Vonage Class Action Lawsuit Settlement
By Mike Holter

VonageA proposed class action lawsuit settlement has been reached with Vonage concerning its promotional “one-month free” and “money-back guarantee” offers and certain charges it imposed. As a result, anyone who subscribed to Vonage services on or before January 3, 2011 may be entitled to cash from the class action settlement.

The Vonage settlement will resolve a class action lawsuit, entitled In re Vonage Marketing and Sales Practice Litigation, that accuses Vonage of misrepresenting the scope of its promotional one-month free and money-back guarantee offers; of improperly collecting certain disconnection, cancellation or termination fees; and of continuing to charge subscription fees despite requests for cancellation. Vonage denies any wrongdoing but has agreed to pay $4.75 million to settle the class action.

To be considered a class member of the Vonage class action settlement, you must have subscribed to Vonage services on or before January 3, 2011 and were unable to receive a full month of free service, did not receive a full money-back guarantee under certain circumstances, were charged disconnection fees after cancellation, or paid for monthly service after requesting cancellation.

The proposed Vonage settlement provides four categories of relief:

Category 1 – One-Month Free Claims: Class members who were not able to receive a full free promotional month of service because the service began on the date their accounts were administratively opened and not the date full service was available for use are eligible to receive $10.

Category 2 – Money-Back Guarantee Claims: Class members who were not able to receive full service during the money-back guarantee period will be eligible to receive payment for any fees and charges they paid (refund not to exceed $25 for the monthly service fee and $80 for equipment charges) with submission of an eligible claim.

Category 3 – Disconnection Fee Claims: Class members who were charged disconnection, termination or cancellation fees for cancelling Vonage service and did not receive a refund or credit from Vonage will be eligible to receive payment for those fees (refund not to exceed $40).

Category 4 – Post-Cancellation Service Fee Claims: Class members who were charged monthly service fees after cancellation and did not use these services are eligible to receive payment for such service fees (refund not to exceed $50) with a sworn declaration.

In order to claim any of these benefits from the Vonage settlement, you must submit a claim form online or postmarked by July 9, 2011. (This date may be extended if the Final Approval of the settlement is delayed.) Claim forms can be found at the Settlement Administrator’s website at www.SettlementVonage.com

I filed one of these claims for all of the crap they pulled. I was very surprised when several months later I did get a check from the court appointed trustee for $251.00 witch was the full amount they stole from me. Now I am getting a collection letter from a company called EOS CCA 700 Longwater drive Norwell, VA saying that vontage has placed my account with them for collection of $225.15. I called this collection company and ask if they were aware of the class action settlement and how could I owe them anything when the court made them send me a full refund. They wanted me to send them all this documentation of the class action suit. I told them to do there job and look it up and I was not going thru all that trouble and time after what they put me through. I am sending the Judge a copy of this collection notice maybe the crooks will have to send me another check for harassing me asgain. They haven’t learned anything.

  4. Margery M. Campbell says:

I ordered service from Vonage and had monthly fees deducted from my account long after I had found that their service and equipment wouldn’t work in my area. They would not refund the fees and I ended up paying them another $87.00 after being threatened that they would put it in a collection agency and ruin my credit.
    They are crooks!!

checking on my claim number 6MQL0L.
vonage owes me money for verbal promises they didn’t keep and then kept charging my credit card for services I didn’t have because they didn’t work. Never going to do business with this sneaky company again.
I’m wondering if there have been any further developments in the claims process?
