or even if you cannot find the receipt. The deal is done. I did not notice anywhere on the documentation that you could submit any receipts or proof of purchase. The redemption certificate is terrific. I used it to get my very first tablet from the machine redemption website and am so glad I did. I got the Acer Iconia 8.1 16GB and it was BRAND NEW! Most of the other items on that website are returns. I love love love this tablet. The display is perfect and it will definitely become my main computer. I was so hesitant to even start this process with sending in the blacked out license and even redeeming the certificate fir the $339 tablet but am I ever glad I did my research and went through with it. I did have to trick the website into making me not give my credit card number based on other’s feedback and it worked! Totally love my little gift. Thank you machines! I love you!

  • ginamarie5000 September 2, 2013

Oops actually I got the 32GB. Also the auto correct keeps changing the spelling. It’s e_machine and it keeps removing the otter “e” when I type it.

  • ginamarie5000 September 2, 2013

    The letter “e”. e-machine

  • ginamarie5000 September 2, 2013

Most of the items on the emachine redeem website are refurbs. Only the 8.1″ tablets are brand new. Most of those are 32GB but there was one 64GB. The 32GB one was on there for a few days. When you see no price on the item it means people are ordering online and stock is being depleted. When the orders finally go through and are processed then the entire item disappears from the website. I just love this tablet. I received it last Wednesday and can’t stop loving using it. I bought so many accessories for it but dirt cheap on ebay and amazon. I love emachines. Thank you!

  • M.Wolfe September 3, 2013

@Carol Fitzgerald, I too received a dented lid and cracked screen laptop. I haven’t had a response to my emails. Do you know the exact address they had you ship yours back too? There wasn’t any packing material, just the laptop banging around in the box. It was obvious UPS was partly to blame, I could tell the box had been thrown. If it had been packed properly it might have been fine. There wasn’t even a fragile sticker. I paid more than the allotted $365, I want to at least get that money back. I’m just not sure what to do at this point.

I bought this emasheen 400I back in 2000 and used it for three or four years it was very useful for it its time and I think I retired it in the year 2003 I know I said the greatest probably a couple of times and I can’t believe that here after all this time I receive this notice to get this settlement award and now I am the proud owner of this Gateway NE56r45 laptop computer that just saying is excellent ah it it’s so much better than the old Emachine’s ever was by a hundred times and to think that after all this time. Its apps for free, unbelievable thank you emaSheen’s and and everyone else behind this.

  • Ray September 5, 2013

Hoo boy, the new gateway I got less than a month ago, today it’s got a blue screen 0×0000034 ‘the boot configuration file is missing some required information’
They say I have to ship to Texas or buy $20 recovery disk (which probably won’t work, I can’t get it to boot into a bootable linux disk even after changing the boot order in bios)…oh well…

  • M.Wolfe September 7, 2013

Update to my previous post. Secondipity responded with an email form letter. I don’t think they even bothered to read my email. Anyway they told me to send picture’s of the damaged laptop but more importantly the box. They’re going to file a claim with UPS and I have to wait two weeks for the outcome of their investigation. There was no damage to the box and according to the UPS website they won’t pay a claim if the shipper didn’t properly pack the item. Since there was NO packing material, I don’t see how UPS would ever pay this claim. I think it’s wrong of them to try and make someone else pay for their incompetency and I’m just supposed to sit and wait. As I stated previously I paid well over the allotted $365. I’m out the cash as well as the credit voucher. I see no where in the warranty that they’ll try to get reimbursed from UPS before they honor the warranty, if they do at all. I’m contacting my states attorney general on Monday since this stems from a class action law suite. Side note: I did a little research on the place secondipity gets their computer’s and are being shipped from, liquidation.com, real upstanding place.

  • Oscar Brockmeyer September 9, 2013

I sent in my card before the July 15 deadline. What is the latest timetable on when the voucher toward an Acer computer will be issued?

  • Chuck September 9, 2013

I gout my certificate about a month ago. I waited and watched as the computers came and went. Finally, I decided on an Acer 23″ AIO. It arrived last Friday. It had packing material, but was still damaged. It was shattered on the upper right, about the size of a golf ball- maybe a little larger, with a crack running down the screen. There was a glass like dust on the screen, which leads me to believe that it occurred in shipping. The mouse and keyboard were packed at the top of the box in padded paper. the mouse had a gash cut into it that could have easily come from it being slammed into the monitor. I have a claim with UPS and they are going to come inspect the package. I emailed emachines.settlement@secondipity.com, but they have not responded. I just saw the toll free number for secondipity’s customer service. Thanks, Tammy. I will be calling them tomorrow.

  • Dale September 17, 2013

Any update Chuck? I got an Acer 23″ AIO and had the same issue, but in the center top of the screen. I got mine yesterday and sent an e-mail. Customer service was closed. I got a response asking me for generic claims information and that I would receiving UPS labels in about 7 days after processing the claim. Seems they don’t know hot to pack the AIOs. Looked good other than the cracks!

