McCormick & Schmick’s Kobe beef class action settlementA California Superior Court judge has granted final approval to a class action settlement over allegations McCormick & Schmick’s Seafood Restaurants Inc. misled consumers about its Kobe beef menu items.

The Kobe beef class action lawsuit alleged that “Kobe” beef refers to beef that comes from a specific type of cattle from the Kobe region of Japan. The plaintiff argued that the U.S. Department of Agriculture banned the import of beef and cattle from Japan in approximately May 2010. Despite the ban, McCormick & Schmick’s restaurants allegedly advertised menu items as containing Kobe beef. The plaintiff alleges that McCormick & Schmick’s misled customers into believing they were purchasing menu items that contained Kobe beef even though they did not contain Kobe beef.

McCormick & Schmick’s denies the allegations but agreed to settle the Kobe beef class action lawsuit to avoid the expense and uncertainty of trial.

In approving the McCormick & Schmick’s class action settlement, California Superior Court Judge Kenneth R. Freeman overruled two objections. He found that the Kobe beef settlement terms “have no obvious deficiencies and do not improperly grant preferential treatment to any individual Class Member.” He found that the settlement benefits offered to Class Members were adequate to compensate them for the purchase price of the allegedly mislabeled Kobe beef menu items.

Class Members of the Kobe beef class action settlement include anyone who purchased a menu item advertised to contain Kobe beef at a McCormick & Schmick’s restaurant in California between July 10, 2008 and July 15, 2012. Class Members who filed valid and timely Claim Forms are eligible to receive a comp card worth up to $15 from the class action settlement. The comp cards are good for the purchase of any food or beverage items at any McCormick & Schmick’s restaurant located in California.
