Netflix class action lawsuitA federal judge on Monday granted final approval to a $9 million class action lawsuit settlement between Netflix Inc. and customers who said the company violated the Video Privacy Protection Act by storing their rental history after they canceled their accounts.

U.S. District Judge Edward J. Davila approved the settlement as “fair, reasonable, adequate, and in the best interests of the settlement class,” despite several objections from Class Members. Objectors included customers who said they were fine with Netflix storing their information and others who said the terms of the deal did not fairly benefit Class Members.

Under the terms of the Netflix class action settlement, $6.65 million will go to various non-profit privacy organizations and $2.25 million to attorneys’ fees. The six class representatives will receive $180,000. Class Members will not receive any monetary benefit.

Netflix has also agreed to delete former users’ video history and queue data within one year after they leave the service as part of the deal.

The settlement resolves a 2011 privacy class action lawsuit accusing the company of violating the VPPA by retaining customers’ rental histories for up to two years after they cancelled their subscriptions. The VPPA requires video rental agencies to destroy certain data within one year “from the date that the information is no longer necessary for the purpose for which it was collected.”

Netflix said it retained former customers’ viewing histories so it can restore their old video queues and make better recommendations if they reactivate their subscriptions.

It did not admit any wrongdoing in agreeing to the class action lawsuit settlement.

The case is In re: Netflix Privacy Litigation, Case No. 11-cv-00379, U.S. District Court for the Northern District of California.

    Hi, My father was diagnosed with asbestosis several years ago and has since been diagnosed approx. 1 and half years ago with Mantle Cell Lymphoma. Can you tell me if there has been any lawsuit settlements regarding either of these? Thanks, Cynthia Douglas
