Audi CVT Class Action Settlement Preliminarily Approved

UPDATE 2: A federal judge granted final approval to the Audi CVT Class Action Lawsuit Settlement on September 23, 2013.

Preliminary approval has been granted to a class action lawsuit settlement involving consumers who purchased 2002-2006 model year A4 or A6 Audi vehicles and experienced transmission problems. Final approval may be given in September, when another hearing is scheduled.

The class action settlement concerns the continuously variable automatic (CVT) transmissions of the A4 or A6 Audi models purchased or leased from Audi in the United States, or about 64,000 vehicles.

The class action lawsuit, filed in January 2011, is being heard in the United States District Court for the Central District of California by Judge A. Howard Matz. He granted preliminary approval on March 11, 2013.  

Under the Audi CVT settlement, customers will be reimbursed for certain transmission repairs and costs incurred within the first 10 years or the first 100,000 miles from the original sale or lease of the vehicle. The specific parts that Audi will cover will depend on the model year.

The parts included in the class action settlement are the transmission control module for the 2003-2006 A4 and A6 models, the valve body for the 2003-2004 A4 and A6 models, and transmission replacements without the valve body or the transmission control module for the 2002-2004 A4 or A6 models.

Plaintiffs in the class action lawsuit charged that Audi CVT transmissions had manufacturing and design flaws, which left customers with the high cost of repairing their vehicles, and that Audi was aware of the problems and hid them from their customers.

Audi argues that they “acted properly and in compliance with applicable laws and rules.”  But they also believe that it is in the “best interests of their customers” that they settle this case.

The class action settlement also includes a “trade-in reimbursement cost” for 2002-2004 A4 or A6 vehicles that were in need of a complete replacement of a CVT transmission, but did not receive the repair before sale.
