Wachovia "Pick-a-Payment" Mortgage Loan Class Action Settlement

WachoviaPreliminary approval has been given to a class action lawsuit settlement between Wachovia and certain borrowers who obtained Pick-a-Payment mortgage loans between 2003 and 2008.

 

The Wachovia Pick-a-Payment class action lawsuit settlement will resolve claims that World Savings Bank and Wachovia Mortgage (a division of Wells Fargo Bank) violated various state and federal laws in connection with the Pick-a-Payment mortgage loan product. The lawsuit is styled In re Wachovia Corp. “Pick-A-Payment” Mortgage Marketing and Sales Practices Litigation, Case No. M:09-CV-2015-JF.

 

The Pick-a-Payment mortgage loan permitted borrowers to select and make a minimum payment amount for a limited time under certain conditions. When a payment was insufficient to pay the interest owed, unpaid interest was added to the loan balance and the outstanding loan balance increased (a practice called “negative amortization”). Plaintiffs in the Wachovia mortgage class action lawsuit claim that Wachovia did not adequately disclose the Pick-a-Payment loan’s potential for negative amortization.

 

Wachovia denies any wrongdoing but has agreed to establish a $50 million settlement fund to resolve the case.

 

If you obtained a Pick-a-Payment mortgage loan for a primary residence from World Savings Bank or Wachovia Mortgage at any time between August 1, 2003 and December 31, 2008, you may be eligible to claim money from the $50 million Wachovia class action settlement.

 

The amount of money you can receive will depend on how many people file valid claims and which Settlement Class you fall into:

 

Settlement Class A includes borrowers who no longer have a Pick-a-Payment mortgage because they sold the property securing the loan, refinanced the loan, personally paid off the loan, or have already obtained a loan modification that converted the loan to a regular mortgage.

 

Settlement Class B includes borrowers who still have a Pick-a-Payment loan and their mortgage payments are not 60 or more days past due (as of December 16, 2010).

 

Settlement Class C includes borrows who still have a Pick-a-Payment loan and who are 60 days or more past due (as of December 16, 2010).

 

If you are a member of Settlement Class B or C, you do not need to do anything to receive a payment from the Wachovia Pick-a-Payment settlement. You will automatically be mailed a payment if the settlement receives final approval.

 

If you are a member of Settlement Class A, however, you must submit a claim form postmarked no later than March 16, 2011 to receive a payment from the class action settlement. Claim forms will be available on the Settlement Administrator’s website on January 28, 2011.

Absolutely everything I have read happened to us too. I been through the World Savings, Wachovia pick-a-payment or Libor loan. Now it is Wells. We are paying almost 7%, have excellent credit NEVER missed a payment.....we cannot get a loan modification, refinance, nothing. I did not even know about this Class action LS. To be honest, I ended up having nervous breakdown and am now on disability. I made formal complaints and just kept getting the run
around . I sincerely spoke with some of the dumbest and
rudest representatives . Pathetic. I have no help from my
husband. He frankly does not care, so I gave up and have
given it to the Lord.

God has bless me with three kids and a loving husband, i promise to share this Testimony because of God favor in my life, 4months ago i was in desperate need of money so i thought of having a loan then i ran into wrong hands who claimed to be a loan lender not knowing he was a scam. I use to bank with Wachovia bank 2007. I didnt have a mortgage loan but i had problem with my account with wachovia. My account some time overdaft when i had money in it. One time when I had my phone service with centurytel and tv service dish tv thur the phone company. Dish tv took money out of my account with me telling them to get the money out of my account. I was wondering can get in on the class action settlement for Wachovia Bank.

Berns and Weiss never disclosed on the papers sent to opt out, neither on the website... until it was too late, that there were more than half a million people involved. Everyone would have opted out, because that was the writing on the wall. They collected the money and out of that half million they are only "helping" 30 taking it to court AGAIN, and more than likely collect $$$$ on top of the million each of the 26 attorneys involved received with the 2010 lawsuit. I am reporting them to the state bar, that was -misrepresentat ion. Think people, they would never help more than half a million people. Just line their own pockets. They should be the ones to be sued by all of us. Jeremy Vogel, Judge in San Jose Court allowed this to happen.

Hello Mauro, I believe there was a time frame. But maybe if you contact the lawyers they are able to help you, Berns and Weiss. I am doing a modification with a lawyer. They told me that wells fargo was the worst to accept any loan modifications.

Yeah these Berns and Weiss are a bunch of shit too. They tell me now that because I eventually got the modification but only because I hammered Wachovia for over 9 months and was denied twice over that time and even with all the BS they are pulling on me now they don't want to be bothered with me. They first told me that because I was in Bankruptcy now they couldn't sue for me, but that was BS and I knew it and told them why, so now they have come up with this new excuse. I thought they were different but they are just like all the other lawyers I have known. They don't give a shit! By the time they might be ready for me, my time will have run out and I probably won't even be here anymore. Shame on these Guys! Just when you think someone is going to help, they turn out to be just like everyone else. Money Grubbing Liars out for themselves only. If I don't win the lottery, I'll probably lose the house and without it be dead by this time next year. I've had 2 heart attacks over all this stress within the last 6 years and the 3rd is not far off. Thanks a Lot Lawyers. For NOTHING!