  • Chuck September 17, 2013

I have returned the item and I am waiting on a replacement. Secondipity said it would take 7-10 business days before I receive a new tracking number for the replacement item. The process, while not painless, wasn’t as big of a hassle as I thought. It required photos of the packaging as well as photos of the machine. Customer service, while a challenge to contact, was helpful. If I have anymore issues I will be sure to post them here.

  • alenka September 17, 2013

got my certificate long time ago, but still waiting to see, looking for a tablet. They had new ones 8.1″, but was too small for me, not too much bigger than a smartphone. Usually if item is refurbished, it should work the same as a new one does and last for a long time. And I think if it comes with a cracked screen or broken, they have to replace it. Hope they have better selection 2 or 3 months from now.

  • ginamarie5000 September 18, 2013

Alenka…the 8.1 is absolutely the perfect size believe it or not! Bigger than smartphone and smaller than a bulky laptop or larger tablet. Fits perfect in one hand, easy viewing. I cant believe i would love it as much as i do..i too thought it would be too small at first but boy oh boy was i ever surprised. Totally love it and dont want a bigger size! be careful of refurbs…they are used and u are taking a risk. Avoid it if u can.

  • Penny September 19, 2013

I am the only one that fines this settlement a sham? We get to use our certificate for a refurbished computer? Why not towards any (which is what I thought would be in the works) new one of our choice from a list…

I think I’ve been ripped off by the lawyers again!

  • ginamarie5000 September 19, 2013

Penny–ripped off by who? We are extremely lucky to be a part of this class action suit! Probably for most of us our original emachines worked fine but we still got lucky in the end. I used my certificate to get the BRAND NEW YES BRAND NEW NOT REFURBISHED TABLET. Totally love it and definitely feel blessed!!

  • Penny September 19, 2013

Nope…our e-machine was a constant problem. I have been on the site several times and everything is refurbished. I am happy you are happy. No tablets left and I don’t need a tablet.

In reading some of the other responses you are among the few who got lucky, good for you! I am glad you feel blessed…

  • Robert September 20, 2013

WOW i sent mine in way back in June 2013 and not yet received anything since… I see so many getting there certificates… :(

  • ginamarie5000 September 20, 2013

@Penny…thanks! And I indeed feel blessed…I have other computer brands and had them in the past that were horrible, too, but never got the opportunity to get a freebie out of it whether brand new or refurbished. So indeed luck is on our side with our past emachine purchases! Good luck to you!

  • Tonya Shelton September 24, 2013

Has anyone received the $62 check? With the refurbished computers, bad packing and overcharging people’s credit card, I decided to take the $62. I agree with the other comments, it feels like we’re being screwed again. The only winners here are the lawyers. Can’t even a live person on the phone if you have a complaint.

  • ginamarie5000 September 24, 2013

@Tonya…I spoke with someone live very easily. I called the 800 number just to find out more…very nice guy. The tablets are brand new on the website…far better choice than the $62 although I’m sure you will find good use for the cash. Be grateful…we are lucky to be a part of this reimbursement suit. Were it not for some wealthy litigant bringing complaints forward it may not have happened at all and we would have zero.

  • MontanJim72 September 24, 2013

It’s interesting that the lawsuit listed above is called Collins v. eMachines Inc., yet the letter I received is called Stroud v. eMachines, Inc. This was on my redemption certificate. I will be calling my state consumer protection agency tomorrow. I’m pretty sure this is a scam, but i might try to make them pay the $62.50 in cash to see what happens. Given all the problems I have seen below, it has to be mostly a scam, although some people seem to have gotten lucky. Anytime credit cards get charged, even “accidently”, it’s a scam.

  • ginamarie5000 September 24, 2013

@MontanJim72: No scam here for me! I love the tablet I got. If you are worried about using your credit card then make it a point to not order anything on the website over the allotted certificate dollar amount. Mine cost $329 and so I never had to expose my credit card number. I use my tablet constantly and did not initially think I would at all! It has fast replaced my older regular laptop. I understand your skepticism for I was like you, too, at first but man oh man am I glad I decided to trust it and go ahead with it. Take the ball and run with it is what I say. Lucky us for sure.

  • joemoe sco September 26, 2013

Yes, ginamarie, just as simple as that. Hope you understand now.

  • ginamarie5000 October 5, 2013

@alenka…ok. I just don’t see a major corporation revealing such seemingly confidential information to phone callers but I get your point. Maybe you should call the same number as the person you are referring to from a previous post and ask them your questions. See if they answer you.

Well the NEW Gateway desktop I got in early August, it would appear the hard drive died on friday, the recovery disks I bought for $21 didn’t work, so I shipped it off to Acer Repair in Temple Tx. Cost only $17+ to ship it Fedex ground 1400 miles. They say they’ll fix it and return it free as it’s under warranty. Keeping fingers crossed….

