Sprint 4G Class Action Lawsuit

Angry Sprint customers who pay a monthly premium for 4G service and who shelled out big bucks for the EVO 4G and Epic 4G — even though they don’t get 4G service — may finally get some vindication from a class action lawsuit filed September 30 in Southern California.

 

Sprint rolled out the 4G phones “with great fanfare” this summer as the first and only phones able to access wireless 4G from a national carrier. According to the Sprint 4G class action lawsuit, however, Sprint’s 4G coverage is limited to only 53 markets in 22 states, and many of these markets are not even located in major urban areas. In California, for example, Sprint only offers 4G service in the cities of Merced, Modesto, Stockton and Visalia. Major California areas such as Los Angeles and San Francisco have been promised 4G access “in the near future” by Sprint, but no specific California 4G rollout dates have been made public. Other major urban such as San Diego and Sacramento have no prospect of having Sprint 4G access any time in the near future.

 

On top of having to pay premium prices for a 4G phone that doesn’t get 4G service, these customers are also required to purchase Sprint’s “Everything Data” plan and pay an additional $10 a month for 4G service — which they’re not even getting.

 

The Sprint 4G class action lawsuit is brought on behalf of all individuals or entities who purchased, leased or otherwise acquired 4G wireless phones from Sprint and were billed for Premium Data charges or other charges specific to 4G phones but did not receive 4G service starting May 2010 to the present. It also includes a subclass of individuals and entities that reside in California and were billed for the $10 Premium Charge at issue during the relevant time period.

    Sprint 4G Class Action Lawsuit
    This lawsuit should include ALL of sprints customers, not just those in California. We in the midwest are forced to pay for the 4G network also, and they don’t even know when it will be available in the upper, or central midwest! They tell us that it’s “just in case we travel to somewhere where 4G is available”. :-( It makes me mad, but I’m in a two-year contract, so there is nothing I can do, and their staff are pushing the 4G phones, In fact, I don’t know if they have many 3G phones left in their store!

    Its not 4G charge it is called a premium data charge, Sprint addresses this issue to smartphone which uses 3 to 10 x more data, I average 5 to 6 GBs a month while att charges 2 gb for 25 dollars, Think about it, use more data pay more

    :PAlthough ATT does offer 2 gb for 25 It also has unlimited data for $30, if your using 5,6 GB a month you need to stop looking at porn or figure out how to use the interweb on dat der mobile divice you hill billy bashing is all fine and dandy you see what happend to verizon right bashing ATT got them cornerd with iPhone’s and no subscribers. Sprint has issues thats true. with the new aquistion of teenmobile 10$ unlimited data on a 4G device. I encourage all sprint customers myself included to leave as soon as your contracts up and enter into an agreement with tmobile on a nice device evo is overated and is really a peice of crap compared to all the new devices out there. and grandfather your self in with the 10$ data plan oh by the way att offers 10 unlimited family for each subscriber, good to have family in the business and use the web for what its there for information! not porn SPRINT looser.

      Good idea except now sprint just cancelled our contract because we have the ” unlimited data plan”, moved and now “roaming” all the time. Been with sprint for over 4 years but now their policy is if you use too much data ” we reserve the right to cancel your contract with only 7 days notice”. We thought we were safe being “grandfathered” in under our old contract…nope just more little people getting screwed by big corporations. Why I’mhere, want to sue them to stop this practice of “selling us” on unlimited data plan, but then cancelling our contract for actually using it.

    Sprint 4G Class Action Lawsuit
    Its funny just a few days ago I filed with BBB about samsung epic isues and the 3 refurbished phones that don’t work, the rep said I was not paying 10 dollars more for 4G I was paying for an “enhanced experiance with the media and blahblah, sounded like a new spin to damage control effort. Straight up sale associates and sprint said pay 10 on epic and evo for 4G not that other bs. Come on law suite fix these douchebags.

    Sprint 4G Class Action Lawsuit
    I bought 5 Evo 4G phones through sprint last year for my family members, I have paid $10.00 per phone that equals $50.00 a month for 13 months now. For a total of $650.00 and no 4g how can this me legal. They told me when I bought the phones that 4G would be up and running within a month of my purchase. I am happy I found this site.

