FedEx Overcharging Class Action Settlement Wins Preliminary Approval

UPDATE 2: A federal judge granted final approval to the FedEx Overbilling Class Action Settlement on Nov. 22, 2013.

 

A federal judge on Thursday preliminarily approved a $21.5 million class action lawsuit settlement with FedEx over allegations the shipping giant overcharged for deliveries to business and government offices.

Under the terms of class action settlement, FedEx will compensate Class Members and provide “prospective relief regarding residential delivery fee practices,” U.S. District Judge John T. Fowlkes Jr. said August 1, 2013.


The FedEx billing settlement resolves a 2011 class action lawsuit accusing the company of overcharging commercial and government customers at a higher residential rate. The higher rate was as much as $3 each for tens of thousands of packages delivered between 2008 and 2011, allowing FedEx to rake in about $5 million in bogus fees, according to plaintiffs.

FedEx denies the allegations, despite internal e-mails supporting a whistleblower’s claim that executives knew for years about the overcharges but allowed them to continue.

Class Members of the FedEx shipping settlement include hundreds of thousands of FedEx customers who used FedEx services from August 28, 2008 to July 13, 2011, and didn’t get a full refund for claimed overcharges on residential deliveries.

Class Members will be paid out within 75 days of final approval, according to an attorney for the plaintiffs.

A Final Approval Hearing is set for November 22, 2013.