I had a pick-a-payment loan but was modified before and separate from the settlement agreement on my own as part of a bankruptcy Chapter 13 HAMP loan. Eventually I got $178 settlement for the pic-a-payment. CHUMP CHANGE! I was denied twice for the HAMP modification before I finally figured out the numbers they wanted and raised enough actual and acceptable income to be counted and made the 31% monthly income to payment ratio. It was very difficult and they tried their best to deny me, but I kept hammering until I qualified for the "trial Period". I made it through that fine and was finally approved for modification, but then 2 months into the new loan they retroactively raised the payment on me by over 25% really hurting me. Besides the fact that I already made the payment before they raised it. They held that entire payment in suspense for over a year and deducted late charges from it every month. At extreme hardship to me, I have been making the higher payments on time and for over another year, but in the process they have messed up my loan so much by retroactively raising my payment after the due date, placing payments in suspense and counting payments late ever after that for over a year before they figured out they messed up. They finally midway through reversed all the late fees, but then misapplied them messing it up again and it started all over again counting me late. I had to write 3 separate 15 to 17 page complaint letters over a period of almost a year before they finally acknowledged their mistakes and fixed it... apparently. Its been 2 months since then and 14 months since they first started this crap but I still think they are still keeping 2 sets of books because they still think I am a payment behind every month when I call to make my payment. Also I believe they have done everything possible to make this loan fail in violation of the Pic-a-payment settlement. I am in contact with Berns and Weiss and we are talking about the next suit. Its Coming SOON they tell me. Not soon enough for me! I can’t wait. I need the money now and it should be about time that these crooked banks feel the sting of their actions. They rob us of Trillions and pay us back $178 each. That’s just Great! Does anyone know where they give you Trillions of Dollars and you only have to pay back 800 Million? That is one pretty fine return on investment. This is one time I say HOORAH for the Lawyers! GO BERNS AND WEISS!! Just Hurry up, Please. That is my experience with HAMP for BLANCA above. They have a new program out now called HARP and HARP2 that you may wish to apply for, as they are similar to HAMP1. Since I had HAMP1 they are telling me I am ineligible for HARP or HARP2.

The lead attorney has now figured out that Wachovia/wells has not complied with the terms of the settlement. Berns Weiss are legit. They want denial letters from people to confirm the pattern of Wachovia/Wells not modifying any pickapays. They may sue Wells. Go to www.law111.com. The government should have said you will get NO MONEY from us you will have to WORK with the people even if it means making .05% interest on a loan for 30 years. I am going to SUE Wells Fargo. I am going to WIN because what they did was INJUST and DECEITFUL and HEARTLESS. I have every single document/name/ id and letter with envelope ever sent to me. I have the original loan document copies where the title note and deed don't match. I have the original emails form the lender stating my rate was suppose to be locked for 5 years. funny thing I never received the paperwork to complete. March 2012 3 offers on the house. They throw out the "VA" offer cause they don't want to wait for a government approval. Way to treat our vets. April 2012 they tell us they are backed up we can stay til August. That afternoon we get papers stating July 1. May 2012 a week before Memorial we are notified we have til June 13 to vacate. So here I sit telling you we tried to be proactive in getting out of this loan and the BANK screwed us for our good effort and STOLE our home DISPLACED our family and to this day spits in our FACES because the JUDICIAL system and GOVERNMENT allow them too.

Dec 2011 Wells Fargo representative from the Ofc of the President of Wells Fargo contacts me for a response to OCC complaint she lies and says I am non-responsive funny thing I have proof of all my failed attempts to contact her (its called a phone bill) Jan another rep from same dept contacts me (oh did I mention I have now applied for a modification four times) I need to complete my fifth and final mod app Jan 2012 Notice of Auction on my front door Feb 2012 told short sale or we will foreclose Mar 2012 six offers on the table they deny my modification (surprise there) I mention this settlement and I am told a rep will contact me I get a letter a few weeks later saying that I forfeit my right because I never provided the paperwork necessary

Sept they start rtn my checks claiming I owe $12000. October File and NOD November I file a complaint with OCC. I speak with a receptionist for J. Stumpf CEO and Pres of Wells Fargo in order to set up an appt/mtg she states Mr. Stumpf does not meet with "common people" he sure has no problem taking my money and going on CNN claiming he want to be here for the people and help make this situation right

They establish an escrow acct under "Breach of Duty Clause" which states they can pay impounds if you "breach you duty" and don't pay them. The next thing I know my payment goes from $2100 to $3100. I send them a ltr stop cancel this bogus escrow acct ect adjust my payments back to $2100. The create a "suspense acct" which is illegal. Wells Fargo misappropriates my funds for every 2 mtg pymt I make they charge me two late fee and one past due mtg in the amount of $3400. My husband and I receive seperate ltrs one says he owes $4000 in back mtg mine says $9000 we have a single mortgage. So do we owe 4 or 9 or $13,000.

