Claims Deadline Extended for Citizens Bank Overdraft Fee Settlement

UPDATE 10/7/13: Payments for the Citizens Bank Overdraft Class Action Settlement went out on September 19, 2013.

 

UPDATE 6/19/13: Distribution of Settlement Awards in the Citizens Bank Overdraft Class Action Settlement will be made in September 2013.

 

The claims filing deadline for the Citizens Bank overdraft fee settlement has been extended to May 6, 2013. If you paid overdraft fees to RBS Citizens, Charter One or Citizens Bank between 2002 and 2010, you may be eligible to receive a cash payment from the class action settlement.

The Citizens overdraft fee settlement will resolve allegations the bank manipulated the order that debit card transactions were posted in order to rack up overdraft fee charges. Plaintiffs claimed that RBS Citizens Bank, including its Citizens Bank and Charter One brands, improperly failed to decline transactions when an account had insufficient funds to cover a purchase, and instead processed transactions from highest to lowest dollar amount to maximize the number of overdraft fees assessed to customers.

Citizens Bank denies the allegations, but has agreed to a $137.5 million settlement to resolve its portion of the consolidated class action lawsuit In re: Checking Account Overdraft Litigation.

Class Members of the Citizens Bank overdraft settlement include anyone who:

  • Had a Citizens consumer deposit account that could be accessed with a Citizens debit card anytime between January 1, 2002, and August 13, 2010, and/or had a Charter One consumer deposit account that could be accessed with a Charter One debit card any time between July 25, 2005 and August 13, 2010; and/or
  • Had a consumer deposit account with an Acquired Bank ( see below) that could be accessed with a debit card between January 1, 2002 and August 27, 2007; and
  • Were charged one or more overdraft fees as a result of posting debit card transactions from highest to lowest dollar amount.

 

To be included in the Settlement Class, you must have had two or more overdraft fees caused by debits posted to your account on a single day during the time period listed above.


Class Members that held a Citizens or Charter One account during the class period will automatically receive a payment from the class action lawsuit settlement. Class Members that held an account from an Acquired Bank will need to file a Claim Form by the deadline of May 6, 2013.

Acquired Banks include:

 

  • Mellon Bank’s former Mid-Atlantic Franchise Branches (PA, DE, NJ)
  • Medford Savings Bank (MA)
  • Commonwealth Bank (PA)
  • CambridgePort Bank (MA)
  • Community National Bank (MA)
  • Roxborough-Manayunk Bank (PA, DE)
  • Charter One Bank, N.A.
  • GreatBank (IL), GreatBank Chicago, and First National Bank (IL)


The amount of money you can receive from the class action settlement will depend on how many improper overdraft fees you incurred.

    You morons took $ 4700.00 from my account and sent me a check for $ 445.00 where is the rest of my
    money. You don’t need it I do. Take it out of your bonus from the end of the year, or better still send me a check just for the hell of it. When I asked the head teller what was going on she couldn’t tell me.
    Did she get a bonus for that. I got a call from some one in the big bank where the CEO lives and he told me they can.t do anything because they are not in charge of it. Well who was in charge of taking out the money ( or shall I say ) stealing the money to begin with. How about I file a lawsuit for the full amount, plus 12%intrest for the time you had it , for the attorney fees and any court costs. I started working on this when I first got the postcard, and when we were given the “little” checks we found out the date for filing a complant was January 2013. we got the checks in September of 2013. I want an answer to this within a week from todays date. do something right for a change

    I dont suppose anyone would know uf this can be applied to RBS UK, I have had loads of charges over the years for similar transactions that they should not have paid, in one account the charges put me out of business?

    I had no idea that this was even happening until I received a $12 check in the mail. I have paid at least hundreds of dollars in fees from charter one that I had argued with them over and have it all documented. So who determined that I get $12? And why did I know nothing about any of this to make any claim until it was too late?

    I have not received my check, much as charter one has overdraft me with unnessary charges, Sept 30th 2013 is over, Just want you to know when will I be getting my check.

    I have a question…Did Citizen Bank charge overdraft fees even if you still had enough money in the bank? Do you still get these fees even if you’ve balanced your check with a personal ledger?

    They are still implementing the policy that they were being sued for. This is so frustrating, they are thieves. I would like to take this farther and have them investigated. Where can we get answers as to why they are still able to do this?
