UPDATE 5.13.13: A federal judge has approved the Steve Madden Text Class Action Settlement.

The deadline to file a claim for the Steve Madden text settlement has been extended to June 11, 2013. Consumers who received an unsolicited text message promoting Steve Madden’s products and events may be eligible to receive a $150 cash payment from the class action lawsuit settlement.

If approved at the April 29 Final Fairness Hearing, the settlement will resolve a class action lawsuit titled Ellison v. Steven Madden, Ltd. alleging the company sent unsolicited text messages to consumers advertising the company’s fashion products and promotional events. Plaintiffs allege these text ads violated the Telephone Consumer Protection Act because consumers did not consent to receive them.

Steven Madden denies any wrongdoing but has agreed to a $10 million class action lawsuit settlement to resolve the litigation.

Class Members of the Steve Madden text class action settlement include all U.S. persons who, from July 2010 until September 25, 2012, received a text message promoting Steve Madden products and/or events from the “short codes” 91919 or 623336.

Class Members can receive up to $150 if they submit a valid Claim Form by June 11, 2013. Settlement checks will be mailed within 60-90 days after the Settlement has been finally approved and/or after any appeals have been resolved.