I tried to refi in Jan 2011 I was current just wanted out of this loan. I was told they don't do refis only modifications the next thing I know they are claiming I am failing to make my pymts. Funny thing I have all the cancelled checks. Then they claim I breached duty by failing to pay my property taxes, home insurance. Funny thing I have proof fm LA Cty Tax Access Ofc and my home insurance company I am current and paid.

Beware of the loan modifications as it takes you out if your original World Savings Loans that were securitized which dud pay off your mortgages... Yo u will probably loose the ability to take that approach if you modify your loans. Chances are your loans have all been paid off two or three times. If you look at the original note it says "when this debt is paid in full"...it doesn't say it has to be paid "by you" and it doesn't say paid three and four times. The bank probably owes you a ton if money since they continued to collect payments from you after your debt was paid not to mention "double dipping" after your loan was securitized. We all need to stand up to the banksters.

I have been in touch with Jeffrey Burns the Supposed Plantiff Attorney. Even if you did not opt out of the class action you can still sue the bank. Everyone needs to get a copy of the class action settlement and go to page 42 where it discusses the court mandated modification program that Wachovia and Wells said does not exist. Write emails to Burns as well as to the Judge and Defendant attorney. I understand there is over 250,000 people they were suppose to modify and set aside a billion bucks. Program vanishes (well it never really existed in 2013) or just modify your loan to 0 owed and record it since World never signed your original loan docs and only you did..heard this is also working!! I have not got a bill all year !!

We refinanced after our pick a payment reached $199,000 but are now facing foreclosure due to inability to pay the new loan. The principal would have never gotten that high had we not been in the pick a pay mortgage which tacked $40,000.00 on to our principle. Do I qualify for the mod?

Ok, so I just received a letter in mail today from BernsWeiss attorneys who claim to have been a lead attorney in this class action lawsuit with Wachovia. They seem to be investigating the fact that they promised to give out loan modifications, but failed to do so. Has anyone else received a letter in mail?

Did you purchase your house in May 2004 or before? I think there is a time frame to qualify. I think the 178.04 or $2000 is nothing compare to the mortgage payments we are stuck with. I wish I could just refinance my interest. WF makes it hard to do a HAMP.

I think I was wrong about the date I posted earlier. I was moving at the time and i already new my new address. I got a letter in October 2011 stating I needed to fill this claim out by Dec 16th or there about. I filled it out online because I met the criteria to do so and submittet it mid October. I know this because I moved to my new place on Oct 20 2011. I had put the new address so the check would come there. Does this sound right to everyone? They are waiting for funds from Wells Fargo for disbursement. The court order has not been finalized. The fuds won't be available unitl at least May 2013 and it won't be as much as you thought it would be.

bret, you can email or call at: 1-877-265-3993. i emailed them on feb. 7, they replied: "We do not have a distribution date at this time." on the letter, it said the checks should be mailed anytime after 1/31/12. so it could be one month or a year later :( ...i'm hoping it's sooner though.

It also stated a minimum of $2000.00 would be sent. It is now Feb 13, 2012. Checking my mailbox every day. Wondering what the phone number is I can call to check status. We have one of these loans and have tried numerous times to do a loan mod and have been turned down 3 times. We just heard about this class action suit and am wondering why we never received notification of this suit prior to its settlement. Does anyone know who we can contact?? The only thing we can think as to why we didn;t get any notification is because it was made to an LLC, instead of an individual. Shouldn't matter still a bad loan!! We got the check and will never collect it, this is blood money. I contacted the governor of CA twice, Kamara Harris, Sacramento, FTC, Obama, faxed a letter to Obergast & Berns, lead attorneys in CA..... zero result. It wasn't enough to be raped by the banks, now the attorneys had their turn. I will never vote for anyone in government. 517000 were thrown in a shark tank, the sharks being the banks and attorneys. Wachovia told us to stop paying while working on the loan mod, 3 months. They sent a letter that a new account had been opened for us, two days later they cancelled. Credit rating went down and we had to pay penalties. Why does the government endorse this behavior. So much for the land of opportunities. Not.

I received a notice in the Pick A Payment Settlement last December stating that they had mailed me a check in the settlement and it needed to be cashed by October 7th of last year. I called the number on the card and was told that i needed to write them a letter stating I did not receive the check. I immediately wrote them a letter stating I did not receive payment and have been calling them every since. They rudely say they have thousands of responses and have no idea when they are going to repost the checks.I have a feeling they are not going to repay these claims unless something is done. You had to have filed a Claim Form either by mail or online by December 9, 2011 to receive the settlement check. The original settlement states that no one shall receive less than $2,650. I questioned why the letter that was sent out says $2000 as a baseline and was told the DOJ AG's Office was who set the amount. Well they set it at $2.650 minimum. This claim was strictly for people who lost their homes to forclosure during 2009 - 2010. There were specific dates. You can find the original settlement on the State of California, DOJ AG website. I opted out of the $178 settlement so I wouldn't be limited in future suits. I also just received letters asking for specific information regarding my pick a pay loan. This is being request by the Federal Govt. now.. They are now investigating all the major banks...Good Luck to all and may everyones future be much better than the past couple of years.

