Skinnygirl Margarita Class Action Lawsuit Denied

A class action lawsuit accusing Beam Global Spirits & Wine Inc. of falsely marketing its Skinnygirl Margarita as “all natural” has been denied class certification by a New York federal judge.
U.S. District Judge J. Paul Oetken ruled that plaintiff Christopher Rapcinsky did not adequately represent the proposed class because he had admitted to buying Skinnygirl to “appease his wife,” not because he believed the marketing message.
“His belief with respect to its naturalness was irrelevant to his purchasing decision, given the statements about the impetus for the purchase,” U.S. District Judge J. Paul Oetken ruled.
Rapcinsky sued Beam and Skinnygirl Cocktails LLC in September 2011 after realizing Skinnygirl Margarita contains an inorganic tequila “byproduct” called mixto and the carcinogen sodium benzoate, despite marketing claims that it is “all natural.”
A similar Skinnygirl Margarita class action lawsuit was filed by California consumer Reneta Bonar.
Judge Oetken denied class certification to Rapcinsky’s class action lawsuit on January 9.
