Mercedes-Benz Reed Valve Class Action Settlement

Mercedes-BenzSome older-model Mercedes-Benz S-Class and CL-Class vehicles are prone to water damage, according to a class action lawsuit. If you’ve ever owned or leased a 2001-2006 model year Mercedes S or Mercedes CL vehicle, you may be entitled to a cash reimbursement or free future repairs from the class action lawsuit settlement.

 

The class action settlement resolves a 2008 lawsuit that claims the reed valve in the air/water duct in these vehicles is susceptible to clogging by leaves, pine needles and other debris, which can cause water to accumulate in the air/water duct and to overflow into the passenger compartment, possibly resulting in damage to electrical and other components.

 

The class action lawsuit includes two types of class members: those who currently own or lease a model year 2001-2006 Mercedes-Benz S-Class (W220) or CL-Class (W215) vehicle — even if you haven’t incurred water damage — and those who previously owned or leased a class vehicle who incurred out-of-pocket, unreimbursed expenses for repair of water damage due to a clogged reed valve in the air/water duct.

 

If you meet any of these class member requirements, you could receive one of the following benefits from the class action lawsuit settlement:

 

Maintenance: Mercedes-Benz dealers will now include a check and, if necessary, clearing of the reed valve in future service visits.

 

Reimbursement Program: If you incurred out-of-pocket expenses as a result of a clogged reed valve prior to May 17, 2010, Mercedes-Benz will reimburse you for all costs related to the repair (including parts and labor). Mercedes-Benz will also provide a reimbursement for one-time towing and car rental costs, up to a combined maximum of $150, that were incurred due to water damage.

 

Payment for Future Water Damage: If you experience water damage after May 17, 2010, but prior to 100,000 miles on the vehicle’s odometer or 18 months after the May 17, 2010 (which ever occurs first), Mercedes-Benz will pay for the repairs.

    Hello,

    My 2013 C300 4matic is at Mercedes dealership right now because of this problem. I see this was printed a couple of years ago, but I am having this same problem now, water go inside my car, both driver and passenger side was wet. Light and needles flashing and dropping all over the place.

    Unfortunately, Ive fallen victim to the Reed Valve failure too. I own a 2004 MB S55 with only 34,000 miles on it which has been garaged kept for over 20 years. In August of 2015 after hand-washing the car I was unable to start it and the entire electrical system was inoperable. I had a flatbed truck deliver it to the dealer who advised me that the rear SAM unit required replacement due to water intrusion and recommended I file a claim with my insurance company because they were unaware of the extent of the damage. The vehicle has been at the dealership for over 5 months without any reparative work being performed whatsoever. I was so frustrated that I began to research the issue on the web over the weekend and discovered that a Class Action Lawsuit Settlement was made back in 2010, but my vehicle doesn’t qualify since the deadline for filing a claim was December of 2011, despite the total mileage on my vehicle being only 34,000. When I confronted the dealerships service manager with my discovery, he had the audacity to try and blame me for the damage by asserting the vehicle was poorly maintained. Im so angry and upset over the fact that I have no recourse at this point time and question why the Californian Federal Court failed to require MCUSA to notify ALL original owners of the vehicles susceptible to damage so that measures could be taken to prevent the potential incident from occurring. In essence, Im being penalized for pampering the vehicle. The vehicle should have been recalled or at the very least a TBSB should have been sent to ALL owners. John Capponi, Philadelphia, PA

    IN 2015 OUR S500 ELECTRONIC COMPARTMENT(UNDER PASSENGER SIDE) FLOODED you say, or shout actually. 12/28/2015 you wrote the comment and you already have mold? And you have respiratory problems already also? Dang that is fast.

    IN 2015 OUR S500 ELECTRONIC COMPARTMENT(UNDER PASSENGER SIDE) FLOODED AND SHUT OFF THE VEHICLE OPERATION WHILE ON FREEWAY NEARLY CAUSING A MULTIPLE CAR ACCIDENT – AFTER BEING TOWED TO AN INDPENDANT GARAGE WE LEARNED THAT THE FLOOD WAS CAUSED BY THIS MB DESIGN PROBLEM- OUR INSURER ALLSTATE DID NOT TOTAL THE VEHICLE- ASIDE FROM THE DANGER OF THIS REOCCURING THERE IS A HEALTH CONCERN WITH MOLD AND RESPIRATORY PROBLEMS WHICH I HAVE HAD SINCE – ANYONE ELSE SUFFERING FROM MOLD EXPOSURE? WE STOPPED DRIVING THE VEHICLE- Please reply to traderwds@yahoo.com

    I own a 2006 S430, it has under 100,000 miles and it is still under factory warranty. In September of 2012, after very heavy rains the car lights would not shut off, we drove the car to Mercedes. The Mercedes dealer suggested that we put in an insurance claim with our Auto Insurance carrier GEICO. GEICO totaled the car as it estimated more then $30,000.00 to repair and its value is $21,000.00. I am not happy because I drive my cars till they die, and I was planning to drive this one for many years to come. I don’t want to start all over with new car payhments. Is there anything I can due? Nick

    My car is at the mercedes dealer for extensive water damage that happened durind Isaac on Aug. 27-2012. All other cars got through this puddle. My called stalled and had to be towed.Any advice. I have a CLK350 2008. Lee

    I would like to be part of this suit. I had problems with my theromosted and after changing it got a misfire on my car. I was told I needed to replace the valve per MB delearship.

    I tried getting on both links on this page but non of them work. please assist.