I send an email to the settlement administrator questioning the letter that I received. I had a reply stating that sometime after January 31 I will be getting the 2000 check. I hope this will go to Avery person that receive the letter and I hope that when they said that sometime after Jan 31 is not going to take the whole year. I lost my house and I have been without a job for the last 14 months. This will help me alot.

I would be interested in learning if anyone who opted out of the class action suit has subsequently filed suit against them. I understand that the class representatives got about $150K each and there were like 16 of them. I intend to sue them independently and negotiate down my principal balance but timing is everything and I want to find out what the statute of limitations is to file suit and if anyone else has been successful.

I also was a part of the Pick-a-payment. I am in California. I received a check for $178.04. I will not cash this. I tried to get a loan modification and they denied me. Now they have me on interest rate that changes yearly. That just came in the mail. I tried to call today and of course, they systems are down. I am appealing their decision. If I am denied again, I am getting a lawyer. Enough of this ppl trying to screw the little guys. $178.04, what a slap in the face.

So...I did cash the check, wish I didn't, but needed the money at the time. I'm a single parent, trying to pay all the bills on my own, make ends meet just week to week at this point. I have til next November before it all hits the fan. $20,000 to be rolled onto my $200,000 mortgage! I make $11.25 an hour, which as we all know is nothing. So how am I going to pay the payment come next November? I understand their not to willing to give you a loan modification unless your 90 days in default, and that doesn't even mean they will do it in the end. Its a chance u take, more likely they will want to foreclose! These banks are not for us, all this stuff Obama was talking about with the loan modifications is bull, cause when push comes to shove, all they say is you don't qualify. Then who does?

We also were mislead by World Savings/Wachovi a/WellFargo. In 2007 we refied into this nightmare for $260k when I saw the principal increasing and interest going up. After being denied a loan mod. tried to sell for 2+years finally had to do a short sale 2010. Realestate told us April 2010 don't make anymore payments we owned this for 19 years with no lates.. Short sale closed Aug. 2010 by then my principal increased to $271 K. Now can't buy/qualify for a FHA for 3 years from short sale. Our credit reports show high balance of loan $325 K (wrong) and 120 to 150 days late. Account status ranges from PAID to SETTLED FOR LESS to Unknown. So you can say they have ruined our life also. It anyone starts a lawsuit please let us know.

You're right. We went to buy a used car from who we thought was a private party when we discovered it was a dealer. We went through the steps and when we got to the money/contract part I could feel my blood pressure rising. I firmly put the pen down and looked at the longest contract I ever saw (next to real estate papers) and told the guy how we were victims of the preditory lending and all it entailed. I told him I can't sign the papers because I'm convinced there is SOMETHING in there to distroy us financially!! I am never signing a contract again. Maybe that's the way to get these slimy, oozing people back. They've taken our trust, etc. and we should all go on a cash only basis. That would crush them...

If you are getting foreclosed and you file bankruptsy before they foreclose.that will buy time . i know people that have the intend foreclose and they are still in their house for over 4 years crazy huh! I am posting this to help in any way I can. I just received a loan mod from Wells, the third time! This was recent with re: to the lawsuit. The 1st time we were denied as we didn't make enough, 2nd time denied because after I became employed, we made too much. 3rd time our status has changed radically and this is what they gave to us..They converted the loan to a fully amortizing loan, beginning with a low interest, increasing by 1 point for the two years and capping in 5. They waived 2 months back mortgage we missed along with 2K in fines/late charges, they added our large back property tax bill to the balance of the loan and they required us to impound our taxes going forward as a condition of the loan mod. This was a JUMBO loan, we just signed. If anyone would like further info, pls email with your questions. I am still shocked....

I found a firm that only deals with situations that involves several people (like we are): 'The Public Interest Law Firm' (TPI) Their purpose is to help masses of people, not just one entity. Are they students? I don't know. I am trying to contact them but I think if we all bonbard them, they might take notice. According to them, all banks are watching this Watchovia suit/settlement to see if the courts back the banks on this. If so, as it appears, all banks are going to follow Watchovia's lead. So, the banks get bailed out AND settle so no one can touch them! wow... Stay in touch, please.

I just got off the phone with the administrator. My check was mailed to me but has not been cashed yet she said... I have to write a letter and request they cancel the first check and send me a new one... YEAH RIGHT, I have been unemployed for almost 7 months now and hate to say it but I need that little check to keep things afloat. If the check had been sent to me I'd have cashed it. I have never missed a payment to these guys but when it comes to getting a check from them, I once again have to be the one to jump through all the hoops. My request for a modification was turned down after several months of BS sending them everything more than once only to be told I WAS NOT ELIGIBLE because I was not in imminent danger of default... It's not legal for them to make you opt out of a lawsuit that you never asked to be in.I received the check for $178.04 and I'm not cashing it. That's chump change compared to the interest we all have paid.I'm sure in the future that I will be able to use this as leverage when I decide to re-fi or loan mod.it will probally take years but I won't give up my rights to future compensation for $178.

