
CSAA to Settle Class Action Suit Over Collision Claims with Uninsured Motorists

The California State Automobile Association (CSAA) has agreed to settle a class action lawsuit that accuses the insurance company of improperly charging deductibles to CSAA customers who filed collision claims with uninsured motorists. The lawsuit claims that under the terms of CSAA’s California auto insurance policy, CSAA was required to waive the collision deductible in cases of accidents with uninsured motorists, regardless of which driver was at fault.
If you insured an automobile with CSAA and filed a collision claim between December 1, 1998 and February 28, 2006 due to an accident with an uninsured motorist, and CSAA charged you a deductible in connection to this insurance claim, you may be eligible for money from the proposed class action settlement. The amount of your payment will depend on a detailed review of CSAA’s files regarding your claim and the date your claim was originally handled by CSAA. This could result in a reimbursement of anywhere between 20% of the collision deductible to 100% of the collision deductible plus 10% interest.
