Sprint 4G Class Action Lawsuit

Angry Sprint customers who pay a monthly premium for 4G service and who shelled out big bucks for the EVO 4G and Epic 4G -- even though they don’t get 4G service -- may finally get some vindication from a class action lawsuit filed September 30 in Southern California.

 

Sprint rolled out the 4G phones “with great fanfare” this summer as the first and only phones able to access wireless 4G from a national carrier. According to the Sprint 4G class action lawsuit, however, Sprint’s 4G coverage is limited to only 53 markets in 22 states, and many of these markets are not even located in major urban areas. In California, for example, Sprint only offers 4G service in the cities of Merced, Modesto, Stockton and Visalia. Major California areas such as Los Angeles and San Francisco have been promised 4G access “in the near future” by Sprint, but no specific California 4G rollout dates have been made public. Other major urban such as San Diego and Sacramento have no prospect of having Sprint 4G access any time in the near future.

 

On top of having to pay premium prices for a 4G phone that doesn’t get 4G service, these customers are also required to purchase Sprint’s “Everything Data” plan and pay an additional $10 a month for 4G service -- which they’re not even getting.

 

The Sprint 4G class action lawsuit is brought on behalf of all individuals or entities who purchased, leased or otherwise acquired 4G wireless phones from Sprint and were billed for Premium Data charges or other charges specific to 4G phones but did not receive 4G service starting May 2010 to the present. It also includes a subclass of individuals and entities that reside in California and were billed for the $10 Premium Charge at issue during the relevant time period.

I too am sick of Sprint advertising about 4G,have been with Sprint about 2 years with the IPhone 4S and not 1 time have I sen 4G show up on my phone. Whether I was in DC or SC. I live in NC and I am getting ready to suit them for the charges I have paid for 2 phones.

class action lawsuits is a joke. regular joes like us will get nothing. the lawyers will get everything. i will just walk away and don't worry about it when my contract is up.

I have 4 more months with Sprint, and I will say good bye to contracts for good. I am sick and tired of them lying about the 4G, and no 4G for me. When my contract is up, I will use the cheap pay as you go phone plans, and that will be all that I will need. I've had it with all their lying and cheating ways.

Ok EVERYONE that's asking to be put on the lawsuit list first off a lawsuit of this type is going to take YEARS typically before its ever going to get to "how many customers" are there to be compensated and how much each will receive. At which time they will get a list "court ordered" mind you that Sprint will have to produce affecting "X" amount of litigants and then there will be a very broadly advertised by the lawyers in the newspapers,TV,e ct asking for people affected to submit their names at which time you'll be sent a form basically stating you were affected for "X" amount of time that you'll sign and then you'll be sent an award check. At this point in time there is no need to try to get in on the ground floor. Trust me if the lawsuit goes thru the lawyers will get whole of everyone possible because a bigger base of customers affected will mean more people the lawyers will get a percentage of awards for! So just relax and save your breath it'll be awhile and you will get yours eventually. I've received 3 awards of this type before so I know how it goes. 2 from companies I used to work for and 1 for the Samsung Capacitor Lawsuit settlement.. Just saying. I'd like to see some money back out of this also considering I've been running 2 Everything family plan lines for 5 years now myself

@ #2 Sprint - There's no need to think about the "use more-pay more" factor when I was told that I was paying for unlimited data & unlimited Internet with the hotspot.
Why would advertise it as unlimited and call it unlimited for one price if they were looking to get more?
They lied about the service they were providing. Not only did they lie about it, they changed the terms of service without notifying their customers that they had the intentions to do so.

Got bad news guys, I talked to sprint and the evoshift,and the epic 4gshift are both ymax phones, and if you don't already have 4g you never will because all new city installs will LTE and my too phones will only work in cities that are currently have ymax... so the 2 phones I bought for 4g in dayton ohio will never be useable where I live as 4g phones, but they tell me its ok cause if I visit cities with ymax I can use it...really

I received an letter from Sprint today that they are dumping me as a customer due to the amount of roaming I am doing in my area. For the last 3 year I tried to get out of my contract and could not, I was even forced to buy an Evo 4 G phone that does not work in my are too. I have been on the unlimited plan for 2 years but now that Sprint is being fined for my roaming they are forcing me out. I want to sue them just like AT&T had happen to them. Sue the hell out of them for the hell that sprint put me through for the last 3 years. It is not my fault that there service is shit in my area I have been telling them that for years and can prove that I have been.