The loan mod scam has been perpetrated by every bank. Wells Fargo made me jump thru hoops for months only to deny my mod in the end ,stating that Freddie Mac said I DID NOT MAKE ENOUGH MONEY TO MODIFY! My loan was current and had never been a day late. I gave up early...sounds like I am the lucky one as they did not force me into foreclosure...j ust BK. Heads up to everyone. The reason they are offering those pay-outs to leave is because people are successfully stalling their foreclosures for years...do the math. No payment on your home for up to 3 years?? My ex has done exactly that. He found out early on that his bank had no real intention of modifying him, that they were playing games & he successfully turned the tables on them. Ten years ago I would never have been in support of someone doing such a thing, but as my ex's 3rd year anniversary w/out a mortgage payment is upcoming and he is STILL in his home....I am his biggest supporter. He is beating them @ their game....hoooooo rah!!

The reason you read:" Cash This Check Immediately" in bold letters is there is still time to appeal, etc. Don't contact the lawyer they hired to represent us. Either they work for 'them' or they're bad at their job. It' easier than ever to find attorneys that work in this field and they're drooling! I am doing this. I like your idea Allen, except I deposited my check already cause I needed the money unfortunately. I feel they should work with all of us to get a loan modification. That is what the lawyers should have done to help us all out when the civil lawsuit was on. For them to settle for just this $178.04 was not in any of our best interest. I really don't know what I am going to do in another year, cause that's when all the deferred interest will roll onto my payment. So now what?

I have 2 ideas. #1, we all put our $178.04 together and hire an attorney to fight for modification of all of our loans. #2, we all get together and notify the bank that if they don't modify all loans, none of us will make our December payment. Imagine that. If 500,000 people, all didn't pay their mortgage, I think they would be forced to work with us all. If they don't give in, then we all don't pay the next month, or the next, until they cry Uncle. I think it would work. Meanwhil e, you save your mortage payment every month, incase they forclose on us all, so that we can rent a home or apartment. W hat do you think?

Our check is also 178.04, I feel like we have been used. We accepted on good faith that the agreement would be fair and adequate. I believe the attorney's did not act in good faith for our best interests - but rather an agreement that was very lucrative for their firms. I know this is how we all feel. Our loan was with World Savings, pic a payment, we put 20 percent down and had good credit. We were told that if we made bi-weekly automatic payments from our checking - our loan would never accrue any negative interest. Wow was that ever a lie. Does anyone have any advice on what we as a group can do at this point since we have been taken for yet another scam. Or is this the end of the road and we lost? Our loan was classified class A.

I am in class A and recived my paper work reguarding the settlement. I then sent in my claim form because in the forms it states if I do nothing I give up my rights and the deadline was really close so I sent in my claim ,but after doing my reasurch and calling the hot line number I asked how many people are eligible for this class action they told me like 500000 so I did the math and guess what 90 dollar payout. To make a long story short I just recived my 174 dollar check and want to know what to do . Or am I screwed for turning in my claim . we, too, received this 4178 check on friday, 10-13-11. what a joke was my first response, I cannot type here my 2nd response due to the harsh words used. The banks keep screwing us. no wonder the world is participating in "OCCUPY"" I hate to say it, but I think that anyone who didnt "OPT-OUT" u r stuck with the $178. We have tried for the last 1 1/2 yrs to get a loan mod (using a 3rd party law firm) & wachovia denied us everytime. we do qualify, but each time they come back with a different reason. I agree with steve P (above) the judge should have made a mandatory decision and eveyone should have gotten a loan mod) wachovia sucks.

OK, I sent the I don't want to be part of the settlement back whenever I received it and forgot about it. Then on Friday, I get this huge check (LOL) for $178. I went to the pickapaymentset tlement.com site and I don't even qualify for the settlement. It states you have to be 60 days behind and we are current. Where does that put us? We all know by now that Watchovia is not Watchin Ova Us, and is trying to 'guide' us again. I suggest we all consult a few lawyers (online and any way U can) for a consultation. There's no charge to see if there's a way to persue this. An unethical agent? No/poor ethics? A 30 years loan at today current valve of their home and help these individuals out. HELL NO… The system will not do that. Check $178.04 ... If you cash this check, you cannot file a lawsuit against Wachovia about the same class action. You can file a different lawsuit, but not the same. Basically, they get a slap for "Deception" and your $178.00 check is NOT admission of guilt on their part, simply a settlement for adding thousands of dollars "negative amortization" to your subprime mortgage. Unless you have plans on suing, paying exorbitant lawyer fees, I can only suggest you take the money. They will send you a "reminder" notice for those who are waiting out the 90 days.

To get your interest and principle lowered you must apply for a home loan modification. Due to the States losing money on property taxes they became involved. So the best place to apply for a modification is through YOUR state's DA's office. But i would read up on mod qualifications before applying. I got 40K off principle and 3.65 interest plus every year Im a good girl and pay on time i will get an additional 1K off principle for five years. Which i find halarious bc I would have never been late if they had not swindled me.

What I would like to know is if it is lawful to cash the settlement check if you fall into Settlement Class C only because the foreclosure on the property has not yet been completed. Soun ds like some people didn't understand what they were signing when they agreed to their mortgage. I will deposit the check and forget about it.

