New BARBRI Class Action Settlement Reached

BARBRI has reached a $9.5 million class action lawsuit settlement over allegations it attempted to monopolize the market for bar examination courses. If you paid for a BARBRI full-service bar review course from 2006 through 2011, you may be eligible to receive a cash payment from the class action settlement.
The BARBRI settlement will resolve a class action lawsuit (Stetson, et al. v. West Publishing Corporation, et al.) that alleges BARBRI violated federal antitrust laws by agreeing with Kaplan to limit competition in the market for full-service bar review courses. Plaintiffs alleged that BARBRI agreed not to compete in the LSAT business and that Kaplan agreed not to compete in the bar review business, thereby allocating to BARBRI the market for full-service bar review courses in the United States and preventing a competitive bar review course from being marketed and sold.
Plaintiffs also alleged that BARBRI unlawfully acquired and maintained a monopoly in the market for full-service bar review courses in the United States and also conspired to monopolize that market, all through a variety of means. As a result, Plaintiffs alleged, competition in the relevant market was adversely affected.
The defendants deny the allegations and any wrong doing, but have agreed to a $9.5 million class action lawsuit settlement to resolve the litigation. This is the second proposed settlement reached in this case. The first settlement, which was reached in 2011, was not finally approved by the court and therefore no settlement benefits were distributed to the Class. A federal appeals court ordered the parties to continue negotiating an amended settlement agreement, which now supersedes the prior proposed settlement.
Class Members of the BARBRI class action settlement include all persons or entities who paid for BARBRI full-service bar-review course from August 1, 2006, through and including March 21, 2011.
The amount of money you can receive if the new BARBRI settlement is approved will depend on how much money you paid for the exam(s) and the number of valid claims submitted. The ONLY way to receive a cash award from the class action settlement is to submit a valid and timely Claim Form postmarked or submitted online no later than July 8, 2013.
A Fairness Hearing is scheduled for August 19, 2013.

HAS ANY ONE RECIEVED ANY REPLIES ABOUT THIS SETTLEMENT?
Almost 2017, still haven’t heard anything definitive. I email them at info@barbrisettlement.com every 3-6 months and they usually request the claim number I was given years ago and my address. I am waiting for their latest response. But, generally, they will state that it’s still in process. I believe how to divy up the award (att fees and the like). I’ll keep you informed.
I believe that I qualify for this class action. The barbri course was useless. The books alone are all one needs to pass the S.C. Bar. I took the course on or about 2006 and found it totally worthless, much less a waste of study time.
