A class action lawsuit filed in Texas Federal Court accuses BMW of not only selling 2007-2011 model cars with defective turbochargers, fuel pumps and software, but also of secretly replacing the defective software without owners’ consent with new software that causes even more problems and voids the warranty.
According to the BMW class action lawsuit, an undisclosed defect in the turbochargers, high-pressure fuel pumps, software affecting the turbo system, and/or waste gate mechanisms in these vehicles led to underlying problems that caused BMW to begin widespread installation of a new version of its ECU software. The BMW turbocharged class action claims this software was installed without the consent of the respective BMW owners, and that the new software causes numerous problems and changes in the performance of the vehicles, including problems with “turbo lag” (dangerous acceleration delays), going into a “limp mode” (sudden loss of power), decreased gas mileage, and decreased performance. The only way customers can fix these problems, the class action claims, is to install an aftermarket ECU flash update that costs thousands of dollars and voids the warranty.
“The appropriate and reasonable ‘fix’ by BMW would have included replacement of the defective turbochargers, high-pressure fuel pumps, and/or waste gate mechanisms, or installation of an adequate ECU software update,” the class action lawsuit says.
The BMW twin turbo class action lawsuit is brought on behalf of all current and former owners and lessees of 2007-2011 BMW 135i, 335i, 335xi, 535i, 535xi, X5, X6 and Z4 sDrive 3.5i models equipped with N54 3.0 liter twin turbo incline-6 engines that were sold or leased in the state of Texas.

I went to bmw to get a high pressure fuel pump fixed, and bmw said that they could not do anything about it.

I have two 135i bmw 2008 2009 and almost died when it went into limp mode. Three different mechanics said it was the fuel pump bmw will do nothing for its customers. Our family Owns 3 and we will never buy another one. Bmw does not stand behind its products or its customers! Tim abel

I have 2012 BMW 740li n54 engine after I took my car to the dealer I noticed a long start and when I took my car back to check the problem I had to pay for fuel injectors and when I got the car back my car will go to limp mode and the links nag start still exist toke it back they told me fuel Pressure sensor need to be replaced when I got the car back the problem still exist took it back to them they told me fuel pressure regulator when I got the car back drove it for about 10,000 mile and then my car star gone to Limp mode again took it back to the dealer they told me my high-pressure fuel pump is bad need to be replaced all that within 10,000 miles when I called the dealer for the High-pressure fuel pump defect on the n54 they claim thats my car is not include and my car is 2012 built in 2011 my car is a year newer and all the Asr problems start after an oil change
I have a 2009 Mini Cooper Clubman S that I have had to pay out money to get a turbo replaced and timing chain and the car had less than 45,000 miles on it. I fear that I could have this happen again and be stuck with this car. I wanted to be compensated for the money I was out and the hassle I went through because of it.
