Vistaprint Class Action Lawsuits Continue

Many online companies offer free products or shipping in order to entice customers to buy, and Vistaprint.com is no different. Vistaprint is known for its long-standing promotion of offering 250 free business cards to new customers, helping to make it one of the most popular companies for online printing services.
Despite its popularity, Vistaprint has faced multiple class action lawsuits over the years for some allegedly deceptive business practices. A lack of clarity in its promotions and terms and conditions was the driving force behind at least two of these Vistaprint class action lawsuits.
The first Vistaprint class action lawsuit accused the company of charging excessive shipping-and-handling fees in violation of California law. Vistaprint denied the allegations but agreed to a class action settlement in 2005.
A second class action lawsuit was filed three years later over Vistaprint’s membership reward program, which plaintiffs alleged Vistaprint was deceptively enrolling customers in without their knowledge and then charging ongoing monthly fees. A Texas federal judge ruled in favor of Vistaprint in 2009 and dismissed the charges, which included alleged violations of the Electronic Funds Transfer Act, unjust enrichment, and other common law claims.
In California, there are expanded consumer protections against deceptive business practices, which may be why plaintiffs in the first Vistaprint class action lawsuit secured a favorable outcome. Now consumer advocates are investigating new claims that Vistaprint.com may have violated California consumers’ rights again.
The full extent of potential violations is unclear at this time, but reports indicate that it could affect an overwhelming majority of purchasers of Vistaprint.com products in California. Factors that will determine the scope include what was purchased and when.
