ShellOn July 22, plaintiffs asked a judge to approve a $2 million settlement of the Shell customer service call recording class action lawsuit, which alleges Equilon Enterprises LLC violated California state privacy laws by recording customer calls for Shell Oil Co.’s call center.

The Shell call recording class action lawsuit was originally filed in federal court in September 2011 by California resident Tuan Nguyen who alleges he made five cell phone calls to Shell’s customer service center between March and May 2012, which were recorded without his knowledge or consent. At no point during these customer service calls did the service agent inform Nguyen that the conversation was being recorded or monitored, according to the class action lawsuit.

After months of legal arguments, Equilon agreed to a $1.98 million class action settlement. On Tuesday, Nguyen asked the court to grant final approval for this class action settlement, which would allocate $515 up to $2,308 to each qualifying settlement Class Member.

According to the Shell call recording class action lawsuit:

“The proposed Settlement satisfies all of the criteria for final settlement approval under federal law because it is fair, adequate, and reasonable. The positive response of the Class Members to the Settlement provides strong support that final settlement approval is appropriate. Not a single Class Member objected to or opted out of the Settlement.”

In addition to Nguyen’s personal claims, the class action lawsuit also alleges that between June 2011 and June 2012, close to 3,000 California residents placed calls to Shell’s customer call center that allegedly were recorded without customers’ consent or knowledge, an action violating California’s privacy laws.

The Shell call recording class action lawsuit covers a period of about a year, during which Shell’s Philippines call center received 2,926 individually identifiable calls from California consumers. These California calls were directed to Shell’s Philippines call center through the 888-GO-SHELL phone number.

The court granted preliminary approval for the Shell Customer Service Call Recording class action lawsuit settlement on March 25 and certified two distinct settlement classes to receive the settlement’s award. The first Class includes customers who placed calls to Shell’s call center between May 1, 2008, and Mar. 25, 2011. The second Class is comprised of customers who made calls to the call center between Mar. 26, 2011, and Sept. 12, 2012.

In January, a federal judge removed Shell from the litigation when all parties involved agreed  to voluntarily dismiss the claims against the gas company, leaving the call recorder agent Equilon Enterprises as the primary defendant in the Call Recording Class Action Lawsuit.

The Shell customer service call recording class action lawsuit settlement final approval court hearing will proceed on Aug. 26 of this year in California federal court.

    I received my check, but wasn’t able to cash it because I was in jail. I just got out, but the check voided after Feb 15. Is there any way I can cash it?

    Received my check put it in my account and a day later my bank said it wasn’t a real check…..so now my bank account is messed up.

    If you have gotten a letter or have already signed up, they are mailing checks no later than Nov 5, 2014.

    I am part of this class action lawsuit, when should I expect my money? How can I look it up?

      It’s very hard to speak with a live person but i had to jump through many hoops to get through to someone. I spoke with the VP of some company called KCC who are in charge of the case management details. the sent me a email later that day that my check as well as the others were would be mailed out that evening which was Nov. 5.
      BTW, ths people at KCC had hardly any details so you have to be a little persisitant when and if you need to contact them, otherwise I think the checks should be here by Nov.12 judging by how long it took other mailers to be received fro them before. Hope this helps.

        We’re they able to tell you the amount I was part of both level 1 and 2 but they claiming I didn’t send them the level 2 one

          I got an email back stating my check was $3,100 and some change. I was in the Class 2. So im thinking class 1 should get the max which was $1k but just a guess.
