FEMA Formaldehyde Trailer Class Action Settlement Checks On Their Way

On Tuesday, October 1, U.S. District Judge Kurt D. Engelhardt approved the Special Master’s Recommendations Concerning the Distribution of Settlement Funds in the FEMA Formaldehyde Trailer Class Action Settlement. The settlement checks will be distributed within 30 days. Due to the processing time, it will likely be several weeks before Class Members receive their settlement checks.
In the aftermath of hurricanes Katrina and Rita, which devastated parts of the Gulf Coast region, many residents were displaced. The Federal Emergency Management Agency (FEMA) issued trailers to provide temporary shelter to many of the displaced residents. The agency procured these temporary shelters from dozens of manufacturers and hired contractors to assist in the project.
Many residents who were housed in these FEMA trailers began to complain of health problems they associated with formaldehyde fumes that were emitted by the FEMA trailers and housing units. They sued FEMA, the building manufacturers and contractors who contributed to the project. These lawsuits were consolidated into multidistrict litigation (MDL), In Re: FEMA Trailer Formaldehyde Product Liability Litigation, MDL No. 2:07-MD1873, in the U.S. District Court for the Eastern District of Louisiana. The majority of claims against the contractors and trailer manufacturers have already been settled or dismissed.
Victims of hurricanes Katrina and Rita who were housed in hazardous government-issued FEMA trailers will receive $42.6 million under the terms of the FEMA Trailer Class Action Settlement which was initially approved by Judge Engelhardt in September 2012. An estimated 75,000 to 90,000 residents of Louisiana, Mississippi, Texas and Alabama may be eligible to receive the funds.
Allocation letters were mailed to Class Members on June 14, 2013. Allocations of the settlement funds were determined by a formula based on the “claimant manufacturer share” for each unit in which the claimant resided. Average awards are expected to be less than $1,000. Extra awards may be granted to claimants who suffered exceptional health problems after they began living in the FEMA trailers, including acute myeloid leukemia/acute myelogenous leukemia or nasopharyngeal carcinoma.
In order to receive your FEMA Formaldehyde Class Action Settlement checks, the Court-Appointed Disbursing Agent must have your name, date of birth and current mailing address on file.
