Wells Fargo BankWells Fargo Bank is the target of a new class action lawsuit investigation into allegations it illegally sends unsolicited text messages to customers without their permission. Unwanted text messages can be annoying and costly, but they can also be against the law. The Telephone Consumer Protection Act (TCPA) and the FCC ban most text messages sent to a mobile phone using an autodialer. These texts are banned unless you previously gave consent to receive the message or the message is sent for emergency purposes.

Wells Fargo offers a free service called “text banking” in which customers are able to quickly request and receive account information via text message. Text banking requires the customer to enroll in the program to receive the messages, so these Wells Fargo texts are permitted under the TCPA.

However, some consumers allege Wells Fargo has sent them unsolicited text messages without their prior express consent. Under the FCC’s rules, your consent for commercial texts – or those that primarily promote a product or service – must be in writing. For commercial emails (which can sometimes appear as texts on your cellphone, depending how they’re addressed), federal rules require that the email contain an easily accessible opt-out feature.

Violating the TCPA can carry stiff penalties of $500 per violation or up to $1,500 if you can prove the company knowingly violated the law. Millions of dollars in TCPA class action lawsuit settlement have been awarded to consumers as text message spam becomes more common.

    I recently received 2 text messages from Wells Fargo from 2 different phone #’s stating my acct has a hold and to get in touch with them I DONT EVEN HAVE A WELLS FARGO BANK ACCT! I would like to join this class action lawsuit.