    Sprint 4G Class Action Lawsuit
    I have had my evo 4g for 3 months now and have had this thing refreshed several times and reported several times also replaced once . Now the phone still is messed up and needs to be replaced yet again. The multi media hardly ever works I can no longer send or receive pic messages . I signed on for a premium package for $69.99 a month for unlimited web text and talk . Now on my bill its charging me for extremely premium services ? When I called and asked Sprint they said its for unlimited web . Wtf that’s why I pay $69.99 . Also lots of add on apps Sprint thought would be nice to add without my approval . Each app added on goes for $9.99 a month . So long story short the evo does not do what I was told it does prior to purchase. And the bill is a clever mystery at best . Not one person at Sprint has done what they said they would do to fix the problem . I am less than impressed. 3 month bill now is at $450 . What a scam . Something needs to be done about this . Thanks for your time…

    Sprint 4G Class Action Lawsuit
    It’s unfair how Sprint keeps false advertising a service they don’t have in certain areas, all my friends who have Verizon and tmobile just bought their phones and get 4g, I bought my EVO in November 10 and still have no 4g service even though I’m paying for it. Something needs to be done to force Sprint to either give a refund or get their 4g up and running immediately. I have been a customer for over 10 years and feel they don’t care. I have called to complain and they can never tell you when they will resolve this issue. I’m sick of 3g it just can’t keep up with this phone. Let’s just say Sprint you suck!!!

    Sprint 4G Class Action Lawsuit
    wish i would have known about this lawsuit sooner, i have had problems with Sprint since day one. i have the everything unlimited plan with 2 phones on my account, my plan is 129.99 a month but yet i am being charged almost 400 bucks a month with all this 4G crap but yet we still don’t have 4G in our area, i can’t send out texts and get dropped calls daily. i have done everything i possibly could to get all the services fixed including call sprint every single day. what more can i possibly do and how would i go about getting my money back for services not provided within my plan?

    It think it would be easy for sprint to disable the 4g service on the phone, like the $30 Portable Hot Spot option they disable. Just disable the 4G service for people that don’t live in a 4G area, like me, and don’t charge the $10 fee. I’ve called sprint a few times with phone issues and i love when they tell me to re-boot my phone. On re-boot, I love to throw the “it’s in the big 4G display startup screen to remind me i’m paying $10 per month for nothing.” Most of the sprint operators laugh and say they are in the same boat.

    I know it for sure Sprint, ATT and Verizon tends more “Malpractice bills charge on everyone the customer” I don’t want the customer feed the elite top of career position inside the Sprint headquarter increase salary. They took advantage of the customer’s pocket because they think the customer “dump or puppet” One day, the eagle catch the fish out of the lake” it means the law force the business shut down and closed the business.

    I don’t have any mobile. I hate mobile because of fraud bills and false fees etc… I fed up. I will never buy any new coming mobile or tablet. I avoid it. Because the company always bad treat to the customer. One day Sprint or any company will be lose business for sure.

    I have few problems with Sprint…. Have been a customer for almost 10 years. I had a very old phone, and just recently updated to an HTC EVO. I am not in a 4G area, and still agreed to the new “Everything” charges of about $69 per month. My issue is – about 1 month after I signed on for the new plan (including the outrageous cancellation fee) I was told that my “Plan” is no longer available, and now they have been charging me about $100 per month for the same service. There has to be something illegal about that type of business practice.

    They roll out their 4g phones last spring and my friend who lives in pittsburgh bought one. I was ready to get a new play so I decided on sprint. The sales rep was raving about the 4g. i thought this was the future so I decided to invest. What I didnt know is that I was investing but would never see a return. I live in a mid level metropolitan area and we have 0 4g service While other SMALLER areas of pennsylvania have the service. The Rep said we didnt have 4g yet but it was just around the corner. It sounded legit bc of all the advertising for 4G. You cant sell a 4G phone, and charge for 4G coverage for technology that will never come to fruition during the contract.

