iStock-TCPA-Phone-CallA woman has accused an educational services company of repeatedly making robocalls to her cell phone, according to a recently filed TCPA spam call lawsuit.

According to the TCPA class action lawsuit, the woman received at least four phone calls in June. The company alleges that she filled out an online form for a quote request for financial aid information, which would have allowed them to claim express consent, but the plaintiff disagrees.

One of the key requirements for any robocall lawsuit is whether the company used what is termed  in the Telephone Consumer Protection Act as an automatic telephone dialing system. The woman said she believes she noted the dead air between when she answered the call and when a company representative began speaking was indicative of such a system.

The TCPA class action lawsuit cites both negligent violations of the Telephone Consumer Protection Act as well as knowing, or willful, violations of the Telephone Consumer Protection Act. This allows putative Class to seek up to treble damages or up to $1,500 per call from the educational services company MyFootpath.

Class Members would include any person in the United States who this year and the four years prior to the filing of the lawsuit received a call on their mobile phone from MyFootpath without express prior consent.

The TCPA Spam Call Lawsuit is Rebecca Leblanc v. MyFootpath LLC, Case No. 14-cv-02994, in the U.S. District Court for the Northern District of California.

    These pieces of trash did the same thing to me.
    I will be more then glad to assist in this.
    They called me every day for am onmth and when I tracked them down they went as far as to call me a loser and shout other names at me.
