Santander Consumer USA Charged with TCPA Violation

Santander Consumer USAThere has been a class action lawsuit filed against Santander Consumer USA for allegedly violating the Telephone Consumer Protection Act (TCPA) as well as the Fair Debt Collection Practices Act. The plaintiffs have also charged the company with breach of contract for allegedly charging improper fees.

Santander Consumer USA, according to their website, is “a leading company in the automotive finance sector.” However, the company has been accused of using “heavy-handed tactics” to get consumers to pay up on these loans, including allegedly violating the TCPA.

There are several federal laws that a debt collector must adhere to regarding their practices. One of these laws is the Telephone Consumer Protection Act, which prohibits companies from calling consumers on their cell phones using an automatic dialing machine (robo-dialer) or a pre-recorded message without their permission.

Plaintiffs in the Santander Consumer class action lawsuit accuse the company of making repeated and even harassing calls to their cell phones in violation of the TCPA.

If you have dealings with Santander Consumer and believe they are violating the Telephone Consumer Protection Act, you should contact a TCPA lawsuit attorney right away. It is also suggested that you do not sign any agreements with the company until you have consulted a qualified attorney in order to protect your interests.

Each call the company places to you in violation of the TCPA can mean a penalty at the minimum rate of $500 for each call. This can add of very quickly to a sizeable sum.

It is important that you keep any and all records that you have of these phone calls, including any recordings on either your cellphone or home phone – especially any harassing messages you may receive. It has also been advised by some familiar with the TCPA to record your conversation with the company and specifically tell they are no longer allowed to call you. However, it is advisable to speak with a qualified attorney before you go any further with any actions.

    They have been sued just this last December 2020 for failing to report accurately on credit reports although it’s done me absolutely no good I keep sending the executive office emails every single day with absolute proof they are continually falsely reporting on my account and I keep disputing so they are in fact in breach of a federal order to consent which they are well aware of so they obviously have not any care in the world about getting sued or paying 4.75 million dollars for the order of consent by not people just the federal court system! So I advise everyone to petition their attorney general of their state and make this matter known if they are falsely reporting your credit on your account for then so get copies of all three major agencies and let’s do this together because there’s actually a consumer law group engaged in wanting to bring this to an end.

    I’m currently stuck in a predatory loan that these people tricked me Into, why because I needed a vehicle In order to provide for my children. It’s been 3 years with this car and it has not gone down at all. I started digging into how much it interest I’ve paid, for I always pay $560 a month $20 is applied to my principal the rest is to interest…HOW? I started looking at all of it and I just ended up having a breakdown I feel like I’m never getting out of this. This is so sad that they are able to do people like this. I’ve busted my butt to be able to pay my car just for it to never actually be mine. I know there is a class action lawsuit against them however Texas isn’t part of it. At this point I’ll let them come pick up their car and I’ll have to sell my soul I guess to get a reliable vehicle to be able to work.

    Santander is also being sued for 750 million. This includes the TCPA and for being a loan predator. This is where they seek out individuals who would most likely default on there loans. They have been working with crooke dealerships all over the United States. The Part of the Judgement is to see out these individuals who Santander targeted. And also those who defaulted on loans who could not afford to pay them. A lot of people debts to ratio was not where it should have been at the time of the loan. And they knew this. One of the judgments are for them to not practice predatory lending practices. And those who have defaulted if you are deemed to be a victim they are to forgive the loan and give you the title. Also for those individuals who are yet victims of these predatory lending practices by Santander, but have not defaulted on there loan. Could qualify also.