I'm so pissed off at sprint right now first of they promised and upgrade every year to us for switching from another carier and said that 4g is right around the corner i have be waiting for 9 months and still no 4g what am i paying for i feel i got lied to and ripped of i life in spokane wa in you stand in the middle of downtown you will get 1 bar or 4g and thats it i want part of this please i have been lied to and they need to pay for there lies....!!!!!!

I filed a BBB complaint, was contacted by Sprint and told there was nothing they could do. It was as I figured, BBB complaints are worthless, but an interesting experiment nonetheless.

So if you think about it, a company (Sprint) sells a phone that is capable of 4G high speed, then it puts up a single tower in a small town located in the same television range as a big city, then floods the market with 4G ads. Sprint make a boat load of money off the hopeful peasants and instead of bringing a 4G network they bring 4G LTE network, forcing the peasants to either upgrade their phone again or SORRY you just don't get 4G LTE

I live in Clovis CA. When I first saw the HTC EVO 4G come out with all of the first network with 4G hoopla, i was excited and couldn't wait to get my hands on one. I saved enough money by the time the HTC EVO 3D came out (2yrs) and bought that one. I was told by Sprint reps at the store that they were working on getting 4G here very soon, it could be any day. 6 months later and no 4G. Guess what!!! I just received an ad from Best Buy showing a new HTC EVO 4G LTE comming soon. WTF! So to add gasoline to the fire, We have been paying a $10 premium "4G" data fee to a company whom had no intentions of bringing us 4G.

They roll out their 4g phones last spring and my friend who lives in pittsburgh bought one. I was ready to get a new play so I decided on sprint. The sales rep was raving about the 4g. i thought this was the future so I decided to invest. What I didnt know is that I was investing but would never see a return. I live in a mid level metropolitan area and we have 0 4g service While other SMALLER areas of pennsylvania have the service. The Rep said we didnt have 4g yet but it was just around the corner. It sounded legit bc of all the advertising for 4G. You cant sell a 4G phone, and charge for 4G coverage for technology that will never come to fruition during the contract.

I was told tht the 10 dollar fee was for the 4G but then they tell me it for the data plan so my phone wrk faster. I live in Milwaukee wi and I have had the EVO since it can out and i now have the 3d but still no 4G and the service in this city sucks.

I have few problems with Sprint.... Have been a customer for almost 10 years. I had a very old phone, and just recently updated to an HTC EVO. I am not in a 4G area, and still agreed to the new "Everything" charges of about $69 per month. My issue is - about 1 month after I signed on for the new plan (including the outrageous cancellation fee) I was told that my "Plan" is no longer available, and now they have been charging me about $100 per month for the same service. There has to be something illegal about that type of business practice.

I just wanted to say Timothy is an idiot... 400 dollars a month? Really? Dropped calls all the time? Really? You can't send text? Really? Bad customer support from Sprint operators? Really? I've had nothing but excellent customer support from them. What company do you work for because everything you said was absolute lies!

I know it for sure Sprint, ATT and Verizon tends more "Malpractice bills charge on everyone the customer" I don't want the customer feed the elite top of career position inside the Sprint headquarter increase salary. They took advantage of the customer's pocket because they think the customer "dump or puppet" One day, the eagle catch the fish out of the lake" it means the law force the business shut down and closed the business. I don't have any mobile. I hate mobile because of fraud bills and false fees etc... I fed up. I will never buy any new coming mobile or tablet. I avoid it. Because the company always bad treat to the customer. One day Sprint or any company will be lose business for sure.

