Lipitor Diabetes lawsuitsThe Lipitor MDL — the group litigation over the cholesterol drug allegedly increasing the risk of developing diabetes — is moving forward following a big step in the legal process. A key meeting for the Lipitor MDL was held last week to determine the next steps of the legal process.

MDL, short for multidistrict litigation, is a legal process that combines very similar individual lawsuits into a single coordinated legal action. This process is designed to help streamline the legal process by combining tens, hundreds, or even thousands, of individual lawsuits into a single MDL.

Last week’s meeting was focused on preparing bellwether Lipitor lawsuits. Within an MDL, a small number of cases are selected to head to trial before the bulk of the MDL. These cases, called bellwether cases, will determine many key elements that will apply to the MDL as a whole. Lipitor bellwether cases may determine things like what evidence is admissible, if there is sufficient evidence that Lipitor can cause diabetes, and what types of plaintiffs would qualify for compensation. The Lipitor bellwether cases are a key step in the large Lipitor MDL.

Lipitor belongs to a family of drugs called statins. Statins are designed to help patients reach and maintain healthy blood cholesterol levels. However, various studies, as well as a number of lawsuits, assert that Lipitor can increase a person’s risk of developing type-2 diabetes. This has led to numerous individual Lipitor lawsuits alleging that the drug caused patients to develop type-2 diabetes, a lifelong medical condition that requires daily attention. The litigation mostly focuses on female patients who used Lipitor and then developed type-2 diabetes, as most research indicates that female users had the greatest risk of this possible side effect. Additionally, the various Lipitor lawsuits within the Lipitor MDL have alleged that research studies as early as 2004 indicated that there was an increased risk of developing type-2 diabetes, particularly in older women taking the drug.

The Lipitor Diabetes MDL is In Re: Lipitor (Atorvastatin Calcium) Marketing, Sales Practices and Products Liability Litigation (No. II), MDL No. 2502, in the U.S. District Court for the District of South Carolina.

In general, Lipitor lawsuits are filed individually by each plaintiff and are not class actions.