    I live in Clovis CA. When I first saw the HTC EVO 4G come out with all of the first network with 4G hoopla, i was excited and couldn’t wait to get my hands on one. I saved enough money by the time the HTC EVO 3D came out (2yrs) and bought that one. I was told by Sprint reps at the store that they were working on getting 4G here very soon, it could be any day. 6 months later and no 4G. Guess what!!! I just received an ad from Best Buy showing a new HTC EVO 4G LTE comming soon. WTF! So to add gasoline to the fire, We have been paying a $10 premium “4G” data fee to a company whom had no intentions of bringing us 4G.

    So if you think about it, a company (Sprint) sells a phone that is capable of 4G high speed, then it puts up a single tower in a small town located in the same television range as a big city, then floods the market with 4G ads. Sprint make a boat load of money off the hopeful peasants and instead of bringing a 4G network they bring 4G LTE network, forcing the peasants to either upgrade their phone again or SORRY you just don’t get 4G LTE

    I received an letter from Sprint today that they are dumping me as a customer due to the amount of roaming I am doing in my area. For the last 3 year I tried to get out of my contract and could not, I was even forced to buy an Evo 4 G phone that does not work in my are too. I have been on the unlimited plan for 2 years but now that Sprint is being fined for my roaming they are forcing me out. I want to sue them just like AT&T had happen to them. Sue the hell out of them for the hell that sprint put me through for the last 3 years. It is not my fault that there service is shit in my area I have been telling them that for years and can prove that I have been.

    Got bad news guys, I talked to sprint and the evoshift,and the epic 4gshift are both ymax phones, and if you don’t already have 4g you never will because all new city installs will LTE and my too phones will only work in cities that are currently have ymax… so the 2 phones I bought for 4g in dayton ohio will never be useable where I live as 4g phones, but they tell me its ok cause if I visit cities with ymax I can use it…really

    @ #2 Sprint – There’s no need to think about the “use more-pay more” factor when I was told that I was paying for unlimited data & unlimited Internet with the hotspot.
    Why would advertise it as unlimited and call it unlimited for one price if they were looking to get more?
    They lied about the service they were providing. Not only did they lie about it, they changed the terms of service without notifying their customers that they had the intentions to do so.

    Ok EVERYONE that’s asking to be put on the lawsuit list first off a lawsuit of this type is going to take YEARS typically before its ever going to get to “how many customers” are there to be compensated and how much each will receive. At which time they will get a list “court ordered” mind you that Sprint will have to produce affecting “X” amount of litigants and then there will be a very broadly advertised by the lawyers in the newspapers,TV,ect asking for people affected to submit their names at which time you’ll be sent a form basically stating you were affected for “X” amount of time that you’ll sign and then you’ll be sent an award check. At this point in time there is no need to try to get in on the ground floor. Trust me if the lawsuit goes thru the lawyers will get whole of everyone possible because a bigger base of customers affected will mean more people the lawyers will get a percentage of awards for! So just relax and save your breath it’ll be awhile and you will get yours eventually. I’ve received 3 awards of this type before so I know how it goes. 2 from companies I used to work for and 1 for the Samsung Capacitor Lawsuit settlement.. Just saying. I’d like to see some money back out of this also considering I’ve been running 2 Everything family plan lines for 5 years now myself

When my contract is up, I will use the cheap pay as you go phone plans, and that will be all that I will need. I’ve had it with all their lying and cheating ways.

    I live in Virginia Beach, VA and have purchased Sprint’s 4G phones and service. I was told by Sprint when I first purchased the phone that 4G was coming soon to my area. I kept checking in with them and they continued to give me the same story its coming soon. Finally they told me the technology used in my phone to use 4G has been discontinued and they now use 4G Lite. I asked if they could switch phones at no charge, they said No. Also if I were to cancel my service, they would have to charge me a cancellation fee of a couple of hundred dollars. Somehow this does not seem fair. I am still paying for a phone and service that doesn’t do what Sprint advertised it would do. They need to make this right!