Same long story here. I am in middle of 3rd attempt with Wachovia. 1st time was in between jobs, told me we did not make enough, 2nd time I had been employed (Wells Fargo now took this one), they took 6 months to tell me we now made too much. We just went back...job/sala ry has been reduced and we are behind in mortgage, CA, jumbo loan, a bit sticky. I think we are near that magic window everyone refers to, our loan is not underwater yet, a small amount of equity left but we could argue that one. Will let you all know. Would definitely be interested in a lawsuit, all slimeballs everyone of them, I think they do everything in their power to find a reason not to modify so they can earn interest on the money! It's a HUGE scam. even with the sad state of the country, it will be far sadder if all of us lose our homes....

The State DA for California is Edmund Brown and can be contacted by website with the details of the settlement. I wonder if Watchovia is testing to see if anyone gets angry or anything? If they really pay $90.00 to each person evenly, I'd be a little nervous if I were them. Do a search for the State DA for your state for details/updates . PS. I knew the checks wouldn't be sent until the very last day, at the very last legal minute, didn't you? Of course!

I just got off with the Claim Administrator. I live in California and the checks were mailed today. According to the administrator I spoke with the estimate of 517,000 claims is consersative. There is actually more. So $96.00 might not be received. I am angry that the lawyers took advantage of the homeowners in this situation and made millions. WHOA! Everybody STOP!! Upon further studies, it's plain we have a near 'run-away-train ' here. It depends on the state you live in, for starters. I live in CA and went to Gov. Jerry Brown's take on this matter. Personally I realize this is still a low settlement for the size we all lost and suffered through, but, to show the quote: "Wells Fargo is also required to pay $32 million in restitution to more than 12,000 pick-a-pay borrowers in California who lost their homes through foreclosure, plus approximately $1.8 million in costs to the state. Payments to foreclosed homeowners are expected to average more than $2,650." (This is me again) It beats $90.00! To go back to fighting is a personal decision, but for me, I've (we) already formed a new and much better life and aiming forward. Sleeping at night ROCKS! We were under water and in bad financial shape on our home in Arizona. We had the "pick-a-pay" loan and were upside down about $400K. We were granted a loan modification, but we still could not afford the mortgage payments. We learned a lot and and finally did a short sale. Wachovia (now Wells Fargo) does not want these loans on their books. We also received $3000 in relocation assistance. Wachovia has made it very easy to do a short sale in Arizona and who knows if anyone will ever get any money from the settlement? My comment, it made it difficult for anyone to make a decission on whether or not to opt out of the lawsuit, with out having every detailed disclosed to you. Like how many home owners are involed in the lawsuit. Let the sum of the disbusment justify that number of home owners involed, not what the banks felt they could afford to sustain a profit. The amount of money paid into the pick a payment program, by the homeowners, I'm sure it's more than fifty million. Another fault on the banks for failing to give full disclosure. This should lead to another lawsuit.

The numbers breakdown this way as of 8/19/11. $49.875 million is the settlement fund total and you divide that by 289 thousand people or settlement payments and YOUR TOTAL EXPECTED PAYMENT is $169.55. I wonder if the TARP Payment total that was given to this bank helps them pay this.....What a joke!!! Don't spend it all in one place folks, and these people are not being allowed to redo there mortgages... what a scam!!!

There must be an expiration date for the completion of this CA lawsuit..The judge gave preliminary approval on Dec 16, 2010. How long by law do they have to complete this process? or can they postpone it indef pending our deaths? Just seems to me that there must be a "completed by" date documented somewhere. I would be interested in knowing what the appeals are. Wells Fargo was just fined $ 85 million and that will be divided up among some mortgage holders but it isn't clear who will benefit from that payment. I assume they couldn't be part of the class action. Although I have been able to refinance my home I am over $100K in the hole because I believe the mortgage broker. From the first month I received the mortgage through World Savings I knew something was terribly wrong and that I was lied to. The mortgage principal either stayed the same or went backwards based on the payments I made, I could rarely pay the full amount and went further into debt trying to hold on. I don't want to settle for this and had I know that this was the path when I opted in I never would have taken this path. Is there anyone that has appealled who can share with us why and a plan going forward? I see people writing with ideas but no one seems to be anwering to the details.

Over the past 1.5 years I tried twice to loan mod. 1st time they said I made too much, next time too little and debt to income ratio too high. Never missed a pymt but currently upside down. Self employed so hard to verify income but was not a problem when getting loan! I recently read where B of A was automatically reaching out to toxic assets like ours and making deals direct without even being contacted. Wonder if Hells Fargo will ever get there?

88 Yr. old mother and husband owned home since 1971. Husband died in 2005, left her very little. In 2006 was tricked into signing loan docs with grossly inflated income & forged signature of DECEASED husband World Savings original lender, should have known something not right with drastic INCREASE in income AFTER death of sole income earner. By 2007 got behind on payments, Wachovia tried to foreclose. Got lawyers, filed lawsuit. They were incompetent, couldn't connect brokers to Wachovia, falsified loan docs. Mother signed settlement agreement with 30% income mortgage payments, 1% interest for 5 yrs then increases, no principal reduction. She had to sign away her right to file any future lawsuits against Wachovia. Currently almost $300,000 underwater. When she can't make payments or dies, Wachovia/Wells Fargo gets the house. Many details left out but this pretty well summarizes story. So she couldn't be part of this class action anyway, right?

