Steve Madden Settlement Puts Illegal Text Messages in the Spotlight

If you’re a woman, you probably have a pair of two of “Maddens” stashed in your closet (or at least your daughter does). Steve Madden shoes sell, but the company may have broken the law in its efforts to earn a little extra revenue. During a two-year text message SMS campaign that started in 2010, Steven Madden Ltd. sent text messages to over 200,000 people to promote the Mobile Club. However, quite a few of these recipients weren’t too happy about the annoyance — and possible additional charges for receiving the texts — and took action.
Consumers launched a class action lawsuit against the company for violating the Telephone Consumer Protection Act (TCPA), which shields consumers from receiving cell phone contact they didn’t sign up for. This includes phone calls and texts. The Madden TCPA class action lawsuit encompassed everyone who received a text message from Steve Madden between July 2010 and September 2012 that is covered by the case. A federal judge approved the Steve Madden text spam settlement on May 7.
Maddening Details
Madden will pay $10 million to settle the TCPA class action lawsuit. Each person who submits a valid claim by the June 11, 2013 deadline will receive up to $150 — enough to buy a pair or two of shoes if they wish. [See how to file a claim.]
Under the class action settlement, Steven Madden also agreed to only text people who have signed a written consent agreeing to be contacted. To make sure the company plays by the rules, it is also required to keep those consent forms for at least four years. However, the chances of Steven Madden breaking TCPA laws again are slim to none. Usually when a company gets caught violating TCPA law, they learn their lesson the first time around.
