DePuy hip implant lawsuit

A DePuy metal hip implant lawsuit was filed by a recipient of a DePuy Pinnacle hip implant who alleges he suffered from metallosis and related problems.

Plaintiff Jack Seznick alleges he received the DePuy Pinnacle hip implant in 2007 and soon after it began corroding and fretting because of a problem with the metal. This resulted in groin pain and in other areas, according to his DePuy hip lawsuit. His metal-on-metal hip implant lawsuit also alleges that he and his doctors had no idea that could happen since the medical device maker did not issue any warnings.

The hip implant side effects reportedly required injections as well as physical therapy. Seznick’s DePuy metal hip implant allegedly continued to cause pain and difficulty while he was moving, but in 2013, he received steroids in an attempt to reduce the inflammation.

Even after all of that, Seznick alleges that the problems continued to worsen due to “increasingly dire symptoms,” and he had the DePuy Pinnacle hip implant removed this year. Had the company taken steps to review data and issue warnings prior to recalls, however, that may not have been necessary, according to the hip implant lawsuit.

Metal on metal hip implants were known to have problems because of the strength of the materials used. As filings and small pieces enter into the body, it can lead to metallosis or metal poisoning. DePuy and other medical device makers alleged that they had fixed the problems. However, because they did not have to submit medical trials to the U.S. Food and Drug Administration, it was not known whether that was accurate.

The DePuy Hip Replacement Lawsuit is Jack Seznick, et al. v. DePuy Orthopaedics Inc., et al., Case No. 14-cv-00922, in the U.S. District Court for the Western District of Washington.

In general, metal hip implant lawsuits are filed individually by each plaintiff and are not class actions.
