CertainTeed Agrees to $103.9M Defective Siding Class Action Settlement

A federal judge on Thursday preliminarily approved a $103.9 million class action lawsuit settlement between CertainTeed Corp. and a class of consumers who alleged the company sold defective siding to thousands of customers across the country and failed to adequately design and test its products before placing them on the market.
The CertainTeed siding class action settlement will cover all individuals or entities that owned, as of September 30, 2013, homes, residences, buildings or other structures located in the United States, on which specific CertainTeed products were installed on or before September 30, 2013. The class action settlement will allow owners of properties where failed CertainTeed siding was installed to claim cash payments proportionately based on criteria including the size, age and condition of the damage. Class Members will have up to six years to file a claim, according to the agreement.
U.S. District Judge Thomas N. O’Neill, Jr. preliminarily approved the CertainTeed class action settlement on October 3, 2013. A Final Approval Hearing is scheduled for February 19, 2014.
The CertainTeed siding settlement resolves numerous class action lawsuits about alleged product defects that were filed against CertainTeed in 2010. In 2011, the U.S. Judicial Panel on Multidistrict Litigation transferred all cases to the Eastern District of Pennsylvania. The products included in the class action lawsuits are CertainTeed’s Weatherboards Fiber Cement Siding, Lap Siding, Vertical Siding, Shapes, Soffit, Porch Ceiling, and 7/16” Trim.
According to the consolidated class action lawsuit, CertainTeed manufactured and marketed its fly ash-based siding products as durable, long-lasting and appropriate for use on homes. Plaintiffs, however, complained they noticed large gaps between siding boards on their houses years after purchasing homes built with the siding.
Plaintiffs in the CertainTeed class action lawsuit also complained that aside from shrinking, cracking and warping, the siding also tends to freeze during winter. It also allegedly displays poor paint adhesion and significant moisture absorption.

My cement board siding is cracking and sagging. I have no documentation or receipts as this was installed by a contractor back in 2009. I was totally unaware of this lawsuit. I’m assuming I’m just out with no benefits.
My shingles have fallen since day one. CertainTeed insists they were installed improperly. Who are they to dodge the bullet?

I received my first payment 6 years ago. I was promised my final payment in 2019. I keep getting the run around & to date I have not received final payment.

We filed a claim in February 2019. As of today, April 14, 2021, we have not received a final determination. We have sent more than 100 pictures and all the required documents. We have submitted the documents multiple times as about every 4-6 months they ask for the same documents again. All we get is auto reply emails. There seems to be no motivation or fiduciary responsibility on the part of the administrator, Analytic Consulting.. The longer they take the more money they make. Maybe there should be a class action lawsuit against Analytic Consulting.

I have had the same issues. I am in contact with an attorney in Washinton County WI on this matter. There are laws to protect us from delays on distibution after a claim has ended.

We have filed a claim and for 3 years it has not been processed. They keep say they need this that and etc. It is very hard to talk to a person, you are on hold at least 30 or more minutes. After holding on a female the female said they will send letter of what else they need. This has happend 4 times, always something they need but didn’t let you know from the beginning. This is their procedure on giving you the run around. We are in need of advice as to how we proceed. I was thinking of contacting the court that appointed this company to handle claims or just hire and attorney. This is wrong.
Curious if you ever resolved your situation with Certainteed siding. We are in exactly the same situation. They never give feedback, but sit for months and if you actually reach them, they say you still owe them information.
Our siding has gaps between the boards and also has slipping issues. Please add us to this class action suit.

Had binal siding by Certainteed installed in 2010. It has warped twisted and fell off and looks horrendous. Had the Certainteed rep there and he’s saying the sun or a grill did the dage. Bull shit, it’s in the deck of my front porch and only sees the west sun. Don’t even own a grill. Please add me to this lawsuit. This crap and lies from their rep has gone in way to long. This house needs repaired and Certainteed is the reason.