  • Kevin October 13, 2013

Received a remanufactured Gateway SX2370-UR13 from the agreement. It is dead on arrival. Certainly dodn’t want to seem ungrateful but who said this was manufactured? This whole thing about getting used equipment is strange. Will have to work through the warranty process and hop for the best

  • ginamarie5000 October 13, 2013

@Kevin–>huh? I don’t understand your question in your post. Everything is manufactured…even humans. What are you trying to ask? Please clarify and people can answer you. Also, I would never ever purchase a refurb..especially when they are sold in bulk quantity at retail prices. You can buy new for the same price or better. Peace, bro.

    Dear Cheryl Brooks,
Who do you expect to actually contact to from this forum? I am amazed at the size of your balls in that you exposed such private information about yourself on a chat forum on a website. Ha!

Varick–>who are you asking to check for your name? No one here will answer you. I’m starting to think some of these posts are fake…people can’t be that stupid to leave personal info on this website and that someone will actually answer them personally by calling them at home or emailing them, can they? I quit.

To the Editor–>thanks for clarifying that information. I am actually glad you posted the message below so the “not fake” people will realize how risky and “stupid” it is to leave personal info on this website and expect someone to actually contact them. I would think people would use common sense about this and realize this is a discussion forum and not a “resolve your matter personally” cyber desk! Thanks!

I had purchased two eMachines the first in late 1998 or early 1999 and the second in 2000. I only received one certificate, but I am not complaining. I never had a problem with the floppy drive on mine. I barely ever used them. In the end I got a free Acer Aspire V5-122P. How can anyone complain about a free notebook that is practically brand new? Refurbished, but I think mine was just an “I don’t like it so I’m going to send it back” type thing as you would have never known it was ever used. I would have liked to have gotten the second certificate, as I always filled out the warranty cards, but again, I can’t complain about a free computer because of a problem I never had. I can’t believe they found me as I have moved three times since originally purchasing them. I thought they were great computers for the price and I never had one problem with either. I was sad to see them go out of business.

Also, a word of advice for anyone who has yet to choose a computer: Make sure that you choose one that has a low enough cost, with the shipping, that they don’t ask you for credit card info in case the shipping ends up being more. I chose a computer that was $329, plus the shipping, which was well enough under the cost. I even chose an expedited shipping, which there was still plenty left to cover, and it never asked me for any credit card info. I’ve read stories on RipOffReport.com of people being charged what they didn’t expect and such. So get one that with the shipping will be completely covered for sure. DO NOT GIVE CC INFO! If the one you want is more and you have to give the cc info, go with one that’s less. Remember, it’s free anyway, so if it doesn’t have everything you want, who cares?! There was one that was $18 more that I wanted more, and the shipping would have been covered by the certificate as well, but with that one they wanted CC info just in case. UH UH! I went with the lesser, and I am happy with it because I didn’t pay a dime. It’s my test computer now, as in I test programs and such on it to make sure that they do not hurt my system, then if everything is fine, I put it on one of my systems that I paid for. Just some advice. Take it or leave it.

i have an emachine that runs slow so i up graded the motherboard memory and cpu. i was reusing the hard drive but got a blue screen saying i needed a new confirmation number so when i call microsoft they say i have used this product key “87″ times! how is that possible unless emachines them selfs have used the same product keys on the desktops from the factory. this company is a scam. i cannot even get tech support unless i pay again or just buy the crappy 8.1 windows. this is nothing but frustration with a side order of being kicked in the nuts

  • Michelle Goebel January 30, 2014

Beware! We got our replacement computer and one month later, Windows won’t open and says I need to reinstall it. So much for a replacement computer. I don’t have a warranty, so I think I am out of luck. The really bad thing is that we gave it to our daughter for Christmas and now she is out a computer. It’s not a very good deal if you get nothing out of the settlement.

I filed my claim about 3 weeks ago.Response was excellent.I should have sent a claim for financial -embursement.Why you ask? I decided to take a tablet in stead of a laptop.Big mistake! It hasn’t worked since I got it.I’ve sent e-mails,tried to contact warranty without success. So e-machines is getting it back.Disgusted with the whole situation

Just got my 2 tablets by UPS today. One of them was $229, another one $130. Did not have to provide my credit card #. Cheaper tablet is like new, works perfectly so far, I love it. Another windows tablet was dead on arrival, does not come on at all. Will be calling them tomorrow.

  • alenka April 16, 2014

Update. I decided to try my non working tablet again today. Surprisingly, it started. I guess I did not have it plugged in long enough, the battery was close to 0. It works fine, but I still like the other one better (A1 model). The 130 dollar one is much easier to use, and the picture is much clearer as well (that was a major complain on brand new W3), so it’s nothing wrong with it, they are just made this way.
But I am still very satisfied with both of them, I am glad I waited longer to get 2 of them with no extra charge. They will get a lot of use by my 6 year-old twins.
