Class Action Suit Filed Against TLC LASIK Centers

By Sarah Pierce

A class action lawsuit has been filed against TLC LASIK Centers for allegedly performing surgeries on patients who weren’t qualified for the procedure. The lawsuit, which seeks about $180 million in damages, claims the national chain of laser eye surgery centers operated on patients with pre-existing conditions that should have disqualified them and then tried to cover up what happened to avoid getting sued.

Guess that didn’t work out too well.

The suit was filed on behalf of several patients who underwent the vision correction surgery between 1997 and 2003, even though pre-existing conditions caused them to suffer post-operative problems. According to one attorney who helped file the suit, TLC created two files for approximately 1,600 patients: one for the patient to read that said the patient was in good ocular health, and one for the center that indicated the patient had pre-existing conditions that put them at risk for post-operative problems like progressive vision loss. Lawyers say they’ve found nearly 200 TLC patients who have experienced post-operative problems.

The lawsuit accuses TLC of knowingly accepting unqualified patients and telling patients that future procedures would improve their conditions, even though they knew it wasn’t likely.

According to BusinessWeek.com, TLC LASIK’s parent company, TLC Vision, filed for Chapter 11 bankruptcy protection in December. A TLC spokesman said the company expects to emerge from bankruptcy in May.

  1. Justin Turner says:

Had TLC lasik center in Oklahoma city, OK do my surgery around 2001. I have had blurry vision twitching for the last several years. I contacted TLC and was told the office i had my surgery done at has closed down and the lifetime warranty was void due to that. My eyes seem worse now than they were before the surgery.

  2. Robert Smith says:

I had a surgery done for telsey and did not hold up but for two years now my eyes are worse than they ever

  3. Sheila Wallace says:

I had Lasik done in 2000 by TLC in Illinois and shouldn’t have had lasik as I had a pre-existing condition. My primary doctor thought I wasn’t a candidate, but sent me to TLC to be evaluated. TLC decided to do the lasik. When my eyes started getting bad three years ago, I contacted TLC to see if I could get an enhancement because I have a life time guarantee and they refused. Now I have glaucoma because I was told by the glaucoma specialist and my primary eye doctor that they believe it was caused by the Lasik I received. I have no history of glaucoma in my family and the condition I had back in 1998 can cause glaucoma and even through TLC knew this they still preformed the Lasik. My symptoms started back in 2013. TLC refused to see me with the issues.
