NexiumDetails on how to file a claim for the Nexium class action lawsuit settlement have arrived! If you purchased the heartburn medication Nexium in or from Massachusetts since March 2001, you may be able to claim a cash payment from the $20 million class action settlement.

The Nexium settlement resolves a long-running class action lawsuit (Commonwealth Care Alliance, et al. v. AstraZeneca Pharmaceuticals L.P., et al.) that accuses AstraZeneca of deceptively marketing Nexium as superior to its other heartburn drug, Prilosec, and its generic version, omeprazole, in order to get consumers to purchase the more expensive Nexium.

AstraZeneca denies the allegations but has agreed to establish a $20 million class action lawsuit settlement to resolve the litigation.

Class Members of the Nexium class action settlement include any person or entity who, from March 1, 2001 through February 6, 2013:

  • Purchased Nexium in or from Massachusetts, or
  • Reimbursed or paid for Nexium dispensed in Massachusetts, or
  • Reimbursed or paid for Nexium purchased by mail order from Massachusetts

If the settlement is granted final approval, Consumer Class Members will receive 43.38% of the net fund, and Third-Party Payors will receive 56.62% of the net fund.

If you are a consumer, you have two payment options: a flat-rate payment of $25 or a full refund of the amount you paid for Nexium. Uninsured consumers who paid for Nexium with cash can receive $97 per prescription or 54% of the total amount they paid. Insured consumers who paid for Nexium with a co-pay or coinsurance can receive $17.50 per prescription or 61% of the amount paid.

Third-Party Payors will receive an estimated 44.5% reimbursement of the amount they paid.

The only way to receive a cash award from the Nexium class action settlement is to submit a valid Claim Form postmarked, faxed, emailed or submitted online by August 30, 2013.

UPDATE: The Settlement Administrator, Garden City Group, has posted an update that distribution of settlement checks began in late 2013 and is ongoing. Class Members who submitted a valid claim will likely see their checks soon.

    Does this class action include mass tort lawsuites against AstraZeneca for nexium fractures in Houston, Tx? Are what is the latest news on that frount? Waiting to hear, if settlement is reached, dismissed or trial. Thank you

        Thank you for the info. I found out the judge wants to meat with both attorneys about whether to dismiss the whole case. That’s good news, because the judge didn’t,t automataly dismiss . It’s not over yet, I,ll keep my fingers crossed.LOL.

    I signed up for the suit in Massachusetts last year, I was taking nexium in 2003-2004, and I moved out of state in Dec 2013, Wisconsin to be exact…. and did not leave a forwarding addresss, how will I get my check….?

    I have been taking Nexium for 15 years, I was not aware of the lawsuit. Now, the deadline has passed to join the lawsuit, is there anything we can do?
