Overdue InvoiceThree companies have been named in a class action lawsuit over their practice of buying old debts for “pennies on the dollar” and tricking people into restarting the statute of limitations of their retired debts.According to the class action lawsuit, Asset Acceptance Capital and Asset Acceptance hire Genesis Financial Solutions to help collect these debts by using a “misleading and deceptive” credit card offer and promise of debt restoration with the “vague and misleading promise of no future legal action” on any amount of the debt placed on the card. “But in reality they are restarting the statutes of limitations on old debts, creating new debt obligations, and introducing the consumer into new, binding contracts that do authorize future legal action.” Furthermore, these terms of the agreement are never included or clarified in the credit card offer pitch and are not given to the consumer until after they have signed and are bound by the contract. Many of the debts these companies target are either already expired or will be expired soon.The class action lawsuit alleges violations of the Fair Debt Collection Practices Act and is seeking damages for class members and an injunction barring these companies from future violations.

    I was never served by Asset Acceptance, next thing you know I have a wage garnishment taking my pay. Come to find out the order to garnish my wages was established in California, I am now in Virginia, and I had to get an attorney for bankruptcy as this garnishment took a toll on my finances, could not even pay my bills. So my attorney called California and there is no order from the courts or judge to garnish my pay, it seems like they are doing illegal practices in regards to paperwork sent to my employer. Is this class action lawsuit still in effect. Then the debt that they went after me for was years ago, never received anything from them in regards to the debt until wage garnishment.     I have researched lawsuits involving Asset Acceptance and I have been sued by them. In my case I never received notice of the lawsuit so that I could fight the case in court therefore I lost by a default judgment. I didn’t even know about the judgment until after I was unable to ask for a hearing on it. I found out when they garnished my bank account. I have all my records on the account they bought and the lawsuit filed against me was done after the statute of limitations for filing had passed but because I didn’t know about it and didn’t go to court they didn’t have to prove anything. I want to be included in the class action suit.

    I would like to also be included in class action against Asset Acceptance, The company has Violated several of the Fair Debt Collection Act against me.

    I currently have Asset Acceptance attempting to elicit a response from me so that they can resurrect this expired debt. They just recently sent me a ‘copy’ of their new privacy policy, not sure what they are attempting to pull here, but I looked into a few things and it looks as if they are trying to elicit a response. From what I know about collection laws they must provide a means to allow them to release information to third parties, and they didn’t. These sleazy no good ambulance chasers need to be sued, so I would like to be included into the class action against them.