The only way they consider is if you are in default and once that happens the real investors get paid by the insurance they have that pays the face value of the loan times 30. So a $300,000 loan is now worth 9 million to the investor. That is why they came up with the great loan mod so those that were paying won't pay and then get denied. But who gets paid? The investors!!!! Individuals that are fighting on there own are getting results there titles quiet and $$ for damages. This is the most debt you will have in your lifetime. You must fight yourself to save your home!!!!! Start with getting a forensic audit on your closing documents. Don't give up!!!!! It would help matters if we can get some of the information here. To all others, a few of us are exploring a law suit gains this so called settlement. How can we do it and how many would be interested and what mechanism can we use to gather a list to explore all avenues left to us if there are any. BofA just settled for a 8.5 billion settlement on its mortgage fraud issue that stemmed from is Countrywide acquisition. That is also being considered not averrable to home owners. I don't know about anyone else, but my loan officer never told me that my rate would vary (go up!) every year for the first 10 years August 1st on my FIXED RATE PICK-APAY mortgagge. Whats fixed about that!!!!! Every page of the mortgage agreement says fixed rate. now that I have gotten my yearly paperwork, going up to 7.50%....what the f!!!! anyone else suprised by not fixed rate. of course when I look at the papers I signed....page 20 spells out the rate increases on my FIXED RATE mortgage. trusted my bank. shame on me

On May 17th Judge Jeremy Fogel granted the settlement. I don't care what the papers said I never signed anything. How did they get my info. They just included me???? What Arbogast & Berns LLP did was fraudulent and the only thing we can do is appeal the settlement. How is the question. There are no attorneys who have the guts to go against other attorneys. Also, write to the Attorney General I did, and sent her a copy of the fax I sent to Arbogast & Berns, basically they are a cesspool. I was finally served foreclosure papers in Feb. and now Wachovia is saying because of my pick a payment loan, they will offer me a $8500 cash incentive (which the attorney gets 40% of it) to short sale my home within 30 days of today. I'm a single mother of 3 and am devastated at this loss. What do you think is in my best interest to do? Those of you that want to start or look at a potential law suit should gather an email or contact list so we can exchange ideas on how to confront this issue. I see many people commenting that they missed an opportunity here, that is what we thought on when most of us signed up. It is a good thing that you missed it, because, you would have felt the same thing that we are feeling now, remorse. Because we have given our right up for peanuts. Be thankful that you did not signup. I too missed the deadline to opt out. Only because I didn't receive the correspondence to the right address. I went ahead and contacted the bank to get them to work with me as outlined in the CA suit. UNBELIEVEABLE what I went through. They would ask me for the same info time and time again when I had already faxed it with confirmation they received it. And get this... they sent me a denial letter twice. In between each denial to modifiy, they kept asking me for more information.... . I would like to know what the hell is going on over there myself. Don't they know that this is our lives and our family's welfare they are playing with? Count me in if anyone finds someone else who will take this on. The attorneys in this suit should be ashamed of themselves!!!!! !

I missed the deadline to opt out, what can i do now. This is another scam, they make you OPT OUT if you don't do anything. This $90 settlement is a spit in our face. The banks want to continue the robbery, everyone should opt out and have another class action suit. What is the deadline crap. The once who want to join this case should have written something. Again I tried twice and believe me it was not my income. THEY MAKE TOO MUCH MONEY ON OUR LOANS. Mine was capped at 7% and interest is 4.5. If anyone thinks we should do this and knows a lawyer willing to help us on pro bono please contact me. I think that the Obama plan was set up to help people stay in there home EXCEPT PICK A PAY LOANS. Anyone with me here. OK reading the comments everyone is right. WACHOVIA/WELLS FARGO whoever they are will not give us poor suckers a modifications. That is where the injustice is. The fact that we got into this smelly loan is one thing but we can't get out! Its like a traingle. I have lost in interest alone over 15,000 in the last 4 years. I tried to modify with Wachovia in 2008 then Wells Fargo 2010. Neither would allow the loan. Why? They make too much money. I think we need a lawyer to represent the people. I think the lawyer who commented should do this. I want my money back....how about any of you? Last they just settled last night and you can read the paper on pickapaysettlem ent.com. The banks have all of the angles.I wonder how many houses the banks are foreclosing on that they are getting back in states of total interior destruction due to their deceitful practices...... . I have not heard of the final conclusion of the law suit. But whatever the results no one from the attorneys and/or either on the web site indicated the final out come and gave any figures. That is an out right deceit and should be vigorously fought in court. This is a double whammy, first you get screwed by World Savings/Wachovi a and now by the attorneys. I have written to the lead attorney on this case asking for answers, after finding news articles which he stated "real cash recovery" would be made to members of the class. Obviously, $90-$100" is not. A bio found says he worked for Wells Fargo some timeI Don't know if accurate. Elsewhere, he reportedly said recovery for the class would be small, then we should have been informed of that. Case against Wachovia was about failure to disclose full facts. Seems disclosure of full facts would be required of plaintiff attorneys. If not,, even if the civil case not reversible, inquiry re responsibilitie s of attorneys to clients could be made with attorneys now, maybe elected officials later.

we had two home loans from wachovia.we re-fied our original home to remodel and sell.then the market went down.we put over $120k down on another house. we were stuck with two house payments.tried for almost two years to get the original house modified.never happened.we ended with a short sale .the other home by that time the house was only worth half of what we paid. kept asking for a loan adjustment.that never happened.went to foreclosure. we moved out of state to get a house we are renting . we are out of least $250k + we paid into the two homes on payments for three years. this lawsuit is a joke if they are only going to pay out a small amount. i feel that the bank should have to pay back everytrhing they took.there were a lot of papers signed illegally for a lot of loans. hopefully it will be straigtened out and we will all get back our money or houses keep hoping for a miracle...

