Walgreen’s FlexAid Joint Supplement Class Action Lawsuit
By Mike Holter
A proposed class action lawsuit filed in California Friday accuses Walgreen’s of selling an “ineffective” muscle and joint pain supplement called FlexAid Advanced Triple Action Joint Formula that doesn’t work as advertised.
Plaintiff Dragan Vasic takes aim in the class action lawsuit at several alleged false advertising statements, including that FlexAid improves joint comfort within five days, promotes flexibility and mobility, and supports joint cartilage and connective tissue.
Vasic says there is no competent scientific evidence that taking glucosamine sulfate – the main ingredient in the FlexAid products – provides the advertised joint health and cartilage benefits, including relieving the major symptoms of arthritis.
“All available scientific evidence demonstrates that the FlexAid products have no efficacy at all, are ineffective in the improvement of joint health, and provide no benefits related to the reduction of pain in human joints or protecting cartilage from breakdown,” the FlexAid class action lawsuit states.
“In fact, defendants do not have any competent, reliable scientific evidence that substantiates their representations about the health benefits of consuming FlexAid,” the class action lawsuit continues. “Had plaintiff known the truth about defendants’ misrepresentations and omissions, he would not have purchased the FlexAid product.”
The proposed class action lawsuit is seeking to represent all persons who purchased the FlexAid products in the United States. It is seeking restitution, disgorgement of profits, injunctive relief and more.
The Walgreen’s FlexAid Joint Supplement Class Action Lawsuit case is Vasic v. Prevention LLC et al., Case No. 13-cv-00941. U.S. District Court for the Southern District of California.
The plaintiffs are represented by Todd D. Carpenter of Carpenter Law Group and James R. Patterson of Patterson Law Group.
