GE Capital Class Action LawsuitA TCPA class action  lawsuit was filed against GE Capital Retail Bank by a Connecticut woman who alleges the company uses robocalls to “bombard unsuspecting consumers,” allegedly in violation of the Telephone Consumer Protection Act (TCPA).

The TCPA class action lawsuit filed by plaintiff Jodie Cowan alleges GE Capital placed a robocall using automated telephone dialing system to Cowan’s cell phone. Cowan claims that she never disclosed her cell phone number to GE Capital nor gave consent to the company to use it to call her.

The robocall lawsuit also alleges that GE bought her number from “third-party sources.” Cowan proposed that Class Members of the TCPA class action lawsuit should include: “All persons within the United States who received any telephone calls from Defendant or their agent(s) and/or employee(s) to said person’s cellular telephone made through the use of any automatic telephone dialing system and/or using an artificial or prerecorded voice within the four years prior to the filing of this complaint where the defendant obtained the cellular telephone number from a source other than the called party.”

Cowan’s TCPA class action lawsuit also seeks an injunction to prohibit GE Capital from violating TCPA in the future, seeking penalties of $500-$1,500 per unwanted call.

Cowan and other consumers are represented by Sergei Lemberg of Lemberg Law.

The GE Capital TCPA Class Action Lawsuit is Cowan v. GE Capital Retail Bank, Case No. 3:14-cv-00696  in the U.S. District Court for the District of Connecticut.

What is The Telephone Consumer Protection Act (TCPA)?

The TCPA was signed into law by Congress in 1991 in order to restrict companies’ use of automated telephone dialing systems for soliciting and telemarketing. The TCPA also works to limit how and when any company may contact individual clients and consumers using an automated dialing systems with a computerized voice message or text messages. Companies and solicitors must also honor the National Do Not Call Registry and those individuals whose phone numbers are registered.

GE Capital is not the only company facing TCPA class action lawsuits. Many banks, business, and even sports teams, are facing class action lawsuit allegations concerning unwanted automated calls to unsuspecting consumers.

    This is really crazy I’ve gotten these calls so much and I dont know how they got my cell and home line number.I agree that these companies are buying our phone numbers from a third party.Something need to be done for real.