I am just curious we cant qualify for a loan mod after trying several times. One of us is unemployed and Wachovia wont use the unemployment income and we don't qualify on just 1 salary. We thought there was so much money available and that they would work with us. When they plug our numbers into their computers they get a "do not qualify! Who is getting that $600 million dollars in loan mods because we sure aren't! So, once the lawsuit is over and we collect our 90 dollars....what will happen to our loan? Will we still have the same loan we have now? Will new loan papers need to be written up?

HAMP IS A SCAM created by BANKS, approved by our USA GOVERNMENT, and paid by TAX PAYERS.. I was denied a loan modification today by Wells Fargo. It seems if you make 5,000 net income and your expenses are 4,500 you don't qualify for any modification. According to "OBAMA's Administration" under HAMP guidelines, you don't qualify for $hit if your expenses are not more than your NET income. Did you guys understand! Th at means your DEBT/Expenses have to be more than your NET Income. Hello! ! "What about the government taking out taxes, insurance premiums, 401k which we are entitled to when applicable, FSA, Vision, or SSN/Medicare tax, state taxes, etc.... Is that not taken into consideration when considering what one could afford?" I want to know which 4th rate lawmakers decided this one.

I wouldn't be surprised if they helped originate the lawsuit against themselves in order to minimize their exposure to future legal actions. They might have had their attorneys working on both sides of the case. Because ninty dollar sounds like just a rediculously low amount....It's like they are trying to buy off a bunch of uninformed people.

In the packet I was sent it says "in addition to the settlement fund, the Defendents will pay up to $25 million in attorneys' fees and costs and up to $1 million to administer the settlement." I took that to mean that the lawyers fees would not come out of the 50 million settlement fund... but I could be wrong?

The attorney is right. But left out one thing. If you opt out by March 16th, you will then have the right to sue with your own attorney, otherwise, you loose that right if you stay in the class action. The other thing is that I was encouraged by one of the class action attorneys to try (for a second time) to apply for the loan modification. He said that Wachovia has loosened their requirements. We'll see. It's my only hope!

I am struggling to pay my mortgage. If without the little help from my two children, I would not be able to meet my obligation. I was laid off last year and I am on unemployment. I use my unemployment money to fill up but my unemployment is about to end. I have 3 options to pay my mortgage first, minimum payment, 2nd Schedule principal and interest and third 15-year payment plan. I currently chose the minimum payment. I called them to try to refinance to fixed mortgage but they told me I cannot because my mortgage is "upside down" meaning the current value of my home is lower than the principal I owe. I asked for loan modification and they said they have to interview me for at least 40 minutes. I have not done yet because I'm not done with my tax to determine our annual income.

8-) Say you took the loan, tried it for a half a year, did not like it onece you have studied it. Then decided to dump it and refi your loan with anonther bank. You paid a penalty for dumping the loan too early, you paid for a refi, your loan principal went up. Could 100 to 500 cover all of your costs. Really? These people should not get the money but a loan restructuring with a principal modified to a just amount. Will this ever happen???????

Let me explain how it really works. They plan to settle for 50 million and the lawyers are wanting 25 million. The lawyers will then sue the plaintiff for the 25 million. (They will not get it from the settlement nor from the people who are receiving the settlement. ) There are 26 people who will receive 125,000 each. this money is taken out of the settlement. Leaving 46,750,000. So lets get down to business. there are 517,000 people who take part of this Class action lawsuit. So when you divide the money by 517,000 than the total for each person (assuming they all decide to file the claim) each person will get 90.425 (90.43 if you round up). So that is the break down of the settlement. This is what you are looking at if you are part of this settlement. To be honest 50 million is nothing. They should sue them for more because that is chunk change for them. The ones who really win in all of this are the lawyers (who get paid) and the bank (who gets a slap on the wrist)

I was just informed that I do not qualify for a modification. Apparently, if you are struggling but making the awful payments you do not qualify for help. I owe 200K more than my house is now worth. Guess It is minimum payment until it implodes on itself.

I obtained a pick-a-pay loan from wachovia bank in the time of which is stated in the settlement statement. My payments are current for the time being. I tried for a loan modification, but was told that this is not a option for me. I am sure we have a long wait to see what unfolds from this matter.

I have this kind of loan from this bank and wonder if it is real and if the lawsuit goes through what will happen next. I am already underwater and can not re-fi becasue of how much, according to wells fargo. I guess well see, probably in 2012 or later. :-(
