Costco GoldCoast Blue Crab Spread Class Action Lawsuit

Costco Wholesale Corp. and GoldCoast Salads Inc. were hit with a proposed class action lawsuit yesterday alleging they exposed customers to listeria-tainted crab spread before it was recalled.
Plaintiff Lisa Grim alleges in the class action lawsuit that she purchased GoldCoast Blue Crab Spread at a New York Costco in January and subsequently became seriously ill. GoldCoast recalled the crab spread February 1 over concerns of listeria contamination. On February 18, GoldCoast expanded the recall to include three other products over listeria concerns: Maine Lobster Spread, Lobster and Shrimp Spread, and Smoked Salmon Spread.
Listeria is a bacterial food-borne illness that is extremely dangerous, particularly to pregnant women, elderly and adults with weakened immune systems. Among other things, listeria can cause meningitis, brain damage and in extreme cases death, according to the class action lawsuit.
Grim accuses Costco and GoldCoast of breaching the warranty of merchantability by selling a product unfit for its intended purpose because it was contaminated with the dangerous bacteria.
Grim also maintains the companies were reckless and negligent by failing to properly prepare and distribute the spread, failing to keep it properly refrigerated, and failing to warn consumers of the danger of contamination.
The proposed class action lawsuit is seeking refunds for all consumers who purchased the contaminated GoldCoast Blue Crab Spread, as well as damages for Class Members who became sick from the spread in order to cover medical care, pain and suffering, mental anguish and loss of business or employment.

I don’t think it’s fair to have Costco involved in this suit. Costco is extremley cautious about all the products they carry. The contamination came from Goldcoast Plant where the products are produced, packaged and shipped. Costco is very much aware of experation dates and handles everything accordingly.
