Chula Vista Cell Phone Tax Class Action Settlement

UPDATE: The claims filing deadline in the Chula Vista cell phone tax class action settlement has been extended to September 29, 2013.

 

The City of Chula Vista, California, has reached an $8 million class action lawsuit settlement over allegations it unlawfully collected a local tax on residents’ cell phone bills. Residents who paid for cell phone service at any time between April 2010 and April 2013 can receive a cash payment of between $35 and $150, or a full refund of the taxes they paid from the class action settlement.

The Chula Vista cell phone tax settlement will resolve a class action lawsuit (Villa, et al. v. City of Chula Vista) that alleges the City unlawfully taxed residents’ wireless telephone service.


The City denies any wrongdoing but has agreed to provide up to $8 million in refunds to Chula Vista residents who paid the tax, called the Telephone Users Tax (“TUT”). The City will also lower residents’ telephone tax rate from 5% to 4.75%.

Class Members of the Chula Vista phone tax settlement include all residents with a Chula Vista billing address who paid for a cell phone bill at any time between April 2010 and April 12, 2013.

Depending on what kind of documentation you can provide proving the amount of tax you paid, you can elect to receive a $35 flat payment or $50 for each full year you paid the TUT since April 2010, up to a maximum of three years ($150). You can also elect to receive a full refund of the TUT you paid.

The only way to get a cash payment is to submit a valid Claim Form and supporting documents postmarked or filed online by September 29, 2013.

A Final Fairness Hearing is scheduled for September 20, 2013.