    I currently have sprint service that really sucks my phone never works it does not charge properly and each time I’ve gone to the, about it they tell me to turn it off and let it reset or they say just buy another charger there ain’t nothing wrong with your phone but each time I go home it does the same thing, they also told me when I purchased the htc evo 3 d that I would soon be getting 4g coverage well that was over a year and a half ago and I still don’t have 4g it barely gets 3 g to be honest. I currently don’t even care to have sprint anymore because I have had so many problems however I am not going to pay them N early cancellation fee. Please help I want my money back for all this crap plus the phone cost me 200.00 for the evo and then 250.00 for the Samsung galaxy 3 I feel like they just totally got over on me and a lot of others

      there is nothing you can do about suing sprint or even about the coverage. your phone actually cost several hundreds of dollars MSRP if you have a smart phone. you signed an agreement saying that you fully understand and agree to the terms and conditions. there are two things that state about suing and coverage. quote: “Coverage; Where Your Device Will Work; Service Speeds
      Our coverage maps are available at our authorized retail locations and on sprint.com. The specific network coverage you get will depend on the radio transmissions your Device can pick up and Services you’ve chosen. Our coverage maps provide high level estimates of our coverage areas when using Services outdoors under optimal conditions. Coverage isn’t available everywhere. Coverage and Service speeds are not guaranteed. Coverage is subject to change without notice. Service speeds may depend on the Service purchased. Actual speeds will vary. Estimating wireless coverage, signal strength, and Service speed is not an exact science. There are gaps in coverage within our estimated coverage areas that—along with other factors both within and beyond our control (for example, network problems, network or internet congestion, software, signal strength, your Device, structures, buildings, weather, geography, topography, server speeds of the websites you access, actions of third parties, etc.)—may result in dropped and blocked connections, slower Service speeds, or otherwise impact the quality of Service. Services that rely on location information, such as E911 and GPS navigation, depend on your Device’s ability to acquire satellite signals (typically not available indoors) and network coverage.       and portion of suing,
      quote: “Mandatory Arbitration and Waiver of Class Action Instead of suing in court, you and Sprint agree to arbitrate all Disputes (as defined below) on an individual, non-representative, basis. You agree that, by entering into this Agreement, you and Sprint are waiving the right to a trial by jury or to participate in a class action or representative action. This agreement to arbitrate is intended to be broadly interpreted.
      In arbitration, there is no judge or jury. Instead Disputes are decided by a neutral third-party arbitrator in a more informal process than in court. In arbitration, there is limited discovery and the arbitrator’s decision is subject to limited review by courts. However, just as a court would, the arbitrator must honor the terms of the Agreement and can award damages and relief, including any attorneys’ fees authorized by law.
      “Disputes” shall include, but are not limited to, any claims or controversies against each other related in any way to or arising out of in any way our Services or the Agreement, including, but not limited to, coverage, Devices, billing services and practices, policies, contract practices (including enforceability), service claims, privacy, or advertising, even if the claim arises after Services have terminated. Disputes also include, but are not limited to, claims that: (a) you or an authorized or unauthorized user of the Services or Devices bring against our employees, agents, affiliates, or other representatives; (b) you bring against a third party, such as a retailer or equipment manufacturer, that are based on, relate to, or arise out of in any way our Services or the Agreement; or (c) that Sprint brings against you. Disputes also include, but are not limited to, (i) claims in any way related to or arising out of any aspect of the relationship between you and Sprint, whether based in contract, tort, statute, fraud, misrepresentation, advertising claims or any other legal theory; (ii) claims that arose before this Agreement or out of a prior Agreement with Sprint; (iii) claims that are subject to on-going litigation where you are not a party or class member; and/or (iv) claims that arise after the termination of this Agreement.”

      it states these segments in the contract at sprint.com/legal and as well as verizon and AT&T. even though you do not get 4g in your area check with tech support in seeing if sprint has plans in the future for them. currently sprint is rolling out a turbo network which provides something called TD_LTE. look up sprint spark. sprint plans to have 4g lte rolled out in the next 2-3 years. remember there is a difference between 4g wimax and 4g lte. 4g wimax was beginning to be rolled out in 2010 but was halted for 4g lte which was rolled out by april 2012 in some areas.

