A judge has certified a Minnesota class action lawsuit that could force Domino’s Pizza, Inc. to change the way it pays delivery drivers nationwide.
According to the class action lawsuit, Domino’s pays drivers on a per-delivery payment system that doesn’t include gas, mileage and other reimbursements for travel expenses, effectively paying drivers below the federal minimum wage. The class action lawsuit also claims Domino’s pocketed “delivery charges” from pizza delivery orders that should have been given to the drivers because they’re considered gratuity under Minnesota law.
It’s estimated that more than 22,000 former and current pizza delivery drivers employed at corporate-owned Domino’s locations in every state except New York and California, since March 2006, will be covered under this class action lawsuit. The lawsuit is seeking a class action settlement that will reimburse drivers for unpaid back wages and an injunction requiring Domino’s to appropriately reimburse its delivery drivers.