It think it would be easy for sprint to disable the 4g service on the phone, like the $30 Portable Hot Spot option they disable. Just disable the 4G service for people that don't live in a 4G area, like me, and don't charge the $10 fee. I've called sprint a few times with phone issues and i love when they tell me to re-boot my phone. On re-boot, I love to throw the "it's in the big 4G display startup screen to remind me i'm paying $10 per month for nothing." Most of the sprint operators laugh and say they are in the same boat.

wish i would have known about this lawsuit sooner, i have had problems with Sprint since day one. i have the everything unlimited plan with 2 phones on my account, my plan is 129.99 a month but yet i am being charged almost 400 bucks a month with all this 4G crap but yet we still don't have 4G in our area, i can't send out texts and get dropped calls daily. i have done everything i possibly could to get all the services fixed including call sprint every single day. what more can i possibly do and how would i go about getting my money back for services not provided within my plan?

It's unfair how Sprint keeps false advertising a service they don't have in certain areas, all my friends who have Verizon and tmobile just bought their phones and get 4g, I bought my EVO in November 10 and still have no 4g service even though I'm paying for it. Something needs to be done to force Sprint to either give a refund or get their 4g up and running immediately. I have been a customer for over 10 years and feel they don't care. I have called to complain and they can never tell you when they will resolve this issue. I'm sick of 3g it just can't keep up with this phone. Let's just say Sprint you suck!!!

I have had my evo 4g for 3 months now and have had this thing refreshed several times and reported several times also replaced once . Now the phone still is messed up and needs to be replaced yet again. The multi media hardly ever works I can no longer send or receive pic messages . I signed on for a premium package for $69.99 a month for unlimited web text and talk . Now on my bill its charging me for extremely premium services ? When I called and asked Sprint they said its for unlimited web . Wtf that's why I pay $69.99 . Also lots of add on apps Sprint thought would be nice to add without my approval . Each app added on goes for $9.99 a month . So long story short the evo does not do what I was told it does prior to purchase. And the bill is a clever mystery at best . Not one person at Sprint has done what they said they would do to fix the problem . I am less than impressed. 3 month bill now is at $450 . What a scam . Something needs to be done about this . I bought 5 Evo 4G phones through sprint last year for my family members, I have paid $10.00 per phone that equals $50.00 a month for 13 months now. For a total of $650.00 and no 4g how can this me legal. They told me when I bought the phones that 4G would be up and running within a month of my purchase. I am happy I found this site.

Its funny just a few days ago I filed with BBB about samsung epic isues and the 3 refurbished phones that don't work, the rep said I was not paying 10 dollars more for 4G I was paying for an "enhanced experiance with the media and blahblah, sounded like a new spin to damage control effort. Straight up sale associates and sprint said pay 10 on epic and evo for 4G not that other bs. Come on law suite fix these douchebags.

:PAlthough ATT does offer 2 gb for 25 It also has unlimited data for $30, if your using 5,6 GB a month you need to stop looking at porn or figure out how to use the interweb on dat der mobile divice you hill billy bashing is all fine and dandy you see what happend to verizon right bashing ATT got them cornerd with iPhone's and no subscribers. Sprint has issues thats true. with the new aquistion of teenmobile 10$ unlimited data on a 4G device. I encourage all sprint customers myself included to leave as soon as your contracts up and enter into an agreement with tmobile on a nice device evo is overated and is really a peice of crap compared to all the new devices out there. and grandfather your self in with the 10$ data plan oh by the way att offers 10 unlimited family for each subscriber, good to have family in the business and use the web for what its there for information! not porn SPRINT looser.

Its not 4G charge it is called a premium data charge, Sprint addresses this issue to smartphone which uses 3 to 10 x more data, I average 5 to 6 GBs a month while att charges 2 gb for 25 dollars, Think about it, use more data pay more

This lawsuit should include ALL of sprints customers, not just those in California. We in the midwest are forced to pay for the 4G network also, and they don't even know when it will be available in the upper, or central midwest! They tell us that it's "just in case we travel to somewhere where 4G is available". :-( It makes me mad, but I'm in a two-year contract, so there is nothing I can do, and their staff are pushing the 4G phones, In fact, I don't know if they have many 3G phones left in their store!