        I have been a sprint customer for more than 10 years. I have traveled throughout the US for work during that period. I average 140 nights away from home each year. I have received good coverage and good service during that time until the past 9 months. Something at sprint is very different. All your gibberish about weather, phone, servers and the like is bull butter. As a paying customer I expect a competitive level of service just as my customers do. When that level of service declines, which it has with sprint, cost should be adjusted accordingly. Service and cost must be commensurate, when it is not, there must be a new agreement. When the company decides to go down the legal road, they will always end up on the short end of that strategy. Get with it sprint.

    Sprint has always charged a month in advance. My service was disconnected July 15, 2013, reconnect August 5, 2013 one day into the billing period. Billing period runs from 5th of one month to 4th of the following month. I could not make any calls out, Sprint calls this hot wired. Sprint took the month in advance I had already paid and credited my account with penny. Now that the bill is current they are now adding another month in advance plus the current monthly charge to this new bill. I was told since the account was suspended they have to charge me another month in advanc plus all these other fees. So, now I have two months in advance. I know something can be done about this. This has got to be illegal. I don’t have a contract with Sprint at this time. And their CSR’s are trained very well as to how to advoid answering straight questions. I need help!! I have always had a problem with the 4G, I have an HTC EVO. How can I get in on the Law suite? That is if it isn’t to late.

    My wife and I have been with Sprint for 3+ years and this is the first year I’ve seen a Sprint icon on my phone.
    But I only seen it in the Sprint store!

    Hello,

    Can you advise if I can become a member of this class action as my phone from SPRINT is being recorded every day and every time I am on the phone. The tones clearly show that the phone is being recorded and if thats not bad enough they have cut off my DATA for some unknown means. Which if I may say the phones do work without the DATA service. that means they have been stealing money form the public/consumers for years. MY phone gets cutoff with full bars on a regular basis but in spurts. Then it stops and starts again. Sprint has claimed there is nothing wrong at all. There has bee assistance but leads right back to nothing is wrong. THey do not understand what is happening. The phone should not be doing that. I have my own reasoning behind why as data manipulation by the FEDS is wider spread than many think.

    Commenting on Christian’s post, just the fact that Sprint or any corporation puts in their contract that you waive your right to a trial by jury, makes the contract unconscionable. Your rights are your God given rights and they can’t be taken away by some corporate fine print, especially if you did not knowingly intend to waive those rights. Sprint has been the worst experience ever and I’m thrilled to see so many people voicing their complaints online against them. I’ve been with them for many years and this will be my last. I’m more than fed up with them for all the many lies, false statements, misrepresentations, making promises they never keep, for spinning their customers thru a system that thrives on passing you off to the next rep until they end up disconnecting your call, forcing you to start all over again. Seriously, if I want to ruin my day, I can call Sprint’s customer service. It works every single time.

    And to anyone in Hawaii who thought they were on a 4g network with Sprint, think again. If you were told you were on 4g, you were outright lied to. Your phone may be 4g, but your service with Sprint in Hawaii is not. It won’t be till after October 2014 and who knows if that is even accurate. I verified that with 3 different supervisors already so you can take it as fact. To the few people who claim to have had a good experience with Sprint, savor the moment, … it will pass.

    They made a technical support appointment with me for last Friday to reset my service since my internet started linking to a Venezuela website. They completely stood me up. Another supervisor was supposed to call me back within 72 hours after an incident where I called to claim my long overdue upgrade. They said it was no longer available because I went on the family plan. They said it should have been disclosed to me at that time, but it never was. They promised a supervisor would call me back within 72 hours, which would allow them time to pull the recording from the call with the rep. But nobody ever called me back. When I called them today, there were no notes whatsoever in the file indicating anything about what we had discussed regarding that issue. OMG what a complete waste of time and energy. It’s completely unacceptable. I give this company a big fat skull and crossbones warning. They deserve to be sued.
